A Wrongful Death Lawsuit
In this particular complaint, a widow from Missouri has filed a complaint against Janssen Research & Development, Johnson & Johnson and Bayer Healthcare – three companies involved in the manufacture and distribution of Xarelto in the U.S. – alleging that the negligence of these firms led to her husband’s wrongful death.
According to reports, the decedent was prescribed Xarelto in December of 2012 by his physician. He continued to use Xarelto until May 4th, 2013, at which point he was admitted to an intensive care unit where the hospital staff discontinued his use of the drug.
On May 22nd, 2013 the man died from an intracerebral hemorrhage which is a type of stroke caused by bleeding within the brain tissue.
The plaintiff in this case argues that her husband would not have taken Xarelto had he known about the risks associated with the drug.
She is suing to recover compensatory damages including medical expenses, loss of earnings, loss of companionship and funeral expenses incurred as a result of her husband’s use of Xarelto.
In addition to other allegations, the plaintiff claims that the defendants failed to warn the public about the dangers of certain Xarelto side effects and furthermore, intentionally hid information about risks associated with the drug.

According to the Xarelto lawsuit, Lois M. began taking Xarelto around April 2011 upon direction of her physician and allegedly, as a direct result of ingesting Xarelto, suffered an irreversible internal bleed which led to her death on June 3, 2013.
The Xarelto wrongful death lawsuit claims that both Bayer and Janssen Pharmaceuticals knew of Xarelto side effects and failed to disclose the truth about the safety and efficacy of Xarelto to the medical community and the public.
The Xarelto lawsuit further accuses the drug companies of manufacturing a defective product, that Xarelto is dangerous, subjecting users to risks of blood clots and irreversible Xarelto bleeding, and that the drug makers failed to properly warn about the lack of a Xarelto bleeding antidote to reverse uncontrolled bleeding caused by the blood thinner.
Xarelto Bleeding Risks
Approved in 2011, Xarelto is one of three new generation blood thinners and is co-manufactured and marketed by Janssen Pharmaceutical and Bayer. Xarelto is commonly prescribed to prevent blood clots in patients suffering from atrial fibrillation, deep vein thrombosis (blood clots deep within the body), pulmonary bleeding, stroke, and for patients who have recently undergone a knee or hip replacement surgery.
It generally is prescribed as an alternative to warfarin, a blood thinner that was introduced in the 1950s. The most serious potential Xarelto side effect is severe internal bleeding that can result in death. Even more concerning is there is currently no available antidote to reverse the type of internal bleeding caused by Xarelto like there is with warfarin.
Other potential Xarelto injuries include thrombosis (blood clots); decreased hemoglobin (a substance that carries oxygen in red blood cells); cerebrovascular accidents (an event that leads to a cerebral hemorrhage); hematoma (a semisolid mass in the blood); peripheral edema (swelling of the lower limbs); and dyspnea (difficulty breathing).
Xarelto still does not have a “black box” warning informing patients or doctors that Xarelto can cause irreversible bleeds. In fact, a label change as recent as March 2014 still fails to contain this type of warning.
Xarelto Bleeding Lawsuits
The Xarelto bleeding lawsuit is seeking equitable relief, monetary restitution, and compensatory and punitive damages for Janssen Pharmaceutical’s and Bayer’s alleged deceptive marketing practices, putting profits before consumer safety, and directly causing the death of Lois M. by their willfully negligent actions.
The Xarelto Bleeding Lawsuit is Case No: 2:15-cv-01876-EEF-MBN and is incorporated into the larger Xarelto MDL Case No. 2592 in the U.S. District Court for Eastern District of Louisiana.

