  8. 10 Things to Know about Xarelto Lawsuits

    Aug 14, 2015 | Golomb & Honik P.C.

Xarelto was approved by the FDA in 2009 for the prevention of blood clots in those undergoing knee or hip surgery. In 2011, Xarelto gained approval to treat those with atrial fibrillation and for stroke prevention in patients. Xarelto has also been approved to treat and reduce recurring blood clots. Johnson & Johnson, the maker of Xarelto, has spent millions of dollars touting the benefits of Xarelto while denouncing the benefits of Warfarin and Coumadin. Unfortunately, Xarelto has been tied to uncontrolled bleeding events, which can lead to hospitalization, serious injury, and even death.
  9. In Moving Forward, a Look Back at Xarelto

    Aug 16, 2015 | LawyersandSettlements.com

    By Gordon Gibb

With the first Xarelto Death and Xarelto Bleeding Issue lawsuits expected to begin about a year from now, in August 2016, it’s instructive to take a look back and see from whence we came. Xarelto is one of the so-called “new age” blood thinners designed to knock warfarin (Coumadin) from its perch with a promise of reduced monitoring heretofore necessary in order to avoid bleeding events (all anticoagulants carry risk for bleeding events). Pradaxa was first out of the gate, with Xarelto having come to the party about a year later, in November 2011.
  10. Future of Anticoagulants Uncertain, Holds Many Options

Patients who require anticoagulation will have more and hopefully better options over the next 10 years, according to a report published by the International Self-Monitoring Association of Oral Anticoagulated Patients (ISMAAP).
  11. 13 Plaintiffs File Joint Xarelto Internal Bleeding Lawsuit

    Aug 17, 2015 | Injury Lawyer News

    By Katarina Siegfeld

Thirteen plaintiffs have filed a joint Xarelto internal bleeding lawsuit over injuries allegedly sustained in connection to the popular new blood thinner. Injuries include severe gastrointestinal bleeding and brain hemorrhage, and ultimately resulted in the death of three plaintiffs (represented by their next of kin). The lawsuit was filed on August 6 in the US District Court, Eastern District of Louisiana, where a major litigation process devoted to Xarelto cases was established late last year.
  12. Blood Thinning Drug Xarelto May Cause Serious Harm Among Patients, Leading To Lawsuits

    Aug 17, 2015 | Kennedy Hodges LLP

When a patient is at risk of developing blood clots that can potentially lead to a stroke, many health care professionals will recommend the use of a blood thinner to help guard against these risks. Xarelto is one widely prescribed medication designed for this purpose. Unfortunately, the use of this drug has been linked to irreversible internal bleeding that can lead to significant injuries in patients, including the possibility of death. It is important for victims to consider legal action against the makers of this dangerous drug in order to obtain the compensation that they deserve.
  13. Xarelto and Pradaxa Bleeding Risk Same As Warfarin

    Aug 18, 2015 | The Legal Examiner

    By Shezad Malik MD JD

According to recent research, the new blood thinners Xarelto and Pradaxa are no safer than warfarin when it comes to bleeding and complications like heart attacks and strokes. Researchers found no difference in the risk of bleeding events or arterial thromboembolism events between any of the three groups for the first 90 days of use.
  14. Xarelto Should Not Be Used in Patients with End-Stage Kidney Disease

    Aug 19, 2015 | The Legal Examiner

    By Roopal Luhana

The FDA approved the anti-coagulant Xarelto (rivaroxaban) to reduce the risk of blood clots in patients going through knee and hip replacement surgery in 2011, and then later to reduce the risk of stroke in patients with non-valvular atrial fibrillation. Within just a year of being on the market, however, Xarelto was linked with hundreds of reports of adverse events, including the development of blood clots, pulmonary embolism, and excessive bleeding. Now, in new clinical guidelines, doctors warn that patients with serious kidney problems should not take the drug, because of risks of blood clots, stroke, and serious bleeding.
  15. New Study Suggests No Difference in Xarelto, Warfarin Bleeding Risks

    Aug 19, 2015 | Top Class Actions

    By Ashley Vanover

Millions of people in the United States are being treated with blood thinners, with statistics showing that about one-in-30 of these patients experience serious bleeding complications associated with blood thinners like Xarelto. However, a recent study published in the July issue of the journal Circulation suggests that the anticoagulant Xarelto poses no greater risk than warfarin in regards to internal bleeding events, heart attacks, and strokes.
  16. Xarelto Linked to Eye Hemorrhaging & Stomach Bleeding

    Aug 19, 2015 | Drug Lawsuit Source

new study has demonstrated a link between Xarelto use and more bleeding complications including eye hemorrhaging and stomach bleeding. This troubling study follows other Xarelto studies that have linked the blood thinner with other gastrointestinal bleeding and even death from bleeding out. The latest study, which was published on the Journal of American Medical Association’s website, raises additional concerns for anyone who is using Xarelto, and it also raises the question of whether even more lawsuits will be added to the ever-mounting cases against Xarelto’s makers, Bayer Pharma AG, Johnson & Johnson and Janssen Pharmaceuticals.
  17. Xarelto Bleeding Risks Equal to Warfarin

    Aug 20, 2015 | Legal Reader

    By Jay W. Belle Isle

Next generation blood thinners have been in the news a lot recently due to claims that the risk of serious bleeding events is greater than tried-and-true Warfarin. However, a new study published in the July issue of the Circulation journal suggests that Xarelto bleeding risks equal to Warfarin. The study examined instances of adverse events such as internal bleeds, heart attacks and strokes. The National Health Insurance Strategy and Research Department in France conducted the study using data from 19K Warfarin patients, 8K Pradaxa patients and 5K Xarelto patients. Researchers were concerned with drug safety particularly during the initial phases of treatment. The patients were taking blood thinners as preventative measures against stroke due to nonvalvular atrial fibrillation.

