    Allegations Made Against Xarelto Manufacturers:

    The lawsuits in the Philadelphia mass tort group are able to be consolidate because they all make similar allegations against the same defendants, in this case the defendants are the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals.  The lawsuits filed all generally allege that Xarelto causes uncontrollable internal bleeding that can lead to serious injury and even death in patients, that the manufacturers of Xarelto failed to adequately warn patients and doctors about real dangers of the drug and provide them with information on how to stabilize patients experiencing an adverse reaction, and that the manufacturers of Xarelto were negligent in releasing the drug onto the market without a corresponding antidote.  For a full list of the cases filed, click here.

    Lawsuits Allege Lack of Antidote is Negligent:

    These lawsuits allege that Xarelto is significantly more dangerous than other blood thinners on the market because Xarelto does not have a corresponding antidote available.  This means that if a patient taking Xarelto suffers from an internal bleeding injury, that internal bleed can become uncontrollable because there is no way to stop the bleeding.  This is what has led to the injury of many of the plaintiffs in the mass tort group and it is a very different situation than patients who are taking other blood thinners, such as Warfarin, are in.  If a patient taking Warfarin experiences an internal bleed, a doctor will be able to simply administer vitamin K to the patient and their blood will clot again.

The complaint filed alleges that blood thinning drug Xarelto caused the man’s uncontrollable bleeding and subsequent death.

    The daughter goes on to explain that her father was prescribed Xarelto to treat his atrial fibrillation. Atrial fibrillation is a heart condition which causes the heart to beat more quickly than normal. Although the condition is not a fatal one, it can cause blood clots or strokes, so individuals with atrial fibrillation commonly use blood thinners.

    After just a short time taking the medication, the man became injured and was hospitalized. At the hospital, doctors said he had suffered a parenchymal hemorrhage, and they could not stop the bleeding. Because he still had active Xarelto in his system, physicians were unable to make his blood clot. After 6 days of significant blood loss, the man passed away.

    The daughter’s complaint goes on to allege that if she or her father were previously aware of this dangerous side effect of Xarelto, they would have never used the drug. She also noted that there were other blood thinners on the market at the time which now appear to be safer alternatives. This is a commonly heard statement. Many Xarelto lawsuit plaintiffs consider the drug to be the most dangerous blood thinner on the market. This is due to the fact that the drug has no corresponding antidote. Manufacturers have been termed negligent and reckless to release it without one.

    If someone has Xarelto in their system and they injure themselves and begin to bleed, doctors cannot make their blood clot because of the medication. In these instances, physicians must resort to life-saving measures such as blood transfusions to attempt to keep the patient alive. Those taking traditional blood thinners who are injured and bleeding, however, are able to be given a vitamin K treatment which reverses the effects of the medication and allows their blood to clot.

    On a federal level, Xarelto lawsuits currently make up over 1,700 filed cases. Complaints are filed against defendants Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson). They were formed into multidistrict litigation number 2592, and all contain similar allegations that the blood thinning drug caused uncontrollable bleeding events. Many plaintiffs call Xarelto the most dangerous blood thinner on the market, due to the fact that it was developed and sold without a corresponding antidote.

    Because the drug has no antidote, if someone taking it is injured and bleeds, there is nothing physicians can do to reverse the effects of the drug and get that person’s blood to clot. Xarelto is the subject of over 2,000 lawsuits: more than 1,700 which have been federally filed and consolidated to form the MDL, and more than 300 which are part of a mass tort in Philadelphia, Pennsylvania. It is fully expected that as these cases await trial, others will continue to be filed.

  6. Xarelto Lawsuit Questions Drug’s Once-Daily Dosage

The suit, filed against Janssen Pharmaceuticals (a division of Johnson & Johnson), brings a new argument to the table against blood-thinner Xarelto. It alleges that the recommended once-daily dosage of the drug is not effective for 24-hours as indicated. Supporting evidence of this is found in details of the suit, which discuss a plaintiff who suffered a stroke just four days after starting to use Xarelto in order to prevent a stroke due to his atrial fibrillation condition.