Two new studies link Xarelto to stomach bleeds and eye hemorrhaging

Johnson & Johnson's blood thinner has been linked to uncontrollable bleeding events in the past, and now, according to Drug Watch, new data has emerged that Xarelto increases the risk of stomach bleeding and eye hemorrhaging. While the two new studies are concerning, because these are two newfound side effects of the blood thinner, the main concern is still uncontrollable bleeding events that lead to death. A similar blood thinner drug, Pradaxa, settled 4K claims involving uncontrollable bleeding events for approximately $160K per case.
According to court documents, there are currently more than 300 lawsuits filed over Xarelto in the federal litigation in Louisiana, with an additional approximate 160 cases as of now with similar claims pending in Pennsylvania's mass tort proceeding. Lawsuits against Bayer and Johnson & Johnson's subsidiary, Janssen Pharmaceuticals, include claims of serious health problems and even death as a result of uncontrollable bleeding events. There is no known antidote at this time, according to experts. The federal multidistrict litigation (MDL) is being overseen in the U.S. District Court in the Eastern District of Louisiana (In Re: Xarelto Products Liability Litigation, No. 2592).
Chris Janish, CEO of MTS, commented on the recent studies linking Xarelto to stomach bleeds and eye hemorrhaging, "Clearly this new report comes at a tough time for J&J's Xarelto blood thinning drug as they continue to fight hundreds of uncontrollable bleeding claims, which continue to rise monthly. Collective Xarelto Lawsuit Filed in Federal Court

A new wrongful death and Xarelto injury lawsuit was filed jointly by three plaintiffs who collectively allege that Janssen Pharmaceuticals, Johnson & Johnson, and Bayer violated consumer protection laws and failed to warn the medical community and general public about serious side effects associated with taking Xarelto.
The Xarelto lawsuit was filed by three named plaintiffs, Mario H (who suffered Xarelto injury)., Adam W. as the surviving son of decedent Lamar W., and John W., the executor of the estate of Lamar W.
According to the Xarelto lawsuit, Lamar W. began taking Xarelto in May 2013 in order to reduce his risk of stroke. On May 26, Lamar was admitted to the hospital after he found blood in his stool. For several days, doctors attempted to treat Lamar for severe gastrointestinal bleeding. Unfortunately, Lamar died due to the uncontrolled bleeding on June 2, 2013. Now Lamar’s son Adam W. and the executor of Lamar’s estate, John W., are suing the defendants for economic damages, funeral costs, pain and suffering, and punitive damages.
The second victim named in the Xarelto lawsuit is Plaintiff Mario H., who was prescribed Xarelto in January 2013 to prevent deep vein thrombosis, pulmonary embolism, and stroke. In June 2013, Mario was admitted to an Alabama hospital and was diagnosed with brain hemorrhaging. While recovering in the hospital, Mario’s medical professionals ordered him to stop taking Xarelto. Mario is suing based on the physical and emotional damages he suffered from taking the anticoagulant medication.
Xarelto Lawsuits
Xarelto is a popular anticoagulant or blood thinner prescribed by medical professionals to treat or prevent stroke, deep vein thrombosis, and pulmonary embolism. It belongs to a new generation of blood thinners that do not require patients to follow a strict diet or undergo constant blood monitoring. Unfortunately, unlike some of the more established and traditional blood thinners, like Warfarin, that do require these extra precautions, Xarelto has no known antidote.

Elderly patients taking Xarelto at greater risk of major bleeds

Elderly patients with a common irregular heart rhythm known as atrial fibrillation treated with the blood thinner Xarelto are far more likely than any other age group to experience major bleeding events, according to a post-marketing study investigating the safety risks with the popular new anticoagulant.
The multi-year study involved medical records of 31,883 atrial fibrillation patients ages 19 to 105 prescribed Xarelto for stroke prevention. Researchers used a validated case-finding algorithm to detect major bleeds, which matched diagnosis codes related to bleeding with patient identities. Patient demographics were identified, as was usage of other medications, treatment for bleeding, and fatalities.
Of the patients studied, 622 experienced a major bleed. Twenty of those patients died from their injury. Researchers found this risk to be just less than 1 for every 100 patient years.
The data, researchers said, reaffirmed the safety and efficacy profile that was used to gain approval from the Food and Drug Administration (FDA) in 2011. But the data showed the bleeding risk was far greater among patients who were aged 75 and older. In fact, nearly three quarters of the major bleeding events occurred in patients from this age group. Twenty-one percent of patients 65 years of age and older experienced major bleeds.
The most common type of bleeding events with Xarelto were by far gastrointestinal bleeds followed distantly by intracranial bleeds, or brain hemorrhages.
The Xarelto safety study is ongoing and will include more than 74,000 patients, reserachers say.
Bayer and Johnson & Johnson subsidiary Janssen Pharmaceuticals face numerous lawsuits from people who claim the companies did not adequately warn of bleeding risks associated with Xarelto.