  2. New Xarelto Lawsuit Filed Alleging that Side Effects Caused Death

    Aug 17, 2015 | Digital Journal

    By Marc Goldich

BloodThinnerHelp.com reports on a new development in the Xarelto multidistrict litigation.  A new lawsuit has been filed in the MDL, now bringing the total number of lawsuits up to over 400 consolidated complaints.

The latest case alleges that internal bleeding was caused by Xarelto.  This side effect resulted in the wrongful death of the decedent from Georgia.

The son of the decedent is the plaintiff in this lawsuit and he is seeking compensation for monetary and emotional damages that have occured as a result of his father's untimely death.

For a complete summary of the allegations of this complaint, click here.

    Latest Wrongful Death Lawsuit Details:

A complaint was filed in the United States District Court for the Eastern District of Louisiana on March 20th, 2015 by the son of a man in Georgia who unfortuantely died due to an uncontrollable internal bleeding incident.

The case is filed under case number 1:15-cv00886 and states that the decedent was prescribed Xarelto for the treatment of atrial fibrillation.

The complaint also states that the decedent died due to a major internal bleeding incident in March 2013.  The plaintiff alleged that was caused by Xarelto usage.

Finally, the complaint alleges that Bayer AG and Janssen Pharmaceuticals, the two firms responsible for Xarelto's manufacturing and distribution in the United States, deliberately concealed information related to Xarelto's safety and the uncontrollable internal bleeding risk.

The plaintiff argues that the death of his father would not have occured if his father had been accurately made aware of the serious risks associated with the anticoagulant in question.

  3. XareltoCares a Leading Blog on Xarelto Launched

    Aug 18, 2015 | Digital Journal

    By SBWire

Stamford, CT -- (SBWIRE) -- 08/18/2015 -- XareltoCares.com is a newly launched website that has been established to inform readers of Xarelto blood thinner uses and bleeding side effects. The main objective of the website is to spread knowledge and educate people to empower them to take informed decisions when regarding the popular blood thinning drug use. The website is being managed by a group of writers who have accumulated a vast range of information through impressive research skills allow them to search out the answers to the most pressing concerns about the use and side effects of Xarelto. The blog recently shared an article about Xarelto Lawsuits that were filed as a result of the side effects caused by the drug.

According to the blog, Xarelto (rivaroxaban) is a recently developed and U.S. FDA approved oral anticoagulant, or a blood-thinning drug. Xarelto is a selective inhibitor of Factor Xa which is used in the prevention of stroke and venous embolism in patients with chronic atrial fibrillation, as well as treatment and prevention of deep venous thrombosis and pulmonary embolism. Although the drug has medically been approved for the treatment of a variety of ailments that require anticoagulant drugs including decrease in the rate of stroke, the use Xarelto similar to other blood thinning drugs has also caused many side effects for users including bleeding adverse events, increased the risk of thrombotic events and risk of developing an epidural or spinal hematoma. According to the blog what makes Xarelto (rivaroxaban) worse than drug of similar effect is that Xarelto has no specific antidote and reversal agents for fatal bleeding side effect.

Many users who have suffered from the adverse effects of the drug have filed lawsuits against the manufacturer of the drug to seek justice and compensation of the suffering caused by Xarelto and their failure warn users about its highly dangerous side effects.

However as the blog explains, Ellen Relkin, Xarelto representing legal claims against Xarelto, states the problems associated with the medication are due to a low therapeutic index. The blog also shares with its readers a list of Xarelto Attorney references that are capable of handling such particular type of cases.

  4. Xarelto Side Effects Lawsuit Update: 1st Trial Location Set

    Aug 18, 2015 | Digital Journal

    By Marc Goldich

BloodThinnerHelp.com reports that the bellwether trials for Xarelto lawsuits will take place as early as August 2016.  The bellwether trials will be heard by U.S. District Judge Eldon Fallon in the Eastern District of Louisiana.  These specific cases are a part of the federal Xarelto multidistrict litigation, or MDL.  At this point, about 550 cases are filed in the MDL as product liability complaints alleging that Xarelto caused individuals a variety of bleeding problems.

"Now that there is a time frame for the bellwether trials, we are expecting more and more cases to come forward," Xarelto attorney Marc Goldich said.

The bellwether cases are meant to help both parties involved in the lawsuit see how evidence and testimonies that will be presented in the litigation will effect the jurors and how they will respond to it.  The results of these trials may not effect the other trials in the MDL, as the point of an MDL is to allow each case to be tried individually.  The presiding Judge, Judge Eldon Fallon, has recommended that 50 cases be initially selected for the bellwether cases and at the recommendation of the court, the first two trials will be heard in the Eastern District of Louisiana, the third in the South District of Texas, and the fourth in the Southern District of Mississippi.

Xarelto Alleged to Cause Adverse Side Effects:

The anticoagulant Xarelto was initially developed to treat deep vein thrombosis and reduce the risk of stroke and blood clots in patients.  It is commonly prescribed to patients who have recently undergone a knee or hip replacement surgery.
Xarelto works differently than other blood thinners because it blocks the enzyme in the blood that is responsible for all blood clotting function, thrombin.

