    The complaint outlines that the plaintiff’s husband was prescribed Xarelto on January 10, 2012 by his primary care physician to treat his atrial fibrillation, a common heart condition, and reduce his risk of blood clots and deep vein thrombosis. The plaintiff’s husband later suffered from a subdural hemorrhage, a bleed just outside of the brain. He was hospitalized for several days where he underwent several extreme lifesaving procedures in efforts to stop the severe subdural bleed. On June 28, 2012, the plaintiff’s husband unfortunately passed away as a result of complications stemming from the internal bleed.

    The complaint alleges that his subdural hemorrhage was caused by his Xarelto usage and that he would not have taken Xarelto had him and the plaintiff known the real risks associated with the drug, instead they would have chosen one of the safer medications available at the time.     The Real Dangers of Xarelto:

    The lawsuits filed in the Xarelto MDL allege that Xarelto is a much more dangerous drug than other blood thinners on the market because of the nature in which the drug operates and because of its lack of antidote. Xarelto is a Xa inhibitor, meaning that it blocks the chemical in the blood which is responsible for making the blood clot, thrombin. By blocking thrombin, Xarelto completely takes away the bloods ability to clot. The problem is that Xarelto’s manufacturers, drug conglomerates Bayer AG and Janssen Pharmaceuticals, a subdivision of Johnson&Johnson, have not provided an antidote for the drug. Without an antidote, if a patient taking Xarelto suffers from an internal bleed, there is no way to stop the bleeding short of serious life-saving medical interventions, which may not even be successful. The lawsuits allege that the lack of antidote has led to many Xarelto users suffering from serious injuries and even death as a result of uncontrollable internal bleeds. Further, the lawsuits also allege that Xarelto’s manufacturers had knowledge of the real dangers of Xarelto and failed to inform doctors and patients about these dangers.

    The plaintiff in this particular case has filed a wrongful death lawsuit. A wrongful death lawsuit enables the estate and loved ones of the deceased to gain compensation to help cover medical bills, funeral and burial expenses, and compensation for loss of future income, support, and companionship.

    To this date, a majority of the lawsuit filed, not just in the federal MDL but also in the mass tort group based out of Philadelphia, make similar allegations, mainly that Xarelto was prescribed to prevent blood clots but due to the nature in which Xarelto operates, the drug can cause uncontrollable internal bleeding which can lead to serious injury and/or death.

    Xarelto’s Dangerous Difference:

    Xarelto is different from blood thinners because it is a part of a new class of anticoagulants known as Xa inhibitors. Xa inhibitors work by blocking the chemical in the blood that is responsible for making blood clot, thrombin. By blocking thrombin, Xarelto completely takes away the blood’s ability to clot. This is problematic because there is no antidote to reverse the effects of Xarelto, meaning that if a patient is taking Xarelto and suffers an internal bleeding injury, there is no way to stop the bleeding.

    Xarelto Lawsuit Allegations:

    The following allegations are the basis for the Xarelto lawsuits:

    - Xarelto’s manufactures failed to warn doctors and patients about the real risks of the drug, specifically the irreversible uncontrollable internal bleeding that may occur.

    - Xarelto has a dangerous defect in its design because there is no safe anticoagulant solution. This poses greater risks of internal bleeding to patients because there is no reversal agent.

    - Xarelto’s manufacturers fraudulently concealed knowledge of irreversible life threatening events and how doctors should intervene and stabilize patients.

    - Xarelto’s manufacturers were negligent in placing the drug onto the market with the knowledge that there was no antidote.

    -Xarelto’s manufacturers were negligent in the marketing of Xarelto with their misrepresentation of Xarelto as a safe blood thinner.

    - Xarelto does not provide greater benefits than other products already on the market in a safer manner such as Warfarin.

    Currently, the lawsuits filed in the Xarelto are still in the pretrial stages of litigation, but the dates for the initial trials have been set. The first trial will take place in the United States District Court for the Eastern District of Louisiana in early 2017 with three more trials throughout the first half of 2017 following it.

    Xarelto is a “one-size-fits-all” blood thinner. Although this increases its overall appeal, it can also cause problems. Taking any form of “one-size-fits-all” drug can be dangerous. Many plaintiffs now allege that due to this characteristic, Xarelto has caused them serious health issues involving severe bleeding and other connected side effects. Additional alleged side effects include gastrointestinal and varied internal bleeding, brain hemorrhages, strokes, and even death.

    Initial lawsuits regarding Xarelto were filed against manufacturers Johnson & Johnson and Bayer in the first half of 2014. It is anticipated that these trials will begin during the second half of 2016. At this point, no settlement reports have been confirmed, although many believe this is what will likely occur.