    Xarelto is unlike other blood thinners on the market today with its one pill a day, one-size-fits-all dosing. Other blood thinners require 2 doses of medication daily. After having a stroke, the plaintiff in this case filed a suit against the drug and manufacturer on October 8th of 2015. His complaint is the first of its kind concerning Xarelto, however, there are many other lawsuits which similarly allege the drug is problematic. Most commonly, it has been alleged that Xarelto causes increased risk for uncontrollable bleeding injuries and even death.

    In this particular suit, the plaintiff not only states that the drug was ineffective in preventing his stroke as it was supposed to do, but he also alleges that the medication may have actually caused his stroke. Across the nation, Xarelto has been the subject of more than 1,700 federal lawsuits and over 300 suits in a mass tort in Philadelphia.

    Xarelto was approved by the United States Food and Drug Administration in 2011 to prevent strokes and blood clots for individuals with atrial fibrillation, and also those recovering from knee and hip surgeries. The drug is supposed to help ensure that these patients do not develop blood clots such as deep vein thrombosis or pulmonary embolism. Initially, consumers were enticed to use Xarelto due to the fact that, unlike more traditional blood thinners, the drug did not require regular evaluations by a physician, or a special diet.

    As allegations in the many pending suits have brought to light, a major problem with the new type of blood thinner, however, was that it was released to the market with no corresponding antidote. Individuals using the drug who begin to bleed will be unable to get their blood to clot. Physicians treating patients in this situation have to resort to life-saving measures such as blood transfusions. Traditional blood thinners are different in this way, as well. The effects of these anticoagulants are able to be reversed with vitamin K treatments.   9. Xarelto Lawsuit Alleges Drug Caused Vermont Man's Parenchymal Hemorrhage And Death

The suit is just one of many which similarly allege that Xarelto causes uncontrollable bleeding that can lead to severe injury or death. The suit was filed under case number 2:14-cv-00159-cr in Vermont federal court on July 25th of last year. It was filed by a daughter for her father, who had died due to a parenchymal hemorrhage which his family alleges was caused by his use of Xarelto.

    Details within the lawsuit explain that the father was admitted to the hospital and diagnosed with a parenchymal hemorrhage, however, physicians were unable to get the man to stop bleeding. His blood would not clot due to the fact that there was active Xarelto in his system. Because the drug has no antidote, physicians were unable to counter its effects. The man had taken Xarelto for less than one month when he died due to his uncontrollable internal bleeding on the 1st of August, 2012.

    The man’s daughter, now representing her father in the current lawsuit, is looking to gain compensation for his wrongful death. As the administrator of her father’s estate, she is seeking damages for the cost of medical and funeral fees, as well as pain and damages. She states clearly in the suit that, had she and her father known about the dangers allegedly associated with Xarelto, they would have chosen a safer alternative to treat him. She also makes note that it shows negligence and recklessness that the manufacturers moved forward with releasing the drug to the market without any corresponding antidote.

    Traditional blood thinners, such as warfarin, do not have this problem. When patients who have traditional blood thinners in their system are injured and bleeding, physicians are able to treat them with vitamin K, which counteracts the effects of the medication and allows their blood to clot. Xarelto does not respond to vitamin K, or to anything for that matter. Because it has no antidote, physicians have to treat patients who are bleeding with Xarelto in their systems by resorting to life-saving measures such as blood transfusions in an attempt to keep them alive. For this reason, Xarelto is widely considered the most dangerous blood thinner currently on the market.

    Xarelto has been the subject of over 2,000 lawsuits across the country. Around 1,700 of these suits are in federal court and have been consolidated to form multidistrict litigation number 2592. They respond to vitamin K treatments, so that if someone taking a traditional blood thinner becomes injured and bleeds, doctors administer vitamin K to reverse the medicine’s effects and clot their blood more easily.

    BloodThinnerHelp.com reports on lawsuits filed against Bayer AG and Janssen Pharmaceuticals (a division of pharmaceutical conglomerate Johnson & Johnson), which question blood-thinning drug Xarelto’s market release without corresponding antidote. The suits note that the lack of antidote, which is still the case today, is irresponsible and negligent. The drug, despite it’s lack of antidote, has been on the market for four years now, and has also become the subject of an increasing number of lawsuits which connect it to uncontrollable bleeding and death.

    The lack of antidote means that when a patient who has Xarelto in their system is injured and starts to bleed, physicians are unable to reverse the drug’s effects to get that patient’s blood to clot. This can put the patient at serious risk for uncontrollable bleeding. In these cases, doctors resort to life-saving measures such as blood transfusions in an attempt to save the patient’s life.