By blocking thrombin, Xarelto is exponentially more dangerous than other blood thinners because there is no known antidote to the drug.  In emergency situations where a patient experiences internal bleeding but is on a blood thinner such as Warfarin, a doctor can administer Vitamin K to counteract the effects of Warfarin and the blood will clot.  These historic antidotes do not work with Xarelto and currently the drug does not have an antidote.

The lack of antidote and risk for severe uncontrollable internal bleeding has caused a variety of adverse events in its users including stroke, hemorrhage, gastrointestinal bleeding, and pulmonary embolism.

    Allegations of Xarelto Lawsuits:

The Xarelto lawsuits that are involved in the MDL all involve similar allegations against the drug's developers, Janssen Research and Development, a branch of the company Johnson&Johnson, and Bayer Pharmaceuticals.  Plaintiffs allege that these companies failed to provide adequate warnings about the dangerous adverse events that Xarelto can cause.

Like all anticoagulants, the Xarelto label contains warnings about the medication’s potential risk of bleeding events, but the lawsuits allege that the information provided is insufficient and fails to convey the serious and potentially deadly nature of the medication’s side effects.

"We strongly encourage anyone who has been injured by Xarelto, or who has lost a loved one due to the dangerous effects of the drug, to reach out to us," says Marc Goldich, " We are available for free case evaluations and consultations and have been working with families from across the country to help them seek justice."

  5. Xarelto Side Effect Lawsuits And The Future Of Blood Thinners

    Aug 19, 2015 | The Legal Examiner

    By Marc Goldich

BloodThinnerHelp.com reports on a new study published by the International Self-Monitoring Association of Oral Anticoagulated Patients (ISMAAP) about the state of the blood thinners currently on the market.  The study states that patients who are in need of anticoagulants will hopefully have better, safer options over the next 10 years. What Are Anticoagulants?

The purpose of an anticoagulant is to reduce or eliminate the risk of blood clots.  Blood clots form when blood platelets and proteins in the blood bind and stick together.  Blood clots are an important function, they stop bleeding when the skin is broken, but they can also be very dangerous.  In some cases, excess blood clots can form in an individual and they can block the rest of the blood’s circulation.  In these cases, an anticoagulant is often needed.Xarelto’s Dangerous Difference & Side Effects:

Xarelto works differently than other anticoagulants on the market because it blocks the chemical thrombin in the blood.  Thrombin is responsible for making the blood clot, so by blocking thrombin, Xarelto takes away the bloods ability to form clots.

This is a desirable effect for many patients, as blood clots can cause strokes and heart attacks.  Xarelto is often prescribed to treat deep vein thrombosis or pulmonary embolisms, but Xarelto is more dangerous because it does not have an antidote to reverse its effects.  Without an antidote, the patient is at risk for an uncontrollable internal bleeding event which can lead to serious injuries and even death.Changes in the Blood Thinner Industry:

As the population ages and more people are in need of anticoagulants, the pharmaceutical industry is increasing their investments in research and development of new blood thinners. Xa Inhibitors, a new class of blood thinners that also includes Pradaxa and Eliquis, are among the most recent releases onto the market.

The global anticoagulant market is currently dominated by North America, specifically the United States.  The United States is expected to continue to hold their place in the market over the next five years.  This can be attributed to the country’s ever increasing awareness of the role of anticoagulants in disease management and their therapeutic applications.  In addition to the United States, Germany, the United Kingdom, Canada, and France are expected to hold major shares of the market.  The growth of the anticoagulant market in Asia is expected to boom in the next five years, especially in Japan, India, and China.Xarelto Lawsuits May Stunt Industry Growth:

Despite these predicted growths, the emerging risk of side effects and adverse events that can be caused by Xa Inhibitors is expected to slow the growth of the industry. As reported in a previousLegal Examiner article, there is a growing number of lawsuits being filed against the drug Xarelto iwth allegations that the drug causes severe internal bleeding that leads to injuries, hospitalizations, and death.   The ever increasing number of lawsuits against the drug is also expected to slow the growth of the industry until new, safer medications come out.

“Now that more reports are emerging on Xarelto’s dangerous side effects, we expect to see more cases come forward.” Marc Goldich, an experienced Xarelto attorney, said.

  6. BloodThinnerHelp.com Reports On Xarelto Side Effects Mentioned In Lawsuits

    Aug 20, 2015 | 12 News KEYC-TV

    By Marc Goldich

August 20, 2015 – /PressAdvantage/ – BloodThinnerHelp.com reports today on the dangerous side effects that Xarelto has been linked to. A large number of prescriptions have been written for the drug because of its convenience and simple dosing method, but recent lawsuits allege that the risks of Xarelto greatly outweigh the benefits.

    Why is Xarelto Different?

Xarelto is part of a new class of blood thinners called Xa inhibitors. Other blood thinners in this class include Pradaxa and Eliquis. Xa inhibitors work as anticoagulants by blocking the chemical in the blood that is responsible for making blood clot, thrombin. By blocking thrombin, Xarelto, Pradaxa, and Eliquis completely take away the blood’s ability to clot. This is the desired effect for many people who are taking blood thinners to treat deep vein thrombosis and other blood clotting disorders, but the problem with Xa inhibitors, especially Xarelto, is that there is currently no antidote for the drug. This is problematic because if a patient taking Xarelto experiences an injury that causes internal bleeding, there is no way to stop the bleeding. If a patient experiences an internal bleeding emergency and is taking a traditional blood thinner such as Warfarin, a doctor can administer vitamin K or promatine sulfate to counteract the effects of Warfarin and the blood will clot. There is no such drug that will work this way with Xarelto, causing many people who have taken the drug serious injury.

