    Being one of the latest innovations in the pharmaceutical industry, the drug is said to have ease of use compared to another well-known blood thinner called Warfarin. Its greatest advantage for patients and medical practitioners alike is that when a patient is being treated with Xarelto would not require regular monitoring unlike the other blood thinners; this is based on their claim that the drug is absolutely safe and effective.

    However, based on complaints received from hundreds of Xarelto users, the drug has been linked to the augmented risk of uncontrolled and irreversible bleeding or hemorrhage. This is, of course, the risk posed in most anticoagulant users, but what made it even worse is that unlike other brands of blood thinners, there is no known antidote to reverse the effects of Xarelto. There were incidences that even minor injuries incurred by Xarelto users have resulted to uncontrolled profuse bleeding which are relatively fatal. As a result, hundreds of people have decided to file Xarelto lawsuits against Janssen Pharmaceutical and Bayer Healthcare; the manufacturer and the co-maker of Xarelto.

    Even when there have been alleged claims that the drug has fatal side effects that could result to deaths, there has not been any event that the drug has been recalled from the market aside from one incident where 13,500 bottles of the drug were recalled basically because of the issue of contamination in the Puerto Rico plant. 

    Patients and lawyers advocate filing a Xarelto lawsuit because it is the only way that they could hold the manufacturing company accountable and liable and thereby receive due compensation for emotional and psychological injuries and financial losses because of aggravated medical conditions and prolonged hospital confinement due to Xarelto's adverse reactions.

    Several counts of negligence were charged because of their alleged deceptive marketing, alleged failure to warn the public about the side effects and alleged pharmaceutical trials misconduct. The court is yet to decide on the fate of the case as more and more patients seek to file their case against the makers and distributors of Xarelto.

    September 18, 2015 — Recent U.S. Judicial Panel on Multidistrict Litigation statistics reveal a steady rise in the number of Xarelto lawsuits filed in federal court. Between May 15 and June 15, the increased filings were particularly high. Xarelto bleeding complications have been a problem for thousands of Americans who switched to Xarelto from the former anticoagulant of choice, warfarin (Coumadin). 

    In December 2014, Xarelto lawsuits filed in federal court were consolidated for pretrial litigation before U.S. District Judge Eldon Fallon in the Eastern District of Louisiana. The MDL is called In re: Xarelto (rivaroxaban) Products Liability Litigation, No. 2592.

    The number of cases filed is 552, which reportedly represents a 27.2 percent increase. 

    Xarelto MDL Moving Toward Trial Date for First Test Case

    Both sides in the Xarelto litigation are now working on schedules for depositions and other pre-trial discovery. The first bellwether trial has a tentative trial date of August 1, 2016. The court has adopted the use of new forms, including the pared-down “Joint Complaint” and “Short Form Complaint” that should help to streamline the Xarelto lawsuit process. 

    Defendants in the Xarelto bleeding lawsuits include Janssen Research & Development, Johnson & Johnson and Bayer Healthcare Pharmaceuticals. Xarelto has been shown to cause uncontrollable bleeding and hemorrhagic stroke in emergency situations. Patients taking warfarin (Coumadin) also may experience drug injury such as sudden bleeding, but it can be stopped with an infusion of vitamin K. There is no antidote for uncontrollable bleeding caused by Xarelto.

The lawsuits allege that Xarelto causes severe internal bleeding, serious injuries, and death.

    The order was issued on Friday by U.S. District Judge Eldon Fallon, the judge who is presiding over the Xarelto multidistrict litigation, or MDL. A total of four trials have been scheduled so far. Judge Fallon ordered that the first Xarelto trial will be held in the Eastern District of Louisiana on February 6, 2017 and the second one in the same district on March 13, 2017. The third trial will be held in Mississippi on April 24, 2017 and the fourth in Texas on May 30, 2017.