    Traditional blood thinners do not have this problem. Their effects can be countered by vitamin K. When patients who use traditional blood thinners such as warfarin are injured and bleeding, physicians administer vitamin K, and the patient’s blood will clot.     A Tennessee woman who developed gastrointestinal bleeding two weeks after first taking Xarelto filed a Xarelto bleeding lawsuit against Janssen Research and Development.

    Plaintiff Judy S. alleges in her lawsuit that taking Xarelto caused the severe gastrointestinal bleeding that led to hospitalization and continuing treatment.

    The Xarelto bleeding lawsuit claims that neither the plaintiff nor her doctor knew about the risks of excessive internal bleeding associated with Xarelto, because Janssen failed to adequately warn  about those risks.

    Furthermore, the lawsuit claims that had Janssen given adequate warning about the risks, the plaintiff’s doctor would not have prescribed Xarelto, nor would the plaintiff have agreed to take Xarelto. According to the Xarelto lawsuit, Janssen did not disclose the serious risks associated with Xarelto.

    The Xarelto lawsuit alleges that the plaintiff’s gastrointestinal bleeding and suffering occurred because of Xarelto’s negligent and defective design, and further alleges that Janssen knew of this defective design. Specifically, Janssen allegedly knew that gastrointestinal bleeding was more common in Xarelto patients than patients who took other blood thinners.

    Xarelto Bleeding Side Effects

    Xarelto (rivaroxaban) is a popular blood thinner. In recent years, Xarelto has been targeted in an increasing number of Xarelto bleeding lawsuits.

    More than 1,000 Xarelto lawsuits have been filed against Janssen on behalf of Xarelto users who have experienced dangerous Xarelto side effects. These side effects include gastrointestinal bleeding, hemorrhaging, and other adverse bleeding events.

    Xarelto is a popular anticoagulant on the market that is marketed as “one-size-fits-all” type of drug, unlike the older anticoagulants, like Warfarin that require multitudes of doctors visits and blood tests to get the correct dosage per person.

    Xarelto was approved for use by the Food and Drug Administration in 2011 as a blood thinner to be used by patients who had a knee or hip replacement surgery in order to lower the chances of blood clots forming. Further approval of Xarelto was for use in people with AFib, brought on by poor blood circulation in the body, in order to lower the chances of blood clots in such patients.

    Medical Studies Associate High Risk Of Internal Bleeding With Xarelto

    Unfortunately, ever since Xarelto was approved the FDA, there have been multiple lawsuits that have been filed against the makers of the drug due to patients experiencing internal bleeding events. There have been medical studies undertaken that ascertain the negative effects Xarelto can have on a patient. Some of the medical study summaries are as follows:

    British Medical Journal– results of their study implied that the chances of internal bleeding, more so gastrointestinal bleeding, are likely to double in individuals who are taking Xarelto as opposed to those using Warfarin.

    Erasmus MC University Medical Center (Rotterdam)- this research discovered a 1.49 times rise in the possibility of someone taking Xarelto experiencing an internal bleed in comparison to someone taking Warfarin.

    Baylor College of Medicine- this study released in the Clinical Cardiology in January 2015, evaluated 27,467 individuals using Xarelto for the period January 2013 to March 2014 and found that 487 of those evaluated experienced a major bleed incident, and fatally 14 of those individuals died from the internal bleeding.

    Other Known Adverse Effects Of Taking Xarelto

    Unlike the more traditional blood thinner Warfarin, Xarelto has no known antidote in the event that the blood is required to clot if an injury occurs. Due to Xarelto’s make up and lack of antidote, the following are some of the side effects a patient taking Xarelto may experience if injured:

    Abdominal Bleeding: An internal bleeding in the abdomen can happen in the esophagus, large intestine, colon, rectum, anus, and small intestine. Depending on where the bleed is occurring the symptoms may include, light-headedness, shortness of breath, blood in the stool, and decreased blood pressure.

