    The MDL is presided over by Judge Eldon Fallon and the Eastern District of Louisiana is located in the city of New Orleans.  A motion was made to form the MDL because there was a rising number of lawsuits that all made similar allegations against the same defendants, the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals, a subdivision of Johnson&Johnson.   By consolidating these cases into an MDL, the entire litigation process is streamlined and will move faster for everyone involved.  Forming an MDL also saves on judicial resources and speeds up the settlement process if there is one.

    In addition to the MDL, there is also a Mass Tort Group in Philadelphia where about 400 Xarelto lawsuits are currently consolidated.  The number of lawsuits consolidate in the Mass Tort Group and the MDL continue to rise.

    Lawsuits Allege Xarelto Linked to Serious Side Effects:

    Xarelto was released onto the United States market after being approved by the Food and Drug Administration, FDA, in 2011.  Xarelto was initially approved to treat patients who suffered from atrial fibrillation, deep vein thrombosis, and for patients who had recently undergone a hip or knee replacement surgery.  Since its release, several studies have linked Xarelto to cause severe internal bleeding which can lead to serious injuries and even death.  This internal bleeding is serious because Xarelto does not have an antidote to counteract its anticoagulant effects.  If a patient is taking the traditional blood thinner Warfarin and experiences an internal bleed, doctors can administer Vitamin K and the patient’s blood will clot.  If a patient is taking Xarelto and experiences an internal bleed, there is no available medication to stop the bleeding.  Many patients taking Xarelto have been seriously injured in this way and have even died.

    Many of the Xarelto lawsuits filed allege that Xarelto’s manufacturers were aware of the serious risks associated with the drug yet put the blood thinner to market anyway.  The lawsuits also allege that the manufacturers deliberately concealed this information from doctors and patients, claiming in advertisements that Xarelto was a safe drug.

  2. Xarelto Lawsuit News: Bellwether Trials, Wrongful Death Allegations

    Last week, on September 17, a monthly status conference was held. Topics addressed at the Status Conference included the determination of bellwether cases, according to court documents. Bellwether trials, which are used as representative case studies, help determine how the entire litigation will be resolved. Bellwether trials are scheduled to take place in less than a year, in August of 2016, according to court documents. At the suggestion of the court, two bellwether trials will take place in the Eastern District of Louisiana, one in the Southern District of Texas, and another in the Southern District of Mississippi, according to court documents.

Xarelto has proved to be effective at preventing the blood from clotting, but as such poses a risk for serious bleeding. All anti-coagulant drugs pose this risk, but Xarelto lawsuits assert that because there is no known antidote to Xarelto bleeding events, the drug is less safe than other blood thinners, having causes serious internal bleeding and bleeding deaths, according to court documents.     Xarelto Internal Bleeding Lawsuits Filed Across Country:

    The lawsuits that are filed in the Xarelto multidistrict litigation, MDL, all make similar allegations against the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals, including that the drug can cause severe uncontrollable internal bleeding and that the manufacturers were aware of the dangers of Xarelto and failed to adequately warn doctors and patients about them. Because the cases against Xarelto are filed as individual personal injury lawsuits, it is very difficult to say how much these cases will settle for since the circumstances of each case are very different.

    Initial Xarelto Trials Announced:

    Although there have been no settlements on the Xarelto litigation yet, the dates for the bellwether trials have been set. The Xarelto trials will begin on February 6, 2017 in the Eastern District of Louisiana. A second trial will take place in the same district on March 13, 2017, a third trial will occur in Mississippi on April 24, 2017, and a fourth will be held in Texas on May 30, 2017.

    The lawsuits filed all contain different types of damages, some economic and some non-economic. Economic damages consist of medical expenses, long term and future medical care, loss of earnings, loss of future income, and funeral and burial expenses. Non-economic damages consist of compensation for pain and suffering and for loss of companionship. Each case will have varying amounts of these damages listed, which is what makes estimating a settlement very difficult.