    In settlement negotiations for Xarelto, it is likely that several factors will determine the amount of damages plaintiffs are able to receive. These factors typically include: the extent of the injury and amount of time it takes to heal, the money involved in getting required medical attention, the impact that the injury may have had on the victim, including physical and mental health and pain and suffering experienced, the amount of wages lost due to time off of work, or, in the case of death, the losses suffered by family members surrounding the victim.

    Lawsuits currently number about 2,000, but it is anticipated that over the next few years, several thousand more cases will be filed. This litigation is in its beginning stages and is likely to take some time, even before settlement negotiations are able to begin. Complaints involved also similarly allege that the manufacturers of Xarelto failed to properly research and warn the bleeding risks associated with the drug.

    Those who have suffered serious health problems after using Xarelto may be entitled to join the litigation and receive compensation.

The lawsuit, filed by the daughter of the deceased, alleges that prescription Xarelto caused the victim’s internal bleeding and eventual death. The man was said to be taking Xarelto in order to prevent blood clots and strokes due to his atrial fibrillation condition.

    The victim first began using Xarelto after being prescribed the drug by his doctor in July of 2012. After six long days in the hospital, the man passed away on August 1st of 2012. At the time of his death, his system still contained active Xarelto, which likely prevented his blood from clotting while he hemorrhaged.

    The daughter of the deceased also lives in Vermont, and has now filed a lawsuit on behalf of her father. She seeks compensation for medical expenses, attorneys fees, funeral and burial fees, and pain and suffering, among other things. Her complaint alleges that if her father had been made aware of the risks associated with the drug, they would have chosen a safer alternative. Additionally, she alleges that Janssen Pharmaceuticals (a division of Johnson & Johnson) and Bayer AG proved to be negligent and reckless by marketing a drug like Xarelto.

    By many of the recent lawsuits, Xarelto is alleged to be a more dangerous drug than other blood thinners because of the fact that it has no antidote. If a patient taking an alternative type of blood thinner becomes injured and bleeds, doctors are able to administer vitamin K which negates the effects of the blood thinner and forces the blood to clot again. If a patient taking Xarelto suffers injuries and begins to bleed vitamin K cannot reverse its effects, and the blood is unable to clot. In these instances, doctors have to resort to life-saving measures such as blood transfusions.

    As these instances continue to occur among patients using Xarelto, the number of lawsuits filed against the drug company grows. Just a few months ago, the lawsuits were consolidated into a Xarelto multidistrict litigation, or MDL. Court documents highlighted around 1,200 lawsuits that had been consolidated into MDL 2592 toward the end of August. At the end of September, Case Management Order #2 was issued by the Court. Additionally, the FDA has attached two ‘Black Box’ warnings to the product. These are the most strict warnings possible. The next step would likely be a recall of the product mandated by the FDA.

    New Lawsuit Filed Against Xarelto

    The plaintiff, the son, is a resident of Tennessee.  He is alleging that his father’s death was caused by an uncontrollable internal bleeding incident directly linked to his father’s Xarelto usage.  The complaint outlines that the plaintiff’s father was initially prescribed Xarelto in November 2012 to treat a heart condition he suffered from known as atrial fibrillation.  The plaintiff’s father continued to take Xarelto until he died due to an internal bleed in March of 2013.  The complaint details that the deceased would not have taken Xarelto if him and his son were fully aware of the real risks that the drug presented.  If they were fully aware of the risks, they would have opted for a much safer alternative.

    The Real Dangers of Xarelto

    Xarelto is a part of a new class of blood thinners called Xa inhibitors.  Xa inhibitors work differently from traditional blood thinners because it blocks the chemical in the blood responsible for making the blood clot, thrombin.  By blocking thrombin, Xarelto completely takes away the blood’s ability to clot.  This is extremely dangerous because there is currently no antidote for Xarelto’s anticoagulant effects.  The lack of antidote means that if a patient taking Xarelto and experiences an internal bleeding injury, there is no way to stop the bleeding.  This is a very different situation than patients taking the traditional blood thinner Warfarin are in.  If a patient taking Warfarin experiences an internal bleeding injury, a doctor can simply administer vitamin K and the patient’s blood will clot.

    Many of the lawsuits filed in the multidistrict litigation allege that the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals, had prior knowledge of the true dangers of the drug yet released Xarelto onto the U.S. market anyway.  They also allege that releasing Xarelto without an antidote was negligent and irresponsible.

    As part of a multidistrict litigation, or MDL, a Xarelto bleeding lawsuit was recently filed against Janssen Pharmaceuticals on behalf of a deceased Nebraska woman, who allegedly died as a result of taking the blood thinner.