    Brain Hemorrhage: This is a type of stroke caused by the bursting of an artery that causes localized bleeding in the surrounding tissues. This form of bleeding is known to kill brain cells. Symptoms of a brain hemorrhage will vary depending on the location of the bleeding, the intensity of the bleeding, and also the amount of tissue affected. Symptoms can develop suddenly or over time, or they can progress for the worst or suddenly happen. Symptoms can be a sudden severe headache, seizures, weakness in arm or leg, lethargy among other things.

    Abnormal liver function: The JAMA Internal Medicine Journal states that Xarelto can lead to Hepatitis or abnormal liver function. Symptoms of abnormal liver function can include weakness and fatigue, weight loss, nausea and vomiting, and jaundice.

  20. Xarelto Bleeding Lawsuit Alleges Drug Caused Wrongful Death

    A woman in Rhode Island is suing Janssen Pharmaceuticals and parent company Johnson & Johnson on behalf of her late husband who allegedly suffered personal injury and later died as a result of using the anticoagulant drug Xarelto.

    Plaintiff Dorothy P. said her husband Graham P. was prescribed Xarelto by his physician and took the medication from January 2013 until February 2013 for the treatment of atrial fibrillation.

    Atrial fibrillation is an irregular heartbeat that can lead to blood clots or stroke, so the medication was prescribed to Graham in hopes that he would avoid these cardiovascular events.

    According to the Xarelto lawsuit, as a direct and proximate result of Xarelto, Graham suffered a cerebral hemorrhage and stroke in February 2013; he also experienced a life-threatening, irreversible bleed, pain and suffering. Graham died on February 14, 2013 as a result of these injuries.

    In addition to physical damages, Graham and Patricia incurred medical expenses, the loss of accumulations, funeral expenses, probate, attorney and other administrative fees. Patricia also had other economic and non-economic damages following Graham’s death.

    Patricia brings forth eleven counts against the defendants including negligence, strict products liability, breaches of express and implied warranty, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit, violation of consumer protection laws, survival action and wrongful death action.

    The plaintiff is seeking compensatory, economic, and punitive damages, pre- and postjudgment interest, attorney fees and costs and other relief as deemed fair by the court.

    Her Xarelto Lawsuit is Dorothy P. v. Janssen Research & Development, LLC, Case No. 3:15-cv-02774-MAS-DEA, in the United States District Court, New Jersey.

    Xarelto Side Effects

    Xarelto (rivaroxaban) is an anticoagulant drug used preventatively to reduce the risk of stroke and blood clots in patients with atrial fibrillation. It is also used to treat deep vein thrombosis (DVT), a condition where blood clots form in deep veins, usually in the lower extremities, and pulmonary embolism (PE), a condition that occurs when a blood clot affects the lungs.

    While many doctors appeared to like new generation anticoagulants like Xarelto for their ease of administration, less frequent need for monitoring, and lack of dietary restrictions while taking the drug, Xarelto and its closely related drug counterparts have a major drawback: lack of an effective reversal agent.

    All anticoagulant drugs have the side effect of bleeding complications. Because the drugs inhibit the body’s natural clotting mechanism, it is a known potential issue. The older generation anticoagulant drug, warfarin (Coumadin), however, has an effective reversal agent.

    As an antidote to excessive bleeding, patients taking warfarin could be administered fresh frozen plasma and intravenous vitamin K to effectively stop the bleeding and resume clotting.

    Xarelto does not currently have such an intervention to effectively stop bleeding. Essentially, patients must wait until the drug leaves their system and the blood begins clotting again. For some, the wait might be too long and the Xarelto bleed becomes fatal.

  22. Louisiana Xarelto Wrongful Death Lawsuit

    In the latest of recently filed cases, Ashlie Fluitt from Louisiana,  filed a wrongful death claim on behalf of her grandmother who died as a result of catastrophic side effects from using Xarelto. According to the lawsuit, it is alleged that Xarelto caused severe intracranial bleeding which caused her grandmother to die.

    The lawsuit was filed in the U.S. District Court for the Eastern District of Louisiana alleging that Hattie Deville-Goodwin’s death was caused by Bayer Healthcare and Johnson & Johnson’s Janssen subsidiary’s failure to warn about the uncontrollable bleeding side effects associated with the new-generation anticoagulant Xarelto.

    Deville-Goodwin took Xarelto for treatment of deep vein thrombosis in in her leg. Two months later, Deville-Goodwin developed severe bleeding in the brain, and died shortly afterwards from the deadly intracranial hemorrhage.

