Cases filed federally have been consolidated by the U.S. Judicial Panel on Multidistrict Litigation to form MDL No. 2592 in Eastern Louisiana.

An overview of Xarelto’s ads show glowing endorsements from popular celebrities, well-known names, and athletes, including Brian Vickers (NASCAR), Chris Bosh(Miami Heat), Kevin Nealon (SNL), and Arnold Palmer (a golf legend). In each of the Xarelto TV commercials, these celebrities discuss the blood thinner and its many benefits, however, according to the plaintiff filing this lawsuit, they fail to adequately address what many consumers today have come to consider dangerous health risks of the drug.

Xarelto has also been closely monitored by the U.S. Food and Drug Administration since its 2011 approval. The anticoagulant has been given two ‘black box’ warnings by the organization. These black box warnings are the most severe and notable warnings a product can receive before being completely removed from the market for public sale.

As thousands of Xarelto lawsuit plaintiffs await trial dates, many involved believe that other lawsuits will continue to join the current MDL. As this occurs, Attorney Joseph Osborne is working to assist everyone who believes their health has been negatively impacted by the blood thinner. He wishes to ensure these patients will be provided the important opportunity of fully investigating their legal rights in the matter. Those affected may be entitled to legal action and substantial compensation. Attorney Osborne is currently offering free legal consultations for affected parties.

  3. Xarelto Lawsuit Plaintiffs Claim Blood Thinner Caused Lasting and Dangerous Side Effects

    Mar 15, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on a lawsuit which was filed against pharmaceutical manufacturer Janssen Pharmaceuticals (a subdivision of the Johnson & Johnson corporation) and Bayer Healthcare in reference to the new-generation blood thinning drug they manufacture: Xarelto. The plaintiffs filing the lawsuit, which has been transferred to the U.S. District Court for the Eastern District of Louisiana under case number 2:15-cv-06514, are a Nebraska couple who both claim that the defendants failed to properly warn consumers about the dangerous side effects allegedly linked to their anticoagulant. They also allege that because he used Xarelto as instructed, the husband suffered from a sudden and dangerous bleeding episode, and now suffers from permanent health problems and a shortened life expectancy due to that bleed.

Court documents for the lawsuit reveal further details, indicating that the man had taken Xarelto for a duration of 7 months when he suddenly began to bleed internally. Doctors reportedly noted that he suffered from a severe gastrointestinal bleed which was incredibly difficult to stop because the blood thinner was in his system. The plaintiffs claim that this troublesome bleeding event was caused by Xarelto and may have otherwise been able to be avoided.

These plaintiffs are joined by others from all over the United States who similarly allege that Xarelto use has caused them health problems. In recent times, in fact, Xarelto has become the subject of thousands of lawsuits from concerned plaintiffs, all who agree that the drug puts patients at increased risk for dangerous bleeding episodes which can leave lasting effects. Some of the plaintiffs involved have even filed their lawsuits on behalf of loved ones who have passed away due to severe hemorrhages or bleeds.

Xarelto lawsuits which were federally-filed across America have been consolidated by the U.S. Judicial Panel on Multidistrict Litigation to form MDL No. 2592, which now includes more than 2,800 cases. In addition to these continuously growing cases, more than 600 other Xarelto lawsuits were formed into a mass tort group in Philadelphia, Pennsylvania by the Court of Common Pleas.

The plaintiffs involved in this particular lawsuit are now asking for compensatory and punitive damages, as well as financial coverage for legal fees. They have indicated that they need help to pay mounting medical bills as well as ones that loom in their future. As they await their trial date, Attorney Joseph Osborne is working to assist anyone who feels that they have been negatively affected by Xarelto use. He wishes to help ensure that these individuals will be provided the important opportunity to investigate their legal rights. Patients involved may be entitled to legal action and significant compensation. 4. Xarelto Lawsuit Plaintiff Claims Anticoagulant Drug Caused Texas Womans Dangerous Internal Bleed

    Mar 15, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on another lawsuit which has been filed against Bayer AG and Johnson & Johnson subsidiary Janssen Pharmaceuticals in the Eastern District of New York. The lawsuit plaintiff is a Texas resident who claims that new-generation, blood-thinning drug Xarelto caused her to suffer from dangerous health complications, and that the defendants (who manufacture the drug) failed to adequately warn patients about the substantial risks linked with their anticoagulant. Her complaint was initially filed under number 1:14-cv-04524 in a federal court before being transferred during the formation of MDL 2592.