    Xarelto (rivaroxaban) is an extremely popular anticoagulant or prescription blood thinner that has, in recent years, been the target of a steadily increasing number of Xarelto bleeding lawsuits.

    Currently, the prescription blood thinner is facing about 1,200 different Xarelto lawsuits. These lawsuits have been filed by or on behalf of Xarelto users who have subsequently experienced such side effects as gastrointestinal bleeding, hemorrhaging, or other adverse bleeding events.

    All of the cases involved in this multidistrict litigation have similar allegations. The Xarelto bleeding lawsuits all claim that the drug’s makers failed to be completely transparent to the community, neglecting to adequately warn the public and the medical community about their product and its potential Xarelto bleeding side effects.

    The cases also allege that Xarelto’s manufacturer needs to be held accountable for its failure to provide an antidote, especially considering the serious side effects alleged in the lawsuits.

    Xarelto was introduced in 2011 as a replacement for Coumadin (generic brand warfarin). Xarelto was meant to help reduce the potential for blood clotting in individuals at risk for conditions such as deep vein thrombosis (DVT) or pulmonary embolism (PE).

    Xarelto, unlike generic warfarin and other similar anticoagulants, does not have an available antidote to reverse or reduce the drug’s sometimes dangerous effects.

    Plaintiffs allege that Xarelto’s manufacturers withheld the fact that their drug did not have an available reversal agent or antidote, making the drug more dangerous in the event of severe Xarelto bleeding side effects.

    Coumadin, unlike Xarelto, does have an effective reversal agent available in case of a bleeding emergency.

    Of course, not all side effects of Xarelto are severe or dangerous, and not all users of Xarelto suffer its side effects. However, the few that do can undergo a number of potentially severe or even life-threatening bleeding issues that are made even more dangerous by the lack of an antidote.

    One of Xarelto’s main selling points over other anticoagulants is that it does not require blood level monitoring. Many Xarelto users view this as a convenience, but the rising number of Xarelto lawsuits suggest that blood level monitoring could be essential in keeping users safe.

    Similar allegations have been brought up against Pradaxa, created by Boehringer Ingelheim Pharmaceuticals. Plaintiffs have won $650 million total in Pradaxa settlements after several years in court.

    New Xarelto Lawsuit Filed in Vermont

    A Xarelto lawsuit was recently filed in Vermont federal court alleging that Xarelto caused a man's uncontrollable internal bleeding and death. In the past year, there has been a rising number of lawsuits filed against the manufacturers of a blood thinner drug called Xarelto. One of the notable lawsuits was filed on July 25, 2014 in Vermont federal court under the case number 2:14-CV-00159-CR.

    Xarelto Lawsuit Allegations

    This particular lawsuit was filed by the daughter of a deceased man from Vermont who was prescribed Xarelto because of his atrial fibrillation, a heart condition that can cause blood clots and stroke. The complaint details that the deceased was prescribed Xarelto by his doctor on July 17, 2012. He continued to take the medication until he was hospitalized for an injury and diagnosed with a parenchymal hemorrhage. The deceased still had Xarelto active in his system, so during the hemorrhage his blood did not clot. After six days of hospitalization, the deceased passed away from an uncontrollable internal bleeding event on August 1, 2012.The lawsuit is brought to court by the daughter of the deceased, who is also based in Vermont. She is the administrator of the deceased’s estate and is seeking compensation for pain and suffering, medical expenses, attorney’s fees, probate, funeral and burial expenses, and other expenses that are related to the deceased’s treatment and administration of his estate.

    The complaint alleges that the deceased’s untimely death was caused by Xarelto. The complaint also alleges that if the plaintiff and her father were aware of the true risks of an uncontrollable internal bleed, they would have not chosen Xarelto for his treatment because of the safer alternatives available on the market. Finally, they allege the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals, a subdivision of Johnson&Johnson, were reckless and negligent by putting the drug to market, which was the proximate cause of the injuries and death of the deceased.

    Xarelto's Dangerous Defect

    The lawsuits allege that Xarelto is a much more dangerous drug than other blood thinners on the market because Xarelto does not come with a corresponding antidote. This means that if a patient suffers from an internal bleeding event, there is no medical way available, short of extreme life saving measures, to stop the bleeding. This is in sharp contrast to the situation that patients who take Warfain are in. If a patient taking Warfarin suffers from an internal bleed, a doctor will be able to administer vitamin K and the blood will clot again. Many lawsuits allege that Xarelto’s manufacturers were aware of this dangerous defect with the drug and yet put it to market anyway.   11. Studies Link Xarelto With Bleeding in the Stomach and Eye

    Xarelto is a blood-thinning drug that has already been associated with severe health problems such as uncontrolled spinal bleeding, brain hemorrhages and others. But two recent studies have also linked the drug with an increased risk of stomach bleeding and eye hemorrhages. One study was published in the April issue of BMJ (formerly known as the British Medical Journal), while the other was published in the June issue of JAMA Ophthalmology.