    To make a rough estimate, we can look to a case in recent history that is similar to Xarelto. In May 2014 Pradaxa, a blood thinner that is similar to Xarelto, settled cases that were similar in nature to the Xarelto litigation that is currently unfolding. Pradaxa’s manufacturers, Boehringer Ingelheim, settled 4,000 lawsuits against their blood thinner for $650 million dollars.

    A Florida widow has filed a dangerous drug lawsuit against the maker of Xarelto, claiming the blood thinning drug caused the wrongful death of her husband.

    Plaintiff Betty H., the widow of Ronald H., filed the Xarelto lawsuit against Janssen Pharmaceuticals, its parent company Johnson & Johnson and affiliated companies over the alleged injury caused by her late husband Ronald’s Xarelto usage.

    Ronald began taking Xarelto in November 2012 through January 2013. In January 2013, Ronald suffered from severe gastrointestinal bleeding attributed to Xarelto use.

    He was hospitalized and had a number of surgeries and procedures for two months. Ronald’s bleeding incident turned fatal and he entered hospice care and died in May 2013.

    Betty is suing both for personal injury to her husband as well as related loss of consortium.     What is Xarelto?

    Xarelto is an anticoagulant used to prevent blood clots in patients who are at risk. The drug was FDA approved in July 2011 for prevention of deep vein thrombosis (DVT) and pulmonary embolism (PE) for patients who were undergoing hip or knee replacement surgeries.

    In November of the same year, it was also approved to reduce stroke risk and systemic embolism in patients with non-valvular atrial fibrillation.

    Xarelto is considered a new generation anticoagulant medication. For many years, the only blood thinning anticoagulant in wide use was warfarin. Warfarin performed well in patients, but did require a lot of monitoring by the physician and patients had to maintain certain dietary restrictions while taking the drug.

    Xarelto and other recently developed anticoagulants seemed to be a great addition to allow physicians to administer a medication that did not have the special considerations that warfarin had, thus simplifying patient care.

    Complications of Xarelto Use

    The most common and most severe complication of Xarelto use is severe internal bleeding. Because Xarelto causes the blood to thin, the natural clotting mechanism to stop bleeds is disrupted and is essentially overridden. Internal bleeds can occur in number of locations in the body, such as in the lungs, gastrointestinal organs, inside the brain or elsewhere.

    Warfarin also had bleeding as a known complication of use. However, warfarin had a reversal agent to stop bleeding from progressing once it began. Fresh frozen plasma and vitamin K were used as an antidote to curtail the bleeding.

    Xarelto has no antidote, so it is not possible to effectively stop a bleed once it starts. Prolonged Xarelto bleeding can cause severe organ damage, and as in Betty’s husband’s case, it can also be fatal.

    The controversial blood thinner Xarelto has been granted clearance by Japanese drug regulators for expansion of the drug’s usage to include the treatment and secondary prevention ofpulmonary thromboembolism (PE) and deep vein thrombosis (DVT).

    DVT is a condition in which blood clots form in one of the large, deep veins, generally in the legs. PE is a condition that occurs when a blood clot travels to the lungs and partially or completely block a branch of a pulmonary artery. PE can be fatal if the blood clot is large, there are multiple clots, or if the patient has heart or lung disease. PE and DVT, collectively, are known as venous thromboembolism, and are the third most common cardiovascular disorder.

    Xarelto, manufactured by Bayer and Johnson & Johnson’s unit Janssen Pharmaceuticals, is also approved in Japan for the prevention of strokes in patients with a heart condition known as atrial fibrillation, and for the prevention of blood clots in patients who have recently undergone hip or knee replacement surgery.

    Xarelto was approved by the U.S. Food and Drug Administration (FDA) in 2012, and is used as a treatment for the same conditions. It is designed to be a more convenient alternative to the long-used warfarin, which requires patients to be monitored on a regular basis.

    Both drug carry warnings for major bleeding events, including gastrointestinal bleeds, brain hemorrhages and bleeding deaths. In many cases, patients taking warfarin who experience an uncontrolled bleed can be given vitamin K that can reverse the blood thinning qualities of the drug. There is no reversal agent currently available for Xarelto.