Side Effects Allegedly Caused by Xarelto:

The adverse events that patients have experienced after taking Xarelto can be grouped into two categories, one being events caused by serious internal bleeding and the other being events caused by excessive blood clots.

If a patients stops their Xarelto regimen prematurely, they are at serious risk for excessive blood clots. This usually occurs when the patient is transitioning off of Xarelto to a different blood thinner. These blood clots can cause pulmonary embolism or stroke in the patient.

Xarelto has also been linked to cause serious internal bleeding because there is no antidote available to counteract the bleeding. Commonly experienced internal bleeding events include gastrointestinal bleeding and brain bleeds. The seriousness of an internal bleeding event depends on where it is located in the body. An internal bleed in the abdomen can be dangerous because of the high concentration of vital organs in the area. A brain bleed can also be very serious because blood pooling in the brain can cause brain cells to begin to shut down and die, mimicking the effects of a stroke. Serious internal bleeding can lead to severe injury or death.

    Xarelto Side Effect Lawsuits:

Xarelto’s dangerous side effects have resulted in many individuals filing lawsuits against the drug’s manufacturers, Bayer Pharmaceuticals and Janssen Pharmaceuticals, a subdivision of Johnson&Johnson. These lawsuits commonly claim that the manufacturers concealed information about the risks of the drug and some of the lawsuits are currently being consolidated into Multidistrict Litigation in Louisiana Federal Courts and in a Philadelphia Mass Tort group.

Experienced Xarelto attorney Marc Goldich comments on the Xarelto side effect situation.

“With more studies surrounding the side effects of Xarelto emerging, we expect more lawsuits to come forward.”

  8. 10 Things to Know about Xarelto Lawsuits

There are currently more than 400 Xarelto lawsuits filed under a federal MDL, and more are expected in the coming months. If you have suffered injury after being prescribed Xarelto, and are considering filing a lawsuit, the following points could be useful:

Xarelto inhibits the Xa direct factor which interferes with the normal blood clotting abilities of the body. Some people experience an overabundance of clotting including patients with atrial fibrillation, characterized by blood pooling in the heart and clotting. Blood clots which develop in the legs or the lungs can lead to serious complications if not treated promptly.

The manufacturers of Xarelto are Bayer AG, Janssen and Johnson & Johnson. More than seven million people across the globe have been prescribed Xarelto.

Unlike older blood thinners such as Warfarin and Coumadin, there is no known antidote to uncontrolled bleeding events triggered by Xarelto. If a patient experiences uncontrolled bleeding while taking Warfarin or Coumadin, Vitamin K can be administered, which will restore the body’s blood clotting. Doctors can do nothing for patients taking Xarelto who experience uncontrolled bleeding.

Many doctors prescribe Xarelto rather than Warfarin because Xarelto does not require frequent blood testing and, according to the manufacturers, there are no known drug or food interactions.

There are reports that another company has developed a reversal agent for Xarelto and drugs like it, however there has been no approval of the agent.

One Xarelto study found that more than 73% of the subjects in the study developed at least one adverse side effect.

In 2013, sales of Xarelto topped $1.4 billion, making the drug a resounding financial success for Bayer, Janssen and J & J.

Among the lawsuits currently filed, the injuries include gastrointestinal bleeding, rectal and vaginal bleeding, brain hemorrhage, stroke, heart attack, pulmonary embolism and epidural hematoma.

Many of these lawsuits allege the manufacturers concealed important safety information and failed to conduct adequate testing of Xarelto prior to marketing.

There are two black box warnings on Xarelto; the first warns patients undergoing spinal procedures or receiving spinal anesthesia of the risk of paralysis and the second informs those with non-valvularatrial fibrillation that when Xarelto is abruptly discontinued, an increased risk of blood clots or stroke exists.

    Xarelto Adverse Events

More than 1,800 adverse event reports have been associated with Xarelto since its release, with the most frequent issues being gastrointestinal bleeding, deep vein thrombosis, pulmonary embolisms and an increase in hematomas. During the first eight months of 2013 alone, there were 72 reports of Xarelto deaths. Despite claims to the contrary, Xarelto has been found to react adversely with anti-inflammatory medications, some herbal remedies, antivirals and antibiotics.

A report from the Institute for Safe Medication Practices identified 356 reports of serious, disabling or fatal injury associated with Xarelto. Patients who are taking Xarelto while undergoing spinal or epidural anesthesia may potentially experience paralysis. While the FDA has not require uncontrolled bleeding to be a black box warning on Xarelto, it is listed under the adverse reactions section. Those who have experienced injury after taking Xarelto should speak to an experienced Xarelto attorney to determine whether they could be eligible for compensation.

  9. In Moving Forward, a Look Back at Xarelto

    Aug 16, 2015 | LawyersandSettlements.com

    By Gordon Gibb

New Orleans, LA: With the first Xarelto Death and Xarelto Bleeding Issue lawsuits expected to begin about a year from now, in August 2016, it’s instructive to take a look back and see from whence we came.

By 2013, according to Bloomberg (12/4/14), Xarelto had racked up more than $2 billion in sales for its principals: Bayer AG, which produces the drug, and Johnson & Johnson (J&J), which owns the US rights to Xarelto. A year later, the lawsuits started coming - allegations that Xarelto was approved for market without an accompanying reversing agent in the event of a Xarelto Bleedout.