    The Xarelto MDL:

    The Xarelto MDL was formed in December 2014 after a motion to consolidate the growing number of lawsuits against the manufacturers of the anticoagulant. Since the MDL was formed, the number of lawsuits filed in it have skyrocketed and it has become one of the fastest-growing mass torts concerning a product liability claim. The MDL was formed to consolidate the lawsuits, conserve judicial resources, and speed up the pretrial litigation and discovery process for both the plaintiffs and the defendants.     The Dangerous Side Effects of Xarelto:

    Xarelto is the subject of controversy and legal action because of the dangerous side effects the drug has been linked to. Since Xarelto was released onto the United States market after receiving FDA approval in 2011, several studies have linked Xarelto to adverse events such as uncontrollable internal bleeding, brain hemorrhages, stroke, and pulmonary embolism, which almost always result in serious injury and even death in some cases. Xarelto is a much more dangerous drug than traditional blood thinners such as Warfarin because Xarelto does not come with a corresponding antidote. If a patient taking Warfarin experiences an internal bleeding event, a doctor will be able to administer vitamin K and the blood will clot again. If a patient taking Xarelto experiences an internal bleed, there is no drug that can be administered to stop the bleeding, resulting in an uncontrollable internal bleeding event. In these cases, serious life-saving medical measures must usually be taken to stop the bleeding. Many of the lawsuits allege that Xarelto’s manufacturers had prior knowledge of these serious risks associated with the drug and put the drug to market anyway.

    Allegations Made in the Xarelto Lawsuits:

  7. Another Xarelto Lawsuit Filed in the Wrongful Death of Tommy Julian

    Tommy Julian began taking Xarelto in November 2012. His personal physician prescribed it to help him reduce his risk of having a stroke. Julian had non-valvular atrial fibrillation, a condition that increased the chances of suffering a stroke.

    According to the Institute for Safe Medication Practices Quarter Watch, Xarelto had been linked with serious blood clot anomalies, most often pulmonary embolism.

    A relatively new drug, only approved by the Food and Drug Administration (FDA) in July 2011, it was touted as having the ability to reduce the risk of blood clots in patients who had hip or knee replacement operations. In November of the same year, the FDA gave it the nod for use with patients with non-valvular atrial fibrillation. It was a once-a-day pill, and supposedly those taking it did not need the same kind of close monitoring as patients on the anticoagulant warfarin.

    The elder Julian started taking Xarelto, and several months later suffered from internal bleeding that could not be arrested. He died March 29, 2013. The boxed product contained no warnings about the risk of serious and fatal bleeding, a fact Julien’s attorney would focus on during the eventual trial.

    “Apparently the drug maker knew early in their clinical trials that Xarelto caused more stomach bleeding than warfarin and that patients on the drug needed more transfusions than those on warfarin,” said Monroe.

    In an emergency, warfarin patients may be given Vitamin K to reverse the effects. There is no antidote in the event of an Xarelto bleed, which causes severe and uncontrollable bleeding.

    The lawsuit is filed against Xarelto’s manufacturers, Bayer AG and Janseen Pharmaceuticals, the pharmaceutical division of Johnson&Johnson. It was filed in the United States District Court for the Southern District of Florida on June 23, 2014 and is listed under the case number 9:14CV80831.

    Details of Xarelto Wrongful Death Lawsuit

    The lawsuit details that the plaintiff’s late husband was prescribed Xarelto by his primary care physician on January 10, 2012 to treat his atrial fibrillation and reduce the risk of deep vein thrombosis and blood clots. After he began to take the drug, the deceased suffered a subdural hemorrhage, or a bleed outside of the brain. He was hospitalized for several days where he underwent several procedures to try to stop the severe subdural bleeding. On June 28, 2012, the plaintiff’s husband died as a result of internal bleeding complications. The plaintiff alleges that Xarelto was the cause of the hemorrhage and that if her and her husband were made aware of the real risks associated with Xarelto usage, they would have chosen to use one of the safer alternatives that were on the market at the time.

    Xarelto’s Dangerous Lack of Antidote

    Xarelto is considered to be a more dangerous drug than other traditional blood thinners on the market, such as Warfarin, because Xarelto does not have a corresponding antidote. This means that there is no way to reverse the anticoagulant effects of the drug in an emergency so if a patient suffers from an internal bleeding event while taking Xarelto, the bleeding cannot be stopped. In contrast, if a patient is taking Warfarin and suffers from an internal bleeding event, a doctor simply has to administer vitamin K and the patient’s blood will clot again. In the case of the deceased, since there is no antidote to Xarelto, the bleeding could only be curbed through very extreme measures such as a bur hole in his skull and a transfusion of new blood to remove the drug from the system. Sadly, despite these extreme efforts, many deaths similar to the plaintiff’s husband have occurred.