    Many lawsuits have been filed against Xarelto’s manufacturers and the plaintiffs claim that the companies failed to warn patients and doctors about the risks associated with Xarelto and the lack of an antidote to help stop the bleeding.

    Since December 2014, all federal product liability lawsuits filed against Bayer and Johnson & Johnson over the bleeding side effects of Xarelto have been centralized and consolidated before U.S. District Judge Eldon Fallon in the Eastern District of Louisiana as part of an MDL, or multidistrict litigation.

    Lawsuits against Bayer and Johnson & Johnson are consolidated in two courts, a multidistrict litigation court in the Eastern District of Louisiana and a mass tort litigation court in Philadelphia.

    The MDL in Louisiana contains over 2,200 federal lawsuits, and the mass tort in Philadelphia contains more than 400 state lawsuits.

    4 Xarelto Bellwether Trials Set

    Judge Fallon set a series of four bellwether trials to go before juries in the Spring of 2017. As of November 15, according the data provided by the Judicial Panel Multidistrict Litigation (JPML) there are 2,266 Xarelto bleeding injury lawsuits in the Eastern District of Louisiana.

    The number of Xarelto lawsuits continue to increase and be filed by individuals across the United States, alleging severe and deadly bleeding complications.

    Bellwether Trials in Louisiana, Mississippi and Texas

    The first two trials will be held in the Eastern District of Louisiana, on February 6 and March 13, 2017. The third trial will be held in Mississippi on April 24, 2017 and the fourth trial will be held in Texas on May 30, 2017.

    According to Judge Fallon’s order, the cases that will go before juries on these dates will be pulled from a pool of 40 lawsuits to be selected in January 2016. These cases will be trial ready, with case-specific discovery, including depositions of plaintiffs, prescribing doctors, treating physicians and sales representatives of the drug makers.

    What is Xarelto?

    Xarelto (rivaroxoaban) was released and approved for sale in 2011 as a superior replacement for Coumadin (warfarin). Xarelto is used to reduce the risk of blood clots among patients at risk for deep vein thrombosis, pulmonary embolism and those patients at risk for a stroke with atrial fibrillation.

    Atrial fibrillation is a common heart rhythm problem, which leads to embolic strokes, from blood clots that develop in the heart and travel up to the brain.

    Xarelto was developed and sold jointly by Johnson & Johnson’s Janssen Pharmaceuticals subsidiary and Bayer Healthcare. Xarelto is a “direct thrombin inhibitor,” and Xarelto was released to compete with Boehringer Ingelheim’s Pradaxa, another new type of anticoagulant. Both drugs were touted as being superior and easier to use than the older blood thinner warfarin, also known as Coumadin. Coumadin was the gold standard for anticoagulants and dominated the blood thinner market for several decades.

    Xarelto has the largest share of the market for anticoagulants and is considered a blockbuster drug, with annual sales over $1 Billion in the United States.

    Big Problem: No Xarelto Antidote

    All anticoagulants or blood thinners have a risk of bleeding and injury, but Xarelto has been linked to a significant number of injuries involving catastrophic and uncontrollable bleeds, including death.

    Xarelto has been advertised heavily as being easier to use than warfarin, since it does not require regular blood monitoring. According to  several recent studies, those claims may be in doubt.  Medical researchers have indicated that Xarelto blood monitoring may actually help doctors identify patients at the greatest risk of bleeding.

    Plaintiffs are filing bleeding lawsuits claiming that the drug manufacturers suppressed information about the lack of a reversal agent. Warfarin’s blooding thinning effects can be quickly reversed in an emergency, there is no antidote for Xarelto.

    Similar Lawsuits Claims Settled For Pradaxa

    Pradaxa, is another new-generation anticoagulant introduced by Boehringer Ingelheim in October 2010. In 2014, there were 3,592 serious adverse event reports involving Pradaxa, with 752 involving the death of the patient, compared with 3,331 reports associated to Xarelto bleeding problems, with 379 involving a patient death.

    Similar allegations of a lack of an antidote, were raised in more than 4,000 Pradaxa lawsuits. On the eve of trial, Boehringer Ingelheim agreed to pay $650 million in Pradaxa settlements, with an average of about $150,000 per claim.