    Bayer and Janssen currently face hundreds of lawsuits alleging the companies did not thoroughly vet the drug before seeking FDA approval, and failed to adequately warn patients or their doctors of the bleeding side effects associated with Xarelto.

    A series of Xarelto bellwether trials may begin as soon as February 2017, according to a Case Management Order issued on September 17 by the U.S. District Court, Easter District of Louisiana.

    The cases are part of a federal multidistrict litigation (MDL) established in December 2014 to consolidate product liability complaints filed in federal court involving bleeding problems with the anticoagulant drug Xarelto. Early bellwether trials are commonly conducted to further the efficient progress of litigation.

    Over 1,200 Xarelto lawsuits are pending in a multidistrict litigation in the U.S. District Court for the Eastern District of Louisiana.     New Orleans, LA: A Xarelto Lawsuit filed this past March raises a lot of the same questions other plaintiffs have been raising with regard to Xarelto Bleeding complications that can’t be stopped as easily as similar bleedouts associated with use of the much older Coumadin (warfarin).

Julien states in his Xarelto lawsuit that such deficiencies and failures were undertaken “willfully, intentionally, and with reckless disregard of the life and safety of the Decedent and the general public.”

    He seeks in excess of $75,000 in compensatory and punitive damages.

    The lawsuit alleging Xarelto Death, Xarelto Bleeding complications and Xarelto Side Effects is one of over a thousand similar cases consolidated in multidistrict litigation before US District Judge Eldon E.     According to Law360.com, two of the plaintiffs represent the estates of people who allegedly died due to Xarelto bleeding. All claim that the defendants’ misleading marketing campaigned induced their physicians to prescribe Xarelto instead of safer alternatives.

The process of selecting cases for those trials will begin next year.

    Xarelto is a new blood thinning medication that was intended to replace warfarin, an anticoagulant that has been on the market for decades. However, there currently exists no approved antidote to reverse Xarelto bleeding side effects. Warfarin can also cause internal bleeding, but such complications can be stopped via the administration of vitamin K.

    In the U.S., Xarelto is approved for the prevention of strokes in people with atrial fibrillation; the treatment of deep vein thrombosis and pulmonary embolism; and the prevention of deep vein thrombosis in patients undergoing hip or knee replacement surgery.   18. Xarelto Bleeding Lawsuit Alleges Ohio Man Bled to Death

    The controversial blood thinning drug Xarelto has been named in yet another lawsuit – this time following the death of an Ohio resident who was prescribed the medication in July 2013.

    Plaintiff Judy C., filing on behalf of her deceased spouse, commenced her Xarelto wrongful death lawsuit on Sept. 15 in Louisiana federal court, home of the ongoing Xarelto MDL to address the alleged widespread injuries caused by the new generation anticoagulant.

    According to the Xarelto lawsuit, the decedent Jerry C. used Xarelto beginning in July 2013 through September 2013, and subsequently suffered fatal internal bleeding. Jerry ultimately died on Oct. 20, 2013, due to his injuries that were allegedly a direct result of using Xarelto

    The Xarelto lawsuit further accuses the defendants of purposely concealing important safety information from the medical community, the U.S. Food and Drug Administration, and the public; the case also claims the pharmaceutical companies did not test the drug enough before it was put on the market.

    Xarelto Side Effects

    At the heart of the Judy’s Xarelto lawsuit are the allegations that the makers of Xarelto engaged in deceitful marketing practices and failed to disclose known Xarelto bleeding risks and side effects.

    The drug Xarelto was approved by the Food and Drug Administration (FDA) in 2011 for the treatment of deep-vein thrombosis and similar clotting risks following knee or hip surgery. Its arrival to the market was initially well-received, as the drug was considered a more-convenient alternative to the long-standing anticoagulant known as warfarin.

    Unlike warfarin, however, Xarelto’s aggressive marketing campaigns promised patients they could maintain an active lifestyle without diet restrictions or regular trips to the blood clinic.

    What these advertisements failed to mention, according to the Xarelto lawsuit, was that the blood thinner could cause a sharp increase in bleeding risks. This new generation blood thinner has been named in several studies as a dangerous anticoagulant alternative that should be used only under close supervision.