The thinning properties of warfarin can be reversed with an infusion of vitamin K, which can help to stem a potentially dangerous hemorrhage. While doctors have reportedly found various workarounds to help minimize a Xarelto Bleedout, a reversing agent of similar effectiveness to that of vitamin K and warfarin remains in the development stages.

Plaintiffs allege they were unaware that a significant bleeding event could not be stopped as effectively as a similar event involving warfarin, and that Bayer and J&J were negligent in bringing Xarelto to market without a dedicated way to control unexpected Xarelto Bleeding complications.

And what began as a trickle of lawsuits in 2014 has grown by mid-2015 to about 2,000 in number.

In early December, there were attempts to have Xarelto lawsuits consolidated before US District Judge David Herndon in East St. Louis, Illinois, for pretrial proceedings. Herndon had presided over the $650 million settlement involving Xarelto competitor Pradaxa. The blood thinner manufactured by Boehringer Ingelheim Gmbh was linked by researchers, according to Bloomberg, to more than 500 deaths.

“If you have a judge already familiar with these blood-thinner suits, the cause of efficiency would be better served by sending the cases to him,” said Carl Tobias, a professor of product-liability law at the University of Richmond in Virginia, in comments published in Bloomberg last year.

In the end, pretrial proceedings for the Xarelto MDL went to US District Judge Eldon Fallon in New Orleans. Fallon had overseen the consolidation of lawsuits in the Vioxx portfolio that resulted in a settlement of $4.85 billion in 2007, and was touted as a worthy backup choice to Herndon.

As lawsuits continue to mount, Kristina Chang, a spokeswoman for J&J, said in comments published by Bloomberg in December of last year that “the benefit-risk profile of Xarelto remains favorable and consistent with the clinical trials.

“All anticoagulants carry the risk of bleeding, and the prescribing information for Xarelto has always warned of these risks,” she noted in an e-mail to Bloomberg.

J&J and Bayer had wanted the cases to go to New Jersey, but their petition was not granted.

The case is In Re: Xarelto (Rivaroxaban) Products Liability Litigation, MDL No. 2592, US District Court for the Eastern District of Louisiana.

  10. Future of Anticoagulants Uncertain, Holds Many Options

    Aug 17, 2015 | The Legal Examiner

    By Steven Davis

Patients who require anticoagulation will have more and hopefully better options over the next 10 years, according to a report published by the International Self-Monitoring Association of Oral Anticoagulated Patients (ISMAAP).

    What are Anticoagulants?

Anticoagulants are meant to reduce or eliminate the risk of blood clots, which form when platelets bind together and proteins in the blood stick together. Although blood clots play an important part in stopping external bleeding that occurs when skin is broken, when blood clots form in blood vessels, they are often dangerous because they can block the circulation of blood.

Blood clots occurring in the arteries or heart can block blood flow and lead to a heart attack, and clots in blood vessels in the brain can result in a stroke. Anticoagulants stop the platelets from sticking together and the proteins from binding together, and are commonly used to treat deep vein thrombosis (DVT), pulmonary embolism (PE), and atrial fibrillation and to manage the risk of stroke.

    Anticoagulants in the Global Market

The aging population is an important factor in the success of the global anticoagulation market, as are the increasing investments in research and development made by the pharmaceutical industry. The introduction of novel oral anticoagulants (NOACs) like Xarelto, Pradaxa, and Eliquis has fueled tremendous growth in the anticoagulant market, a trend that is expected to continue.

North America, specifically the U.S., is expected to continue to dominate the global anticoagulant market over the next five years, due to increased awareness of therapeutic applications of anticoagulants in disease management. Canada, Germany, France, and the United Kingdom are expected to hold major shares of the market, and Asia is anticipated to exhibit high growth rates over the next five years, particularly in India, China, and Japan.

Strict regulations set by various governments are expected to hamper the growth of the global anticoagulant market, along with the risk of side effects and complications associated with NOACs, which include uncontrolled bleeding, the lack of an approved antidote, and a growing number of pending lawsuits.

  11. 13 Plaintiffs File Joint Xarelto Internal Bleeding Lawsuit

The lawsuit was filed on August 6 in the US District Court, Eastern District of Louisiana, where a major litigation process devoted toXarelto cases was established late last year.

Judge Eldon Fallon presides over the multidistrict litigation (MDL No. 2592, In re Xarelto (Rivaroxaban) Products Liab. Litig., 2014 WL 7004048) in Louisiana created to process the growing number of complaints filed over Xarelto, one of the so-called “next generation” of blood thinners that was supposedly safer and more user friendly than warfarin (or Coumadin), which had been on the market for decades. However, the lack of a reversal agent for the new wave of blood thinners has posed significant risks for patients who experience bleeding events as doctors have limited means to bring any internal hemorrhaging under control.

Plaintiffs in Xarelto lawsuit make numerous allegations

Plaintiffs who have brought the Xarelto lawsuit against defendants Bayer and Janssen Pharmaceuticals, manufacturers of the anticoagulant medication, have made numerous allegations concerning the drug. Among their claims are that the manufacturers failed to adequately research the safety of the drug, failed to warn about its true risk, failed to disclose the need for dose adjustments and blood monitoring, failed to inform potential patients about the lack of a reversal agent, and failed to include adequate warning labels.