    The plaintiff in Florida is bringing forward a wrongful death lawsuit alleging that the manufacturers of Xarelto were aware of the serious risks around the drug and deliberately concealed this information from doctors and patients. A wrongful death lawsuit will give them the chance to recover compensation for medical bills, burial and funeral expenses, along with the loss of future income, support, and companionship.

    Recently, many of the federally filed lawsuits against Xarelto have been consolidated into a multidistrict litigation, MDL, in the Eastern District of Louisiana.   12. New York Couple Adds Another Bleeding Lawsuit to Xarelto MDL

    A New York couple has joined the Xarelto multidistrict litigation now pending in Louisiana federal court.

    Plaintiffs Ann and Richard B. of Auburn, N.Y. filed their Xarelto lawsuit in August. They are joining other plaintiffs in pursuing legal action for the serious and dangerous bleeding complications that allegedly occurred as a result of the anticoagulant drug Xarelto.

    These federal Xarelto lawsuits have been consolidated into a multidistrict litigation, or MDL, in federal court in New Orleans.

    Plaintiffs in this MDL consist of former Xarelto patients, their close relatives, and estate representatives. Generally, these Xarelto lawsuits are seeking compensation for excessive gastrointestinal bleeding or other severe internal bleeding that they say was caused by the anticoagulant.

    Defendants in the Xarelto MDL include several different pharmaceutical companies all of whom share some involvement in the development, manufacture, or marketing of Xarelto. These include Janssen Pharmaceuticals, Janssen’s parent company Johnson & Johnson, Bayer Healthcare Pharmaceuticals Inc., and their related companies.

    What is Xarelto?

    Xarelto, or rivaroxaban, first received FDA approval in July 2011. It’s now approved to reduce the risk of stroke and systemic embolism in patients with nonvalvular atrial fibrillation, a common use for many anticoagulant medications.

    Xarelto is also approved to treat pulmonary embolism and deep vein thrombosis (DVT), to prevent recurrence of those conditions, and to prevent DVT after hip or knee replacement surgery.

    The blood thinner is one of a new class of anticoagulant drugs (along with Pradaxa and Eliquis) introduced to the market within the last few years. These new anticoagulant drugs have been the first in years to successfully compete with warfarin (Coumadin), which had been the go-to anticoagulant medication for decades.

    Plaintiffs Allege Xarelto Bleeding Risks Understated

    The newest joint complaint added to the Xarelto MDL claims that the defendants’ aggressive promotion of Xarelto benefits is misleading to consumers and the medical community. According to the Xarelto lawsuit, the defendants had promoted Xarelto as offering the benefits of a single daily dose, with no need for ongoing monitoring of blood levels or adjustment of dosage as is required with warfarin.

    Ann and Richard are taking issue with this promotion in two ways. First, contending the defendants over-promoted Xarelto, overstating its efficacy while understating the risks associated with Xarelto bleeding. The plaintiffs claim that the clinical trials for Xarelto actually showed that the drug is safer and more effective when administered with twice-daily dosing and with ongoing blood level monitoring.

    Second, Ann and Richard point out that Xarelto, unlike warfarin, has no antidote that can stop excessive bleeding once it starts. They say that the original FDA-approved label for Xarelto mentioned the lack of an antidote in the overdose section but did not actually contain a warning about that fact.

    Furthermore, the plaintiffs state that with this promoted once-daily dosing and no monitoring, Xarelto puts the patient at a greater risk for major, life-threatening bleeding events.

    Ann and Richard say in the Xarelto lawsuit that the new generation blood thinner creates an unacceptable risk of excessive bleeding that defendants failed to warn physicians or patients about these risks.