    Xarelto Lawsuits

    Xarelto has been targeted with increasing scrutiny over the past several years, and its manufacturers are alleged to have unlawfully concealed the truth about its tendency to cause life-threatening hemorrhages and internal bleeding. Consequently, a Xarelto multidistrict litigation was formed to help consolidate the growing number of cases against the makers of Xarelto.

    The Xarelto lawsuit is seeking compensatory, economic, and punitive damages for Bayer and Janssen Pharmaceutical’s alleged deceptive and reckless practices in misrepresenting and omitting numerous facts about the dangers of taking Xarelto and causing the death of Jerry in part by their gross negligence.  The filed complaint indicates a demand for a jury trial for this case.

  19. Son Blames Xarelto for Father’s Death, Seeks Punitive Damages

    In December 2014, the U.S. Judicial Panel on Multidistrict Litigation (JPML) consolidated all federal Xarelto lawsuits into one court in the Eastern District of Louisiana before the Honorable Judge Fallon. Currently, about 400 cases are pending there.

    One of the cases recently filed involves a plaintiff who claims the anticoagulant blood caused internal bleeding that led to the death of his father.Plaintiff Claims Xarelto Caused Wrongful Death

    The plaintiff, a Georgia resident, is the son of the man who allegedly died because of his ingestion of Xarelto. He’s also the representative of the decedent’s estate. He has filed the Xarelto lawsuit against manufacturers Janssen Pharmaceuticals and parent company Johnson & Johnson, as well as against co-manufacturer Bayer AG.

    According to the complaint, the decedent was first prescribed Xarelto in November 2012 for his atrial fibrillation. The FDA approved the drug in 2011 for the treatment of non-atrial fibrillation, to help patients reduce their risk of blood clots and stroke.

    The decedent continued to take Xarelto for several months. On March 27, 2013, he suffered serious internal bleeding that led to his death. The plaintiff claims that had his father known about the risks associated with Xarelto, he never would have taken it.

    Manufacturers Misinformed Patients About Xarelto

    The plaintiff also notes in his case that the defendants told patients in advertisements that they wouldn’t need regular blood monitoring when taking Xarelto, like patients normally do when taking warfarin, the leading anti-coagulant for decades. They also noted that there were no known dietary restrictions with Xarelto, like there are with warfarin.

    Such advertisements made Xarelto look like a “one size fits all” drug, the plaintiff states, while failing to provide adequate warnings about the risks. The boxed warming on the drug, for example, did not address the increased risk for serious and fatal bleeding, despite early clinical trials showing that in comparison to warfarin, patients taking Xarelto experienced more gastrointestinal bleeds and needed more transfusions.

    Doctors Question Lack of Xarelto Bleeding Antidote

    The plaintiff also points to a January/February 2013 ad in the WebMD magazine in which the defendants advertised Xarelto—an ad that resulted in a warning letter from the FDA. The administration stated that the ad was misleading because “it minimizes the risks associated with Xarelto and makes a misleading claim.”

    He also references a 2012 Huffington Post article in which prominent cardiologists and other health care professionals questioned the use of Xarelto, noting that the drug had no antidote for a bleeding emergency, as warfarin does. Indeed, patients taking warfarin who experience excessive bleeding can be treated with vitamin K injections to encourage blood to clot again. There is no such treatment for patients taking Xarelto who end up in the same situation, making bleeding events much more serious and potentially deadly.

    Defendants Failed to Provide Adequate Warnings

    As in other Xarelto lawsuits, this one highlights the fact that the manufacturers didn’t do enough to warn doctors and patient of the potential risks, particularly of the fact that there was no readily available antidote for Xarelto bleeding. “Defendants merely indicated that there was a risk for bleeding and side-stepped the important issue of reversing the effects of Xarelto should a bleed occur,” the plaintiff states in his complaint.

    He brings claims for failure to warn, defective design, negligence, negligent design, negligent misrepresentation, breach of warranties, and fraud. He seeks both compensatory and punitive damages.