Further details of her lawsuit found within court documents indicate that the plaintiff was prescribed Xarelto by her doctor as a method of treatment for her atrial fibrillation condition, which can put sufferers at an increased risk for the occurrence of strokes. It is common for blood thinning drugs to be prescribed preventatively in these circumstances. In this particular case, however, the plaintiff claims she took Xarelto for only 5 month’s time before suddenly suffering from a life-threatening internal bleeding episode. Her complaint states that this dangerous and substantial bleed left her with long-term health problems requiring lengthy and costly specialized care.

Xarelto was approved by the U.S. Food and Drug Administration in 2011, though this approval has now become a topic of increasing controversy. The drug is surrounded by more than 3,000 lawsuits from across the nation and has also become the recipient of two ‘black box’ warnings from the FDA. These warnings are the most strict warning a product can receive before being pulled completely from the market.

Currently, federally-filed Xarelto uncontrollable bleeding lawsuits number over 2,800 cases and make up MDL No. 2592 in Eastern Louisiana. They are being overseen by the Honorable Judge Eldon Fallon. In addition to these lawsuits, however, another consolidation of more than 600 Xarelto lawsuits has taken place in Philadelphia, Pennsylvania, where the Court of Common Pleas has created a mass tort. As these many plaintiffs await further trial preparations, Attorney Joseph Osborne is working to help ensure that anyone who believes they were negatively affected by Xarelto will be provided the important opportunity of fully investigating their legal rights. These patients may be entitled to legal action and substantial compensation. To help those deserving pursue justice, Attorney Osborne is currently offering complimentary legal consultations for affected parties.

  5. Xarelto Lawsuit Numbers Surpass 3,400 Within Just Five Years' Time

    Mar 15, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on Xarelto lawsuit numbers which have now reached more than 3,400 in number since its release. The U.S. Food and Drug Administration (FDA) approved the anticoagulant in 2011 and it launched onto the market as a revolutionary, new-generation drug designed to treat patients recovering from knee and hip replacement surgeries, or suffering from deep vein thrombosis, pulmonary embolism, and atrial fibrillation. The drug was incredibly popular, providing users with freedoms that more traditional blood thinners hadn’t.

Since its initial popularity, however, public opinion on the drug has shifted substantially, and over 3,400 lawsuits have been filed against its manufacturers, Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson). Plaintiffs filing these lawsuits are from across the U.S., and all commonly claim that the anticoagulant poses substantial health risks to users; specifically sudden dangerous bleeding episodes.

The lawsuits filed against Bayer and Janssen concerning Xarelto have been consolidated to form two major litigation groups. In New Orleans, the U.S. Judicial Panel on Multidistrict Litigation transferred federally-filed Xarelto cases to a single Eastern Louisiana Court. The consolidation formed MDL No. 2592 and grouped all federally-filed cases to be overseen by Judge Eldon Fallon. These cases number more than 2,800 currently, and are additionally joined by over 600 others which were consolidated by the Court of Common Pleas in Philadelphia, Pennsylvania to form a mass tort group.

Xarelto has been the subject of additional controversy recently as the European Regulators announced that they would be investigating the clinical trials on the drug, and data provided to prestigious medical journals after those trials (or lack thereof), which could have led to a premature FDA approval for the drug.

As these investigations look for further answers, Attorney Joseph Osborne is working to help ensure that everyone who used the drug and suffered from health complications that they attribute to it will be provided the important opportunity of fully exploring their legal rights. These patients could be entitled to significant compensation, and are likely still able to join the current litigation groups. To assist those looking to pursue justice, Attorney Osborne is now offering complimentary legal consultations for affected parties.