  13. Side Effects of Xarelto: Vomiting Blood

    Xarelto (Rivaroxaban) is a blood thinner drug prescribed to prevent blood clots and pulmonary embolism in a number of different conditions, like deep vein thrombosis, also known as DVT, along with a heart rhythm condition called non-valvular atrial fibrillation.

    One of the more common side effects of Xarelto is gastrointestinal bleeding. Xarelto side effects can also include a more dramatic and frightening event: coughing up or vomiting blood.

    Side Effects of Xarelto: GI Bleeding and Vomiting Blood

    As a new generation anticoagulant drug, Xarelto is a Xa inhibitor, which inhibits thrombin, a component that’s critical for allowing red blood cells to clump together and form clots. This can result in uncontrolled bleeding, both internally and externally.

    This side effect of Xarelto is especially problematic in the gastrointestinal tract, which extends from your esophagus, to your stomach, through to your small and large intestines, colon and rectum. Anything you swallow can potentially damage the GI tract and any inflammation can cause ulceration and sores, which may bleed uncontrollably due to the blood thinning properties of Xarelto.

    Intestinal bleeding and other internal bleeding is compounded by the fact that there is often little surrounding muscle or tissue to exert pressure on the bleed. In the case of a soft tissue injury, the skin and muscles swell, and this exerts natural pressure on the site of the wound or injury, but this does not occur with internal organs. Pressure is one of the only other ways to stop bleeding when blood won’t clot (either due to a blood thinner drug like Xarelto or due to a medical condition like hemophilia.)

    Vomiting blood can be very frightening, especially since the amount of blood can appear to be significantly larger than it actually. This occurs because the blood may be mixed with other gastric fluids.

    While on Xarelto, vomiting blood can be life-threatening due to the lack of a Xarelto reversal agent or antidote.

    Coughing up or vomiting blood can take a few different forms, including the following.

    Vomiting red “fresh” blood

    This typically indicates very recent or active bleeding in the esophagus or stomach.

    Vomiting coffee grounds-like substance

    This is “old” blood which has started to congeal. The natural congealing process causes the coffee grounds-like consistency (though this may be diminished in someone who’s taking a blood thinner medication like Xarelto, as blood clotting is partially responsible for causing the blood to congeal into a coffee grounds-like consistency. The dark color arises due to exposure to air and other conditions outside of the cardiovascular system. The brown-black color of the blood suggests that the gastrointestinal bleeding occurred at least a few hours prior to the vomiting incident.

    Vomiting a red blood and coffee grounds-like substance

    This typically indicates an esophageal or stomach bleed that has been occurring for several hours. The fresh red blood suggests that the bleeding is still actively occurring, while the coffee grounds-like texture of the older blood indicates that some of the blood has been in the GI tract for a longer period of time.

    Notably, the coughing up or vomiting coffee grounds-like material without the presence of red blood doesn’t necessarily indicate that the bleed has now stopped. Since the blood takes on the appearance of coffee grounds after several hours, many may assume that vomiting only this substance would suggest that the bleed has stopped. But patients may not realize that they may have only vomited a portion of the blood that escaped, so it’s possible that additional “fresh” blood may be present in your system; blood that would indicate an active or very recent bleed.

    While on Xarelto, vomiting blood can indicate a life-threatening situation. If you observe or experience this or any other side effects of Xarelto, it’s essential that you consult your physician and seek medical attention immediately.

    On Thursday, September 17, 2015, officials announced the locations for the first four Bellwether trials in the Xarelto Multi-District Lawsuit (MDL) case, which now includes well over 1200 individual Xarelto lawsuits.

    The Xarelto lawsuit MDL case is currently being overseen by U.S. District Court Judge Eldon Fallon, who presides over the court in the Eastern District of Louisiana. It was announced on September 17 that the first four Bellwether trials would occur in the following three locations:

    The U.S. District Court for the Eastern District of Louisiana for the first two cases, scheduled for August 1, 2016 and August 22, 2016;

    The U.S. District Court for the South District of Texas for the third case, scheduled for September 12, 2016; and

    The U.S. District Court for the Southern District of Mississippi for the fourth case, scheduled for October 17, 2016.

