The lack of antidote means that when a patient who has Xarelto in their system is injured and starts to bleed, physicians are unable to reverse the drug’s effects to get that patient’s blood to clot. This can put the patient at serious risk for uncontrollable bleeding. In these cases, doctors resort to life-saving measures such as blood transfusions in an attempt to save the patient’s life.
Traditional blood thinners do not have this problem. Their effects can be countered by vitamin K. When patients who use traditional blood thinners such as warfarin are injured and bleeding, physicians administer vitamin K, and the patient’s blood will clot. This can be a truly life-saving difference, and is also the reason that many allege Xarelto to be the most dangerous blood thinner currently on the market.
Anyone who has used Xarelto and who has suffered adverse health effects that they attribute to the drug may be able to file a lawsuit and may be entitled to compensation for their damages. Are there are serious risks with Xarelto? The Lawsuit Claimants Say Yes!
Because of the risk of hemorrhage, blood thinners often require periodic medical monitoring through doctor visits along with the patient’s self-intervention with dietary and lifestyle changes. While previous blood thinner medications required regular doctor visits and alterations to a person’s lifestyle and dietary habits, it is claimed that Xarelto is sold and marketed as an alternative which does not require the constant check-ups and the drastic lifestyle changes. Similar litigation
The anti-coagulant market is estimated to bring in $10 billion a year. Thousands of lawsuits with the same allegations were brought in state and federal courts against German drug manufacturer Boehringer Ingelheim, who also didn’t have a solution to bleeding when its blood thinner, Pradaxa was used. Pradaxa was only approved by the U.S. Food and Drug Administration in 2010, and by 2011, it was alleged that more than 540 patients had lost their lives while using the blood thinner. Others had testified of their experiences with very serious side effects. Boehringer Ingelheim has agreed to pay $650 million to settle those state and federal lawsuits.

1. Common Side Effects-
There are quite a few common side effects associated with Xarelto, and this includes pain in the back, bleeding gums, as well as blood in your stool. The pain in your back could vary in pain, and so can the amount of blood in your stool. Asides from those three side effects, other common ones include bowel or bladder dysfunction, as well as tingling feelings or the feeling of pins and needles. Plaintiff Veronica R. was first prescribed Xarelto in 2013, and had followed all medication instructions and listened to the advice of her physician. Despite her diligence, Veronica needed to seek medical attention on several occasions, with the most significant being on May 13, 2013.
Court documents indicate that Veronica suffered bleeding ulcers and vaginal bleeding, allegedly result of ingesting Xarelto. Veronica is filing this Xarelto bleeding lawsuit against Bayer and Janssen for failing to warn her against the potential dangers of Xarelto, and claims that she had no prior warning of the potential side effects before she suffered the bleeding events.
Additionally, her lawsuit indicates that her doctor also had no prior knowledge of this, and was not notified by the drug companies of possible Xarelto bleeding complication. Veronica insists that she never would have taken the blood thinner medication if she shad know the potential side effects associated with this drug, and would have opted for a safer product.
So for being allegedly responsible for manufacturing, selling, distributing, and marketing a dangerous drug, Veronica is suing Bayer and Janssen Pharmaceuticals. The charges include: negligence, false advertising, concealing information, and misrepresenting a product.
Xarelto Bleeding Events
Xarelto is a new generation anticoagulant that contrasts greatly from America’s traditional blood thinner, Warfarin. Xarelto and the other newer anticoagulants, Pradaxa and Eliquis, are prescribed in one dose and do not require constant medical monitoring like Warfarin requires.
However, Warfarin patients have a key feature that Xarelto and other newer anticoagulants currently lack – a bleeding reversal agent. In the case of internal bleeding, patients implement vitamin K to stop any internal bleeding injury.
Xarelto was approved in 2011, and is often prescribed to treat patients with atrial fibrillation, and patients at high risk for stroke.
It was released as a joint effort between Bayer Pharmaceuticals and Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson. The Food and Drug Administration (FDA) approved Xarelto for use in patients who have had knee or hip replacement surgery to reduce the risk of blood clots, reducing the risk of stroke in people with AF. Following a fast-track regulatory review, the FDA approved the drug for general treatment of deep vein thrombosis (DVT) and pulmonary embolism (PE).
One of the most severe side effects of Xarelto is uncontrolled bleeding. When bleeding occurs near a major organ, such as the brain, lungs or kidneys, blood flow to that organ is interrupted, causing it to lose some or all of its functionality. Also, pools of blood may form within the body and can cause other severe health risks. Because Xarelto prevents clotting, the hemorrhaging will continue until the drug is flushed out of the system.