  6. Xarelto Lawsuit Plaintiffs Note Reports That Duke Researchers Omitted Important Drug Data To NEJM

    Mar 15, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on recently emerging news that Duke researchers have failed to provide all Xarelto data for publishing to the New England Journal of Medicine. Because of this discovery, Xarelto manufacturers Bayer AG and Johnson & Johnson subsidiary Janssen Pharmaceuticals have been accused of intentionally deceiving the prestigious medical journal, whose assessment likely led to determining the drug’s safety for FDA approval and public consumption.

According to a recent article in Business Insider, Xarelto has now gone on to be the topic of more than 5,000 lawsuits and 500 allegations of patient death. These concerning numbers have left consumers and lawsuit plaintiffs questioning whether the omitted research data would have made a difference in these devastating outcomes. The data which is currently being discussed was part of a 3-year long clinical trial conducted on blood-thinning drug Xarelto.

Xarelto manufacturers hired Duke researchers to run this trial, which is now being investigated and thoroughly questioned. According to a legal briefing recently filed, lawyers allege that the companies involved purposefully remained silent after noticing Duke’s omitted data surrounding a recalled blood-testing device which was used. These attorneys state that in doing so, the companies misled the New England Journal of Medicine and therefore its many readers. In addition, it has been alleged that the manufacturers then remained silent as this incomplete drug information was sent to all regulators across the U.S. and in Europe.

Details of the investigation show that Xarelto trials began in 2006 when the chief of the FDA at the time worked as the co-director of the trial, which was named “Rocket AF”. The clinical trial reportedly reviewed 14,000 patients during a 3 year period of time, and was focused on comparing the blood-thinning effects of new-generation drug rivaroxaban (Xarelto) to more traditional blood thinner warfarin. Many question the presence of a defective testing device during these trials, which could have swayed the data results to the benefit of Xarelto. Additionally, researchers have indicated that patients involved were likely given the wrong dosage size of warfarin due to the malfunctioning testing device, therefore making Xarelto appear more effective.

There are many other factors emerging as this clinical testing and data collecting process is being investigated, and the controversy surrounding it continues to surge. In the meantime, plaintiffs involved in lawsuits against Xarelto are looking forward to bellwether trial dates currently set for early 2017.

As these plaintiffs await trial, many expect that lawsuit numbers will continue to grow. Attorney Joseph Osborne is working to ensure that anyone who has used Xarelto and has suffered from health problems that they attribute to the drug will be given the important opportunity to evaluate their legal rights in full. These patients may be entitled to legal action and substantial compensation. To help those deserving of pursuing justice, Attorney Osborne is offering complimentary Xarelto consultations at this time for affected individuals.

To request more Xarelto lawsuit information, or to ask questions, please contact Joseph Osborne, Esq. by calling (866) 425-8902.

  7. Xarelto Lawsuit Plaintiffs Note New York Times Discussion Of Controversial Xarelto Clinical Trials

    Mar 16, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on a recent New York Times article which indicates that the U.S. Food and Drug Administration (FDA) is now investigating whether a recalled testing device may have affected clinical trial results leading to the approval of Xarelto for the market.

Within the last 5 years since its initial release to market, Xarelto has become the subject of more than 3,400 lawsuits-- 2,800 of which were filed in federal court and consolidated in Eastern Louisiana by the U.S. Judicial Panel on Multidistrict Litigation, and more than 600 of which were consolidated to form a mass tort group in Philadelphia by the Court of Common Pleas. All of the many plaintiffs involved in these lawsuits share strikingly similar allegations which indicate that Xarelto causes increased risk of severe and even fatal bleeding episodes among patients using it. All complaints have been filed against Xarelto manufacturers Bayer AG and Janssen Pharmaceuticals, a subdivision of Johnson & Johnson corporation.