    Judge Fallon recommended that a total of 50 cases should be selected to serve as Bellwether trials for this ever-growing MDL case.

    What are the Bellwether Trials and the Xarelto MDL?

    Bellwether trials are trials involving specially selected cases, which are chosen because they are found to be substantially similar to multiple other cases in a MDL case, which is a consolidation of multiple cases with very similar facts. The cases in an MDL are all tried and/or settled separately, but they share some elements of the pre-trial process, such as evidence discovery.

    The results of the Bellwether trials will provide both the plaintiffs and the defendants with valuable insight into the viability of the remaining cases in the MDL. Based on the results of these Bellwether trials, the plaintiffs and defendants can make an educated decision as to whether they wish to pursue a trial or arrive at a settlement, thereby negating the need for a trial.

    As of mid-July 2015, there were over 1230 cases in Xarelto Lawsuit MDL case 2592 versus defendants Johnson & Johnson subsidiary Janssen Pharmaceuticals and Bayer Healthcare — the manufacturers of the dangerous blood thinner Xarelto (Rivaroxaban). More than 800 Xarelto lawsuits were added to the MDL in just one month.

    The plaintiffs in the Xarelto lawsuits have four collective claims:

    They claim that they were never properly informed that Xarelto lacks an antidote or reversal agent to stop bleeding.

    They claim it was negligent to release a blood thinner drug that did not have an antidote or reversal agent.

    They claim the anticoagulant drug’s marketing understated the risks and side effects. Some also criticize the drug’s lack of a serious warning label.

    They claim that Xarelto’s marketing overstated the benefits of using this blood thinner drug in place of the traditional option, Coumadin/Warfarin.

    Xarelto is prescribed to many patients, including those suffering from deep-vein thrombosis, pulmonary embolism, and non-valvular atrial fibrillation.     Xarelto side effects are many and varied, ranging from bruising and heavy menstrual cycles, to intestinal bleeding, kidney bleeding, stroke and brain hemorrhage, ultimately leading to death. Studies have revealed that three-quarters of the uncontrollable bleeding cases involved patients age 75 and older. Another study found that the average age of those who died from Xarelto was 82 years old.

  15. Woman Files Xarelto Bleeding Wrongful Death Lawsuit

    A Pennsylvania woman filed a Xarelto bleeding wrongful death lawsuit on behalf of her  father, who allegedly bled to death after using the blood thinner.

    Plaintiff Roxanne J. alleges that her father, Patrick M., was prescribed the blood thinner and used it as prescribed until his death, allegedly as a result of irreversible Xarelto bleeding.

    The Xarelto injury lawsuit claims that Bayer heavily marketed Xarelto by exaggerating the benefits and downplaying the risks and side effects of the drug in its advertisements, failing to warn of the lack of a reversal agent should a patient suffer internal bleeding.

    Roxanne is pursuing a wrongful death claim against the manufacturers of Xarelto, further asserting that the drug makers aggressively promoted Xarelto’s advantages compared to predecessor Coumadin (warfarin). One selling point is that Xarelto does not require regular blood monitoring or have dietary restrictions as Coumadin does.

    In December 2014, the Judicial Panel on Multidistrict Litigation (JPML) consolidated all federally-filed Xarelto lawsuits against Janssen Pharmaceuticals and Bayer in a multidistrict litigation in the Eastern District of Louisiana under U.S. District Judge Eldon Fallon.

    In the Xarelto injury lawsuits that have been filed, some of the allegations include that the manufacturers ignored patient safety and failed to warn about the significant risks with the new generation anticoagulant, including that in the event of a serious bleeding incident there is no available reversal agent that can be used to stop the bleeding.

    What is Xarelto?

    Xarelto is a blood thinner initially approved by the U.S. Food and Drug Administration (FDA) in July 2011 to prevent strokes in patients who recently underwent hip and knee replacements.

    It was also later approved for use in patients with non-valvular atrial fibrillation, or an irregular heartbeat, and to treat or reduce the recurrence of deep vein thrombosis and pulmonary embolism. Since Xarelto was first approved, there have been several reports of bleeding events for those taking Xarelto, including gastrointestinal bleeding, hemmorhagic strokes, and brain hemorrhages.