Xarelto was introduced into the US on July 1, 2011, the second of the so-called New Oral Anticoagulants (“NOACs”). The first such drug was Pradaxa, marketed by Boehringer Ingelheim in 2010. The drugs were marketed as safer than older blood thinners and much more convenient, requiring less frequent testing and monitoring.

However, the complaint states that Xarelto was “overmarketed” and that the “Xarelto Difference” advertising segments amounted to “nothing more than a marketing campaign based on flawed science,” given that regular monitoring is needed to maintain a safety level comparable to the other generation of anticoagulants and that a lack of reversal agent dramatically increases safety risks should internal bleeding occur. In contrast, vitamin K infusions can often halt bleeding for a patient taking warfarin.

Xarelto plaintiffs would not have used drug had they been warned

All of the plaintiffs suffered serious internal bleeding episodes after taking Xarelto, which doctors found difficult to control. In some cases, patients died: for instance, James W. Burnett, Sr. used Xarelto from February 28, 2013 to August 8 or 9, 2014. He experienced severe internal bleeding, including a brain hemorrhage, on August 10, 2014 and on died on April 5, 2015 due to injuries. He was a resident of DeSoto County, Mississippi, and is represented by his surviving spouse, Margaret Burnett.

The complaint charges that the plaintiffs would not have used the drug if they had been given accurate information about its risks. The joint complaint adds to a growing number of similar lawsuits over alleged Xarelto side effects filed across the country.

Lawsuits about the first new generation blood thinner, Pradaxa, also included similar allegations. Boehringer Ingelheim has agreed to a $650 million settlement deal to wrap up the more than 4000 lawsuits filed over Pradaxa.

    What Is Xarelto?

Xarelto is an anticoagulant, which is a medication that thins the blood. It is used to prevent dangerous blood clots that can obstruct blood flow to the vital organs of the body. Unlike other medications in its class, Xarelto differentiates itself because it can be taken orally and in one uniform dose. Other types of anticoagulants require health care professionals to prescribe specific doses for an individual patient. The U.S. Food and Drug Administration (FDA) approved the use of Xarelto for the following:Patients who have had knee or hip replacement surgery to reduce the risk of blood clots and the risk of a stroke occurring.Patients who suffer from deep vein thrombosis.Patients who suffer from pulmonary embolism.

Despite the significant dangers associated with using the drug, Xarelto sales have amounted to more than a billion dollars.

    Why Is Xarelto So Dangerous?

While many patients and their families are familiar with the use of blood thinners for various medical purposes, few are aware of the dangers associated with the specific drug known as Xarelto. This medication has proven to be dangerous for many reasons, including the following:

There are numerous potential adverse side effects associated with Xarelto use. Perhaps the most dangerous, however, is the risk of uncontrolled bleeding. In addition, patients taking the drug after hip or knee replacement surgery have been shown to later require intensive antibiotic therapy due to serious infections, as well as additional surgeries to remove their implants.

There is no way to turn the drug “off” once the adverse side effects begin to occur. Unlike other anticoagulants, there is no known antidote to stop the drug’s anti-blood clotting effects. This means that hemorrhaging that occurs as a result of taking the drug will continue until the drug is completely out of the patient’s system.

Xarelto can be administered to patients without regular monitoring of the patient’s blood. While Bayer and Johnson & Johnson promoted this feature as a benefit, the reality is that regular blood monitoring may have prevented some of the injuries and even deaths that occurred as a result of Xarelto use.

Tragically, despite the risks that have been shown to stem from Xarelto use, Bayer and Johnson & Johnson have reportedly failed to warn the public of these dangers. As a result, victims have accused the companies of misrepresenting the safety and effectiveness of the drug to consumers and the health care community. Victims allege that the companies knew the drug was dangerous, but continued to sell it anyway to unknowing patients.

What to Do If You Were Injured After Taking Xarelto

Unfortunately, despite the mounting evidence against Bayer and Johnson & Johnson regarding the dangers associated with Xarelto, and the failure of the two companies to properly handle the situation, the drug continues to be both marketed and prescribed. Its makers argue that the drug is still a safe and more convenient alternative to other anticoagulants on the market. If you or a loved one took this drug and suffered injury as a result, it is crucial to take swift action in order to protect your legal rights.

Medical experts are concerned about the new-generation anticoagulants, as they do not have a reversal agent, in the event of a serious or catastrophic bleeding, which can result in deadly results.

Medical Study: No Difference in Bleeding Side Effects

The latest research was published in the July edition of Circulation, here researchers found that there was no difference in the rate of bleeding events, strokes or heart attacks among patients using either Xarelto, Pradaxa or Coumadin (warfarin).

The researchers were investigating the safety and efficacy of the drugs during the early phases of treatment. Typically, patients first begin using the anticoagulant drugs as a preventative measure to prevent strokes caused by nonvalvular atrial fibrillation.

    What are Xarelto and Pradaxa?

Pradaxa and Xarelto are two new blood thinners, known as novel oral anticoagulants (NOACs), which are touted as being superior and safer than warfarin.

But these drugs do not have a reversal agent, unlike warfarin, which means that when bleeding complications occur, doctors cannot stop them. The blood thinning effect of warfarin can be quickly stopped through the use of vitamin K and blood transfusions.

    Blood Thinner Bleeding Risks

Pradaxa is made by Boehringer Ingelheim and is the first to hit the market of a new class of anticoagulants. Xarelto is made by Bayer and Janssen Pharmaceuticals, and is the second to be released and has rapidly gained the lion share of the market.