According to details released by the recent New York Times article, the FDA has begun to ask Johnson & Johnson, “...detailed questions about whether there was evidence that the device was malfunctioning while the trial was underway, according to a legal brief filed in federal court on Monday by lawyers for patients and their families who say they were injured by the drug. The lawyers also cited internal company documents that they said showed doctors were complaining to the trial leadership during the course of the study.”

Public controversy and mounting questions over the accuracy of the clinical trial study have been steadily increasing since last fall when Johnson & Johnson and Bayer reportedly, “...notified regulators that the device that was used in the trial had been recalled in 2014 because it was understating patients’ risk of bleeding.”

The New York Times has stated that, “Regulators are looking at whether the malfunctioning device might have led doctors to give patients the wrong dose of warfarin, which could have led to additional bleeding episodes and given an unfair advantage to Xarelto.”

Xarelto was a controversial drug before these new findings; now, however, more than ever, plaintiffs involved in lawsuits surrounding the drug are pushing for justice. The FDA has also given the drug two ‘black box’ warnings, which are the most strict warning a product can be given before it is fully removed from the market. There has been no new news regarding the FDA and European regulators’ investigations at this time, and many are anxiously awaiting updates as lawsuit numbers continue to grow.

Attorney Joseph Osborne is currently working to assist anyone who used Xarelto and has suffered from health complications that they attribute to the drug. He is looking to help ensure that all affected individuals will be provided the important opportunity to explore their legal rights fully. Those affected may be entitled to legal action and significant compensation. In an effort to help those deserving of justice, Attorney Osborne is offering free Xarelto consultations for affected parties at this time.

  8. Xarelto Lawsuit Plaintiffs Gain Supporting Evidence From Studies Linking Drug To Sudden Bleeds

    Mar 16, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerhelp.com reports on information released in 2015 Xarelto studies which seems to lend support to the arguments of current plaintiffs who have filed lawsuits regarding the possible dangers of the drug against manufacturers Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson corporation). The results of the studies now being discussed show a possible increased risk of the occurrence of stomach and eye bleeds for patients using the anticoagulant, especially after they transfer from using a traditional blood thinner and begin to use new-generation blood thinner Xarelto.

The first Xarelto-related study was published in BMJ’s April 2015 issue and showed that researchers had noted that they were unable to rule out a twofold increased risk of the occurrence of stomach bleeds among patients using Xarelto when compared with those taking warfarin. To arrive at this conclusion, the study reviewed the medical history of almost 46,000 blood thinner patients.

The second study was conducted by Doctors John C. Hwang and Judy H. Hun, who noticed that patients within their own practice were suffering from sudden bleeding episodes, and decided to investigate. The results of their analysis showed that patients between the age of 70 and their late 80’s who had transferred from taking warfarin to Xarelto were more likely to suffer from sudden eye bleeds, specifically vitreous hemorrhages which occur between the lens and retina of the eye.

Their studies also indicated that as patients began to wean off of warfarin, and gradually transfer to using only Xarelto, the bleeds would most commonly occur. The doctors reported their study findings to JAMA Ophthalmologywho published the complete results in their June 2015 issue.

The doctors stated, “In all cases, an acute vitreous hemorrhage occurred shortly after rivaroxaban (Xarelto) treatment was initiated.”

Both of these studies seem to lend support to federal lawsuit claims which have been filed by more than 2,800 plaintiffs, all who similarly allege that Xarelto can cause sudden and dangerous uncontrollable bleeding episodes among patients. Federally-filed lawsuits have been consolidated by the U.S. JPML to form MDL No. 2592 and are being overseen in Eastern Louisiana by Judge Eldon Fallon. They are also joined by more than 600 other lawsuits filed against the same defendants which were formed into a mass tort group in Philadelphia, Pennsylvania by the Court of Common Pleas.

Currently, Attorney Joseph Osborne is working to help ensure that anyone who has used Xarelto and has suffered from health problems that they believe were caused by the drug will be given the important opportunity to explore their legal rights in full. These patients may be entitled to legal action and significant compensation. To better assist those deserving of justice, Attorney Osborne is now offering complimentary Xarelto consultations.