    Xarelto injury lawsuits in the Louisiana MDL allege that use of the drug caused serious internal bleeding.

    The Xarelto lawsuits name as defendants Bayer Healthcare, Johnson & Johnson and its subsidiary, Janssen Pharmaceuticals. The Xarelto injury complaints accuse Bayer and Janssen of failing to warn consumers that Xarelto does not have an antidote, leaving doctors without any effective means to treat and stabilize patients who experienced uncontrolled and excessive bleeding.

    BloodThinnerHelp.com reports today on the formation of the Philadelphia Mass Tort Group. The Philadelphia Court of Common Pleas ordered the establishment of a Xarelto mass tort litigation group on January 22, 2015. This order is a result of 75 individual complaints that were filed in the system against the manufacturers of Xarelto. All of these complaints commonly alleged that the blood thinner causes serious injuries and death due to uncontrollable internal bleeding events.

    Xarelto Lawsuits Consolidated in Philadelphia

    The 75 Xarelto lawsuits were ordered by an administrative judge to be transferred to the Complex Litigation Center for pretrial administration and discovery. These cases are currently still in this phase of litigation. Continue to check back here for more updates on when the litigation moves forward. The lawyers for the manufacturers of Xarelto, Janssen Pharmaceuticals, a subdivision of Johnson&Johnson, and Bayer AG, argued that these cases should not be consolidated in the city of Philadelphia because the manufacturers are headquartered in New York and New Jersey. The lawyers also argued that the cases should be consolidated federally with the rest of the Xarelto lawsuits that have been consolidated into the MDL in Louisiana. The presiding judge rejected both of the defense’s arguments and agreed with the plaintiffs who argued that both of the defendants had considerable ties to the Philadelphia region and it was an appropriate venue for the litigation. Because of the Mass Tort Group, the courts will be able to process all the lawsuits in a much more efficient manner by handling discovery, procedural motions, and other legal matters in bulk. “Handling many of these matters at once will bring faster justice and hopefully settlements for the plaintiffs and their families who have been harmed by this drug.

    The Dangers of Xarelto

    Xarelto is a prescription blood thinner that was released onto the U.S. market after it was approved by the FDA in 2011. Xarelto works differently than traditional blood thinners because it blocks the chemical in the blood that is responsible for making blood clot, thrombin. By blocking thrombin, Xarelto completely takes away the blood’s ability to clot in any capacity. Xarelto is more dangerous than other blood thinners because there is no antidote to its anticoagulant effects, meaning that if a patient suffers from a serious internal bleeding event, there is no way to stop the bleeding, leading to serious injuries and death in patients. Many of the lawsuits also allege that the manufacturers had knowledge of these dangers before they released Xarelto onto the market but released the drug anyway.   18. Xarelto Manufacturers present 2 Studies Claiming Drug Safety at Recent Conference

    Even as Xarelto lawsuits based on claims that the blood thinner caused patients to suffer serious or even fatal internal bleeding continue to mount, the makers of this drug presented two studies touting the medication’s safety at a recent medical conference in Europe.

    Janssen Pharmaceuticals, a Johnson & Johnson subsidiary, and Bayer Healthcare presented two studies claiming to show the safety of Xarelto at a recent conference held by the European Society of Cardiology in late August. The companies also issued a press release on September 1 to share the findings of the studies.

    The first study presented at the conference was a post-marketing safety surveillance (PMSS) study in which researchers found a rate of 2.89 major bleeding events in Xarelto in 100 person-years. This was compared to the rate of 3.6 events per 100 person-years noted in the ROCKET AF clinical trials conducted before the FDA approved Xarelto. Study author W. Frank Peacock, M.D., stated that this trial showed “real-world” results in patients and that “these findings show the use of rivaroxaban in day-to-day care is consistent with the safety profile observed in ROCKET AF.”

    The second study was called XANTUS and investigated rates of stroke prevention in Xarelto patients in recent years. Here, researchers noted a 2.1 rate of major bleeding events per 100 person-years.