More Xarelto lawsuits alleging patients suffered serious bleeding events after using the anticoagulant have been filed, with the multidistrict litigation now sitting at more than 2,200 consolidated cases. Plaintiffs say they were not adequately warned about the risk of Xarelto side effects, nor were they warned that Xarelto, unlike its predecessor, did not have an approved antidote.
According to court documents from the Judicial Panel on Multidistrict Litigation, as of November 16, 2015, there were 2,266 lawsuits consolidated in MDL 2592, before US District Judge Eldon Fallon. That’s up significantly from the 1,698 lawsuits consolidated as of October 15, 2015.
Xarelto, known generically as rivaroxaban, is a newer-generation anticoagulant, used to reduce the risk of blood clots and strokes. It, like other newer anticoagulants, were developed as an alternative to Coumadin (known generically as warfarin), because Coumadin required regular blood monitoring. Because anticoagulants prevent blood clots, however, they are associated with an increased risk of serious bleeding events.
Coumadin has an antidote in the form of vitamin K. Patients who took Coumadin and experienced a serious bleeding event could be given vitamin K and have the anticoagulant effects reversed. Newer-generation anticoagulants, however, were approved for use on the market without an antidote. That means if patients experienced a bleeding event, they would have to wait for the drug to leave their system. Plaintiffs allege if they had known there was no antidote to Xarelto, they would not have used the medication.
The first bellwether Xarelto trials are expected to go to court early in 2017, meaning there is still time for patients who were affected by Xarelto to file lawsuits.One such lawsuit was filed by Ashlie Fluitt, whose grandmother died while on Xarelto therapy. The patient, Hattie Deville-Goodwin, was prescribed Xarelto in September 2014 to treat deep vein thrombosis. Only two months after she began using Xarelto, Deville-Goodwin experienced an intracranial bleed, which became an “irreversible and fatal bleed.” She died on November 14, 2014, according to court documents.
The lawsuit claims Xarelto caused life-threatening bleeding, physical pain, extreme mental anguish, and financial expenses for hospitalization and medical care. In her lawsuit, Fluitt alleges that Bayer used the results of various studies to promote Xarelto but did not highlight the increased risk of gastrointestinal bleeding and other serious bleeding events, and did not warn emergency room doctors about the lack of an effective reversal agent for Xarelto. Furthermore, the lawsuit alleges Xarelto marketing “overstated the efficacy of Xarelto with respect to preventing stroke and systemic embolism.”

Xarelto Bellwether Selection Process in MDL Outlined by Judge Fallon

The U.S. District Judge presiding over all federal Xarelto lawsuits has laid out the process for selecting 40 cases that will be part of a bellwether discovery pool, out of which at least four claims are expected to be chosen for the first trial dates in early 2017.
There are currently more than 2,800 product liability lawsuits pending against Bayer and Johnson & Johnson’s Janssen subsidiary over failure to adequately warn about the bleeding risks linked to side effects of Xarelto, which is part of a new generation of blood thinners introduced in recent years as a replacement for warfarin among individuals at risk of clots.
Since December 2014, the federal Xarelto litigation has been consolidated as part of an MDL, or multidistrict litigation, with all cases centralized before U.S. District Judge Eldon Fallon in the Eastern District of Louisiana for coordinated handling during discovery and a series of early “bellwether” test trials, which are designed to help the parties gauge how juries may respond to certain evidence and testimony that is likely to be repeated throughout a large number of claims.
Judge Fallon ordered plaintiffs and defendants to come up with a pool of Xarelto bellwether cases, which will go through case-specific discovery and dispositive motions in preparation for a series of early trial dates that are expected to begin between February 2017 and May 2017. However, the sides failed to resolve disputes over how the cases would be selected.
In a case management order (PDF) issued on November 20, Judge Fallon outlined his own case selection plan to resolve the dispute, indicating that each side will select 10 cases, with an additional 20 cases selected randomly from claims filed in certain venues.
The plan calls for 20 of the cases to originate in the Eastern District of Louisiana, four from federal court in Mississippi, two from federal court in Texas, seven cases in any seven states chosen by plaintiffs, and seven cases from any seven states chosen by defendants. Each of the seven states selected must have at least 20 cases eligible for inclusion in the bellwether plan.
Judge Fallon has directed the parties to continue to meet to determine eligibility criteria for case selections and appropriate case categories, which will be subject to an order at a later date by the Court. The next status conference is scheduled for December 21.
The parties have also been directed to develop a plan for selecting the four cases from this bellwether discovery pool that will become the first to go before juries, indicating that a selection method will be developed by June 10, 2016.
While the outcomes of these Xarelto bellwether trials will not be binding on other claims in the litigation, they are designed to help the parties determine the relative strengths and weaknesses of their claims.
Following the bellwether process, if Xarelto settlements are not reached to resolve large numbers of cases, Bayer and Johnson & Johnson could face hundreds of different trials scheduled in courts throughout the U.S.