  9. Xarelto Lawsuit Drug Controversies Draw Public Discussion Over Alternative Therapeutic Treatment Options

    Mar 17, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on the ever-increasing number of Xarelto lawsuits being filed across the United States. Xarelto is a new-generation blood-thinning drug manufactured by Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson corporation). The drug was approved by the U.S. Food and Drug Administration in 2011 and was released for public sale. Since its initial booming popularity, however, the drug has become widely considered dangerous, and many patients, who have now stepped forward to file lawsuits concerning the drug, allege that it can cause sudden and severe bleeding episodes. Many current plaintiffs additionally state that Xarelto manufacturers used misleading marketing tactics to sell the anticoagulant.

Xarelto has recently become the subject of even more controversy as investigations have begun researching its initial FDA-approval process to determine whether important data from clinical studies was left out of information sent to prestigious medical journals.

Plaintiffs have been watching the news for updates for some time, and, according to a recent article from SBWire, so has Greg Grambor, the president of Vascular PRN. Vascular PRN is a company that offers patients at increased risk for blood clots an alternative prevention method to drugs like Xarelto. The company distributes pneumatic compression devices. It is the hope of Grambor and his company that additional controversies surrounding blood thinner Xarelto will bring the medical focus back to blood clot therapies, which offer protection without the complication risk.

Grambor commented on this possibility, stating, “In cases where embolism prevention is the primary concern, pneumatic compression is a terrific alternative or supplemental therapy to warfarin and Xarelto.” He continued by noting, “It uses alternating compression to enhance blood flow and prevent clotting in the limbs of immobilized patients, such as those recovering from surgery, or sedentary patients such as those in nursing homes.”

Xarelto is the topic of more than 3,000 lawsuits today. 2,800 of these federally-filed lawsuits have been consolidated to form MDL 2592 by the U.S. Judicial Panel on Multidistrict Litigation in Eastern Louisiana. Another group of more than 600 lawsuits has also been formed to make a mass tort by the Court of Common Pleas in Philadelphia, Pennsylvania. Those involved in the current litigation expect to see these compliant numbers continue to grow, as they did in similar Pradaxa lawsuits.

Given these facts, and new scrutiny surrounding a potentially recalled medical device used during clinical trials on Xarelto which may have given the drug the upper hand, it is likely that public concern may draw people to consider alternate therapies through devices like those that Vascular PRN distributes.

As the public awaits more information pending the completion of additional Xarelto investigations, Attorney Joseph Osborne is working to help ensure that anyone who has used Xarelto and who has suffered from health problems that they attribute to their use of the drug will be provided with the important opportunity to evaluate their legal rights in full. These patients may be entitled to substantial compensation through legal action. To help those wishing to pursue justice, Attorney Osborne is currently offering free Xarelto consultations for affected parties.

  10. Xarelto Lawsuit Plaintiff Alleges Anticoagulant Caused Georgia Mans Death From Internal Bleed

    Mar 18, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on a lawsuit which now joins with more than 2,800 cases federally-filed and consolidated in the Xarelto multidistrict litigation (MDL No.2592). The case was filed on March 20, 2015, in the Eastern District of Louisiana under complaint number 2:15-cv-00885. It was filed on behalf of a father from Georgia by his son, due to the fact that the father has passed away. Details found within the son’s lawsuit show that he alleges that his father died from an uncontrollable internal bleeding episode which was caused by his use of blood-thinning drug Xarelto. The lawsuit names the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson), as defendants.

Further details from the complaint show that the father was prescribed Xarelto by a physician to help reduce stroke risks present due to his atrial fibrillation condition. The plaintiff states that neither he nor his father had been made aware of the potentially serious bleeding dangers linked to Xarelto use; specifically surrounding the fact that, at the time, Xarelto had no corresponding antidote for patients in emergency bleeding situations. The son indicates that if they had known this information, they would have chosen a safer alternative drug for the father.