    Both studies were part of the EXPLORER program designed to evaluate the safety and benefits of Xarelto in collaboration with Janssen and Bayer Healthcare.

    Despite these recent studies, many patients have claimed in Xarelto lawsuits that the makers of this drug falsely marketed it on claims that it is safer than the previous standby anticoagulant warfarin (Coumadin). Much Xarelto advertising was centered on claims that Xarelto patients do not require routine blood monitoring as warfarin patients do and also suggested that Xarelto is a safer alternative to warfarin. In truth, both drugs are anticoagulants which may increase the risk of internal bleeding. However, patients who hemorrhage while taking warfarin may be helped by Vitamin K and there is no such antidote for Xarelto internal bleeding. Additionally, a number of experts are now suggesting that Xarelto patients may benefit from routine blood monitoring to ensure proper dosing.

    The makers of Xarelto are not the only pharmaceutical companies facing dangerous drug lawsuits regarding their blood thinners—Pradaxa and Eliquis have also been the subjects of this type of litigation.

  19. 1,700 Xarelto Bleeding Lawsuits Filed in MDL

    The Judicial Panel on Multidistrict Litigation (JPML) released statistics (PDF) on September 15, reporting that 1,694 cases were pending in the Eastern District of Louisiana (MDL No. 2592) under Judge Eldon E. Fallon.

    Judge Fallon has set “bellwether” trial dates starting as early as August 2016. Two trials will occur in Louisiana, followed by Texas and Mississippi. The outcome of each trial is not binding on other cases in the litigation, but will help resolve cases involving similar injuries.

    All of the lawsuits accuse Janssen Pharmaceuticals and Bayer of downplaying the risk of uncontrollable bleeding and cherry-picking good data from studies to market Xarelto.

    The problem is that when Xarelto was introduced in 2011, it had no reversal agent. In an emergency, doctors might struggle to reverse its blood-thinning effects. Dozens of deaths and thousands of adverse events have been reported in the last three years.

    Xarelto was designed to replace warfarin (Coumadin), a blood-thinner that has been on the market since the 1950s. The big difference is that warfarin can be reversed with a dose of Vitamin K, but not even dialysis can remove Xarelto from a patient’s bloodstream.

  20. Woman Sues Xarelto Makers over Internal Bleeding

    New Orleans, LA – A woman is suing the manufacturers of Xarelto over claims that she suffered severe bleeding after using the drug.

    Louisiana resident Glenda Froelich filed her complaint against pharmaceutical majors Bayer and Janssen, along with several of their United States affiliates and subsidiaries, in May. The suit, which was filed in the U.S. Dist. Court for the Eastern Dist. of LA, accuses the defendant companies of fraud and negligence.

    The lawsuit claims that Froelich started using Xarelto after her doctor prescribed it in 2013 December. Froelich used the drug as part of her treatment for atrial fibrillation, a heart condition that causes an uneven and often abnormally rapid heart rate. After taking the drug for a few months, the plaintiff allegedly experienced heavy internal bleeding, the complaint states. Froelich also suffered permanent injuries due to her Xarelto use, according to the suit.

    Froelich argues that the defendant pharmaceutical firms failed to adequately warn doctors, patients, and the general public regarding the dangerous side effects of Xarelto, including the fact that there is no antidote for reversing the bleeding caused by the medication.

    The plaintiff is seeking unspecified monetary damages for her alleged: physical pain; emotional anguish and suffering; legal costs; medical expenses; mental distress; and attorney fees. Froelich is also asking for unspecified punitive damages.

    Xarelto (Rivaroxaban) is a drug used to prevent the formation of blood clots because of atrial fibrillation (irregular heartbeat). It is also used after surgical procedures for knee and hip replacement. In addition, Xarelto is used to treat blood clots linked to DVT (deep vein thrombosis) and PE (pulmonary embolism). It may also be used prevent recurrence of blood clots.

    Xarelto is an anticoagulant medication which works by blocking some clotting proteins in the blood. Some of the side effects are easy bruising and minor bleeding (like nosebleed, excessive bleeding from cuts, wounds, needle injections etc.). If these side effects continue, or worsen, the patient needs to consult their physician or pharmacist immediately.