    Stomach Bleeding Risks

    The researchers who performed the BMJ study were quoted as saying they could not rule out the possibility that people who take Xarelto are at twice the risk of developing a stomach bleed when compared with warfarin, an anti-coagulant that was developed in the 1950s. This study analyzed 46,000 patients who took Xarelto as well as another of the newer anti-coagulant medications, Pradaxa.

    Elderly patients are at the highest risk of stomach bleeds after taking Xarelto, the BMJ reports. According to the study, 74.1 percent of bleeding incidents occurred in patients 75 years or older. The average age of patients who died from bleeding in the stomach was 82.1 years.

    Eye Hemorrhage Risks

    According to the study that appeared in JAMA, doctors reported that several elderly patients who had moved to Xarelto from warfarin suffered bleeding between the retina and lens – referred to as “vitreous hemorrhage.” The authors of the study, Drs. John C. Hwang (of the Keck School of Medicine at the University of Southern California) and Judy H. Hun (of Retina Associates of Orange County in Laguna Hills, CA) suggested that doctors be aware of this problem when transitioning patients from warfarin to Xarelto.

  12. Lawsuit on Xarelto Claims Link to Ischemic Strokes and Other Bleeding Events

    A lawsuit filed last week in state court in Philadelphia, Pennsylvania alleges that Xarelto’s recommended dosage doesn’t work for as long as is represented by the manufacturer, JanssenPharmaceuticals and Bayer HealthCare. It is believed to be the first in the nation to allege that Xarelto does not prevent, and in some cases may actually contribute to, ischemic strokes in patients suffering from atrial fibrillation.

    The lawsuit was filed on behalf of a Florida man who suffered anischemic stroke while taking Xarelto, an anticoagulant prescribed to specifically prevent stroke. The case alleges that the indicated 20mg dose of Xarelto is insufficient to protect against stroke/systemic embolism for those who take the medication once a day. Xarelto is currently the only new anticoagulant that is recommended by the manufacturer for once-per-day dosing for those with atrial fibrillation. All other comparable anticoagulants are given on a twice-per-day basis.

    Xarelto MDL

    Late in 2014, the U.S. Judicial Panel on Multidistrict Litigation (MDL) announced that all nationwide Xarelto lawsuits filed in federal courts would be consolidated in the Eastern District of Louisiana before U.S. District Judge Eldon E. Fallon. Experts estimate that eventually several thousand cases will be transferred into the MDL.

    According to court documents, all of the pending Xarelto lawsuits allege that the manufacturers of the drug:Failed to provide adequate warnings regarding the risk of uncontrollable internal bleeding associated with Xarelto, particularly the lack of an approved antidote to counteract bleeding incidents.Falsely marketed Xarelto as a superior alternative to warfarin, a blood thinner that has been on the market for decades, pointing out that warfarin bleeding can be reversed with the administration of vitamin K.

    Xarelto was approved by the U.S. Food and Drug Administration (FDA) in 2011, and is currently being prescribed to prevent strokes in people with atrial fibrillation, treat deep vein thrombosis and pulmonary embolism, and prevent deep vein thrombosis in patients undergoing hip or knee replacement surgery.

    A lawsuit filed last week in Pennsylvania state court against Janssen Pharmaceuticals alleges that the company’s recommended once a day dosage for the blockbuster drug Xarelto isn’t effective for a full 24 hours.

    A plaintiff with non-valvular atrial fibrillation who suffered a stroke four days after starting on Xarelto filed the lawsuit in Philadelphia on October 8. The suit alleges that the indicated 20mg dose of the medication is insufficient to protect against stroke/systemic embolism for those who take the medication once a day.

    The Pennsylvania case is believed to be the first in the nation to make the allegation that Xarelto is not effective in preventing, and in some cases actually contributing to, ischemic strokes in patients suffering from atrial fibrillation.

    What is Xarelto?

    Xarelto was approved by the U.S. Food and Drug Administration (FDA) in 2011, and is currently being prescribed to prevent strokes in people with atrial fibrillation, treat deep vein thrombosis and pulmonary embolism, and prevent deep vein thrombosis in patients undergoing hip or knee replacement surgery.

    Xarelto is currently the only new anticoagulant that is recommended by the manufacturer for once-a-day dosing for patients with atrial fibrillation. Rival anticoagulants require users to take multiple doses per day and in some situations, to undergo monitoring.