All blood thinners carry a risk of bleeding side effects, but Pradaxa and Xarelto injuries have become common as more patients are switched from warfarin to the new anticoagulants.

According to several recent medical studies, blood monitoring tests may help doctors identify patients at the greatest risk of bleeding.

Warfarin blood thinning effect on the blood is routinely measured by doctors on a monthly basis, and the makers of Pradaxa and Xarelto main selling point is that blood testing is not required with their drugs.

Boehringer Ingelheim Pradaxa Clinical Trial Data not shared with FDA

In July 2014, the BMJ reported that the Pradaxa’s Boehringer Ingelheim failed to provide the FDA with important clinical trial data. The data suggested that patients may benefit from regular blood monitoring to ensure the drug did not build up in their bloodstream, increasing the risk of bleeds.

According to research in the Journal of Cardiology in October 2014, researchers noted that Xarelto monitoring may have helped doctors understand the effects of the drug on a particular patient and their associated bleeding risk.

    Pradaxa Bleeding Injury Lawsuits

Boehringer Ingelheim faced more than 4,000 Pradaxa lawsuits that allege inadequate warnings were provided about the lack of an available reversal agent for their medication.

The drug company agreed to settle the Pradaxa claims last year, with an average of $150,000 to former patients who developed injuries associated with uncontrollable bleeds.

    Xarelto Bleeding Injury Lawsuits

Many Xarelto bleeding lawsuits are filed with similar allegations that inadequate warnings were provided about the lack of an approved reversal agent and that the companies should have never introduced the medication without an antidote.

Since December 2014, the cases have been centralized before Judge Fallon in the Eastern District of Louisiana as part of an MDL, or Multidistrict Litigation, to reduce duplicative discovery and to have the cases supervised by one judge. As of August, 17, there are over 1,200 federal lawsuits consolidated in the Eastern District of Louisiana.

There are several hundred more cases pending in various state courts nationwide, including Pennsylvania state court, where a Xarelto mass tort was established in January.

Medical Groups Recommend Patients with Severe Kidney Disease Avoid Xarelto

The American College of Cardiology and the American Heart Association, in collaboration with the Society of Thoracic Surgeons, developed treatment guidelines for the management of anticoagulation in patients with non-valvular atrial fibrillation. This is a condition in which the heart beats too fast, too slow, or irregularly. This increases risk of blood clots, heart attack, and stroke, so doctors typically manage the condition by prescribing drugs that reduce the risk of clots.

These medical groups recommended that when patients have chronic kidney disease (CKD), “warfarin should be used” in those receiving hemodialysis, or who have significant signs of kidney failure. They added that rivaroxaban (Xarelto) or other similar anticoagulants “may be considered for moderate to severe CKD,” but that these drugs “should not be used in patients with end-stage CKD.”

According to an earlier 2012 study, CKD is a pandemic public health problem, affecting over 500 million people worldwide. These patients have a higher risk of blood clotting events, and thus require treatment, but doctors have to be careful because these patients are also at risk of bleeding complications. Researchers noted in this study that Xarelto was not recommended in patients with stage 5 CKD.

The problem is that when the kidneys aren’t functioning correctly, they are not able to process and flush out the drugs normally. This can result in too much of the drug in the body, increasing risk of bleeding.

Xarelto Manufacturers Fail to Warn About Health Risks

Any drug that interferes with the blood’s ability to clot has a potential risk of causing excessive bleeding. The question is whether Xarelto increases that risk more than warfarin, the leading anticoagulant for decades.

When manufacturers Janssen Pharmaceuticals and Bayer AG released Xarelto onto the market in 2011, they advertised it as a more convenient alternative to warfarin, since it came in a once-daily dose and didn’t require blood monitoring. In a 2015 study, however, scientists showed that in many patients taking Xarelto, including Japanese patients, blood monitoring would have been helpful in detecting those patients at risk of excessive bleeding.

Manufacturers also failed to warn doctors and patients that Xarelto had no readily available antidote to excessive bleeding. Whereas patients taking warfarin could be treated with injections of vitamin K, there was no similar solution for patients taking Xarelto, making bleeding events much more dangerous.

    Xarelto Lawsuits Pending in Louisiana

Current warnings on Xarelto indicate that patients with kidney problems should not take Xarelto. Plaintiffs who have filed Xarelto lawsuits, however, claim that the manufacturers failed to provide adequate warnings about other risks, such as gastrointestinal bleeding and the lack of an antidote.

All federal Xarelto lawsuits were consolidated into the Eastern District of Louisiana in December 2014.

Study Looks At Xarelto, Warfarin Bleeding Risks

Researchers from France’s National Health Insurance Strategy and Research Department conducted a nationwide cohort study which used data from three groups: 19,713 VKA (warfarin) users; 8,443 Pradaxa users; and 4,651 Xarelto users to analyze the differences between warfarin, Pradaxa and Xarelto bleeding risks.

The study focused on the safety of these blood thinning medications during initial phases of preventative treatment where patients were prescribed the anticoagulants to treat their nonvalvular atrial fibrillation, specifically to prevent the occurrence of strokes.

After gathering and analyzing the data, the researchers concluded that there was no difference in the occurrence of bleeding events in any of the groups during the first 90 days.

However, the researchers caution that the findings do not alleviate concerns that Xarelto and other new generation anticoagulants are safer than warfarin (or VKAs) as there is still no reversal agent for Xarelto bleeding events.