    Some other adverse effects of Xarelto are: unusually heavy menstrual periods; dizziness, headache, and weakness; pink or red urine; feeling like pass out; bloody or black stools; vomit which looks like coffee grounds; coughing up blood; loss of ability to move any body parts; muscle pain; pain in the legs or arms; and itching. Some studies say the drug could increase the risk of experiencing stroke after non-valvular atrial fibrillation patients stop using it.

  21. Ind. Woman Claims Severe Xarelto Vaginal Bleeding

    Janssen Pharmaceuticals (a Johnson & Johnson subsidiary) and Bayer Healthcare were hit with a Xarelto lawsuit, adding to over 1,000 Xarelto bleeding lawsuits filed in federal and state courts.

    Plaintiff Paula K., a resident of Indiana, claims in her Xarelto bleeding lawsuitthat the popular anticoagulant Xarelto caused her to suffer severe physical, mental and emotional damages.

    Paula began taking Xarelto in January 2013 to treat her atrial fibrillation condition. Shortly after starting her prescription, however, Paula suffered from menorrhagia, a condition characterized by severe vaginal bleeding.

    She was hospitalized for one night in Feb. 2013, and in June of that year was admitted to a local hospital again with severe vaginal bleeding. Paula had to undergo endometrial ablation, a cauterization procedure to stop the uncontrollable bleeding.Xarelto Allegations

    Paula has filed a Xarelto lawsuit alleging that her medical conditions and resulting physical injuries were caused by Xarelto bleeding complications. Paula is suing the makers of Xarelto for damages, alleging that their acts and omissions led to her painful and life-threatening Xarelto side effects.

    Paula’s Xarelto lawsuit claims that had the drug manufacturers done their job and properly informed her of the possibility of serious Xarelto bleeding side effects, she would not have chosen to take the blood thinning drug.

    Paula brings several allegations against Janssen and Bayer, including claims of design defect, negligence, failure to warn, unreasonable marketing of a dangerous drug, unreasonable failure to remove the drug from the market, breach of express warranty, breach of implied warranty, fraudulent concealment, and violation of consumer protection laws.

    The Xarelto lawsuit seeks relief in the form of past and future medical expenses, past and future loss of earnings, past and future general damages, compensatory damages, punitive damages, payment of court costs and attorney’s fees, pre and post judgement interest, and any other forms of relief deemed fit by the court.

    Lawsuits alleging bleeding risks with the blood thinner Xarelto continue to mount, once again making it the fastest growing mass tort involving product liability claims, according to a monthly analysis of statistics from the U.S. Judicial Panel on MultidistrictLitigation. The latest analysis covers filings from Aug. 17 through Sept. 15.

    The lawsuits allege that the Xarelto makers, Bayer and Johnson & Johnson’s Janssen Pharmaceuticals, failed to thoroughly test the drug’s safety and efficacy before marketing the medication, and did not adequately warn of Xarelto side effects, which includes major bleeding events including gastrointestinal bleeds, brain hemorrhages, and bleeding deaths.

    Xarelto is one of the first drugs in a new class of blood thinners designed to compete with the long-used warfarin. The anticoagulant is used to prevent strokes in patients with a heart condition known as atrial fibrillation, and to prevent and treat blood clots in patients including those who have recently undergone hip or knee replacement surgery.

    Xarelto promised to be more convenient than warfarin, which requires patients to be monitored on a regular basis. Sales of the drug skyrocketed.

    While Xarelto proved to be more convenient than warfarin, it wasn’t showing that it was safer. Reports of bleeding risks began piling up in the Food and Drug Administration’s adverse event data base. Even more concerning was that, unlike warfarin, there is no commercially available antidote to reverse the blood thinning effects of Xarelto, resulting in uncontrolled bleeds.

    More lawsuits are expected to join the Xarelto side effects multidistrict litigation (MDL) in the months to come as the public becomes aware of the serious bleeding risks associated with the drug.

    SEPTEMBER 2015 - Although the U.S. FDA approved Xarelto in 2011, many patients have experienced liver injuries and uncontrolled bleeding, resulting in severe damage and even death in some cases.