“NOAC cannot be considered to be safer than VKA during the early phase of treatment,” the researchers stated. “On the contrary, the clinical implications of our results are that physicians must be just as cautious when initiating NOAC as when initiating VKA, particularly in view of the absence of an antidote and objective monitoring of the extent of anticoagulation.”

Xarelto Claims to Lower Bleeding Risks

Xarelto has been aggressively marketed as being safer than warfarin. One of its most significant selling points has been that patients, who take Xarelto to treat atrial fibrillation, are less likely to suffer from a bleeding event.

Manufacturers claim that the new drugs posed less of a risk of a hemorrhage or other bleeding complication than warfarin. This study certainly challenges this claim as researchers called into questions whether Xarelto provides additional safety to a patient than its predecessor warfarin.

Xarelto was marketed as being significantly more convenient than warfarin. Warfarin always demanded that the patient stick to a careful diet, submit to frequent blood monitoring and more.

As a new generation anticoagulant, Xarelto has no such monitoring or dietary restriction requirements.

Some say that this convenience factor was aggressively marketed to the medical community and consumers alike. Research suggests, however, that for people who take Xarelto, strict and regular patient monitoring may actually reduce the risk of potential bleeding events.

    No Xarelto Bleeding Antidote

While, the risk of bleeding associated with Xarelto and warfarin was essentially the same according to the study, all blood thinners present at least some risk of bleeding or hemorrhage. Their very nature alone contributes to that risk.

With warfarin, if a patient experiences a bleeding event, even a life-threatening one, the bleeding could be stopped with a dose of vitamin K. Vitamin K quickly and easily reverses the “thinning” effects of warfarin.

Currently, there is no such approved reversal agent to help patients taking Xarelto. In the event of a life threatening bleed, where time is of the essence, there is no way to stop the effects of the drug.

The results of this study do raise concerns about the benefits of taking Xarelto as the lack of an active antidote makes it difficult for doctors to stop or control bleeding events.

    Xarelto Lawsuits

The fact that there is no reversal agent for Xarelto is one of the subjects of several Xarelto lawsuits that have been filed against the drug’s manufacturers, Bayer and Janssen.  The number of filed Xarelto lawsuits continue to rise, all similarly alleging uncontrollable or life-threatening bleeding.

In December 2014, an order was issued establishing a Xarelto MDL and at least 500 Xarelto lawsuits have been consolidated as of August 2015, in the U.S. District Court for the Eastern District of Louisiana.

This troubling study follows other Xarelto studies that have linked the blood thinner with other gastrointestinal bleedingand even death from bleeding out.

Despite these known and highly publicized risks, Xarelto is still prescribed frequently because it is easy to use since it requires fewer checkups than other blood thinners such as warfarin (Coumadin). Unlike other blood thinners, however, there is no FDA-approved antidote for Xarelto’s potentially fatal effects. There is a proposed antidote, Andexanet alfa, made by Portola Pharmaceuticals, that is currently undergoing testing in order to get FDA approval, but, until it has gained approval, Xarelto patients who begin to bleed out can only wait for the drug to wear off, which can take hours and can even be deadly in some instances.

The number of Xarelto lawsuits has continued to increase dramatically over the last couple of months, and, as of the middle of June of this year, there were 552 cases pending, which is more than a 25% increase from the previous month. The lawsuits have been consolidated in multidistrict litigation in the Eastern District of Louisiana after they were found to be substantially similar. The lawsuits all contain similar claims against the makers of rivaroxaban, which is more commonly sold under the name Xarelto. The cases’ plaintiffs suffered various injuries, which they allege are the direct result of using Xarelto, most notably uncontrollable bleeding, which has even resulted in death. In addition to alleging that Xarelto was the cause of these injuries, the plaintiffs also allege that the drug’s manufacturers knew about the anticoagulant’s serious health risks – or should have known – but that they still fraudulently and negligently promoted the product without adequately warning the patients.

The study’s findings indicate that, in the first three months of treatment, there was no difference in the number of bleeding events between the three groups. However, the researchers do not insist that this lends credence to manufacturer’s claims that Xarelto is safer than Warfarin. This is largely due to the fact that there is no known reversal agent for the blood thinning effect of Xarelto.

“NOAC [Xarelto] cannot be considered to be safer than VKA [Warfarin] during the early phase of treatment. On the contrary, the clinical implications of our results are that physicians must be just as cautious when initiating NOAC as when initiating VKA, particularly in view of the absence of an antidote and objective monitoring of the extent of anticoagulation.”

This is a responsible conclusion to reach. Warfarin bleeds, even those that are life threatening, can be counteracted with a dose of vitamin K. While the incidents of bleeds may be similar between Warfarin and Xarelto, those caused by Xarelto are ultimately more dangerous to patients.

Xarelto marketing focuses on the claim that it’s safer than Warfarin, a claim cast into doubt by this study due to the lack of a reversal agent. The drug was aggressively marketed as not only safer, but more convenient than Warfarin. Patients on Warfarin must deal with dietary restrictions and frequent blood tests. Xarelto does away with these requirements. However, the monitoring may actually have the benefit of reducing the risk of bleeding events.

There are currently a number of suits against Bayer and Janssen, Xarelto’s makers, over uncontrollable and/or life threatening bleeding events. A multi-district litigation (MDL) was created in December 2014 to consolidate these suits. As of this month, 500 suits have been consolidated under the MDL in U.S. District Court for the Eastern District of Louisiana.