Xarelto has become quickly regarded by many as the most dangerous blood thinner currently on the market. It has also been given two “black box” warnings by the U.S. Food and Drug Administration. These warnings are the most strict product warnings possible to be given by the FDA before removing the product in question from the market entirely. Xarelto is not only the subject of over 2,800 lawsuits in the current MDL, it is also the topic of more than 600 lawsuits which have been formed into a mass tort group by the Court of Common Pleas in Philadelphia, Pennsylvania.

Attorney Joseph Osborne is working to ensure that anyone who has used Xarelto and who has also suffered from serious health problems that they attribute to their use of the drug will be given the important opportunity to evaluate their legal rights in full. These patients could be entitled to legal action and substantial compensation. To help those deserving pursue justice, Attorney Osborne is offering complimentary legal consultations for involved parties at this time.

  11. Plaintiff Files Xarelto Lawsuit Claiming Blood Thinner Caused Husband’s Death Via Fatal Bleed

    Mar 18, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on another lawsuit filed against Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson). The plaintiff filing the suit is a south Florida resident, and is filing on behalf of her deceased husband whom she alleges passed away due to bleeding complications which arose from his use of the anticoagulant drug Xarelto. The wife claims the manufacturers Bayer and Janssen neglected their duty to adequately warn consumers of the potentially dangerous bleeding risks she associates with their product.

The widow’s lawsuit has been filed under case number 9:14-cv-80831 in Florida but, during the U.S. JPML’s consolidation of all federally-filed Xarelto lawsuits, it was transferred to the Eastern District of Louisiana. Today, it joins with more than 2,800 other similar lawsuits to become a part of MDL No. 2592. The MDL is being overseen by the Honorable Judge Eldon Fallon.

Details of this particular lawsuit show that the plaintiff claims the defendants are to blame for the death of her husband. Within her court documents, the widow indicates that his death was caused by a sudden and fatal episode of uncontrollable internal bleeding. He suffered from this hemorrhaging while using Xarelto, which made it impossible for doctors to clot his blood. The man ultimately passed away from a subdural hemorrhage. According to the plaintiff, her husband was taking Xarelto to treat his atrial fibrillation condition.

Xarelto has now become the topic of over 2,800 federally-filed lawsuits from across the United States, in addition, there are more than 600 cases which were formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania. Xarelto has also been the recipient of two “black-box” warnings from the FDA. These warnings are the most strict warnings possible to be given before a product is fully removed from the market.

As many plaintiffs like this widow await their day in court, Attorney Joseph Osborne is working to assist anyone who used Xarelto and who believes they have been negatively affected by the drug. He wants to ensure that these people will be given the important opportunity to investigate their legal rights in full. Affected patients could be entitled to significant compensation through legal action. To better assist those seeking justice, Attorney Osborne is currently offering free legal consultations for qualified parties.

  12. Xarelto Lawsuit Plaintiffs Claim Anticoagulant Caused Family Members Bleeding Deaths

    Mar 18, 2016 | Bloodthinnerhelp.com

    By Joseph Osborne

BloodThinnerHelp.com reports on a lawsuit which has been filed against Xarelto manufacturers Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson corporation). A group of 10 plaintiffs from several states have united to file a complaint due to their similar allegations that blood-thinning drug Xarelto has caused their family members dangerous and fatal health problems.

The plaintiffs are comprised of a group of family members who are standing in as representatives for loved ones who have died due to medical complications while using Xarelto. The lawsuits were filed together under case number 15-L-670 in a St. Clair County Circuit Court on November 20, 2015.

Details of the complaint indicate that plaintiffs reported in June of 2013, that the defendants received a letter from the U.S. Food and Drug Administration (FDA) asking them to change their advertising campaigns noting that their current claims were misleading, and left out important warning information.

Xarelto was the recipient of two “black box” warnings from the U.S. Food and Drug Administration. These “black box” warnings are the most strict warnings the FDA can attach to a product before completely pulling it off the market. Across the country as well, Xarelto lawsuits from various plaintiffs have now surpassed 3,300 in number. Over 2,800 of these cases have been consolidated to form multidistrict litigation in Eastern Louisiana, while more than 600 cases now make up a mass tort group in Philadelphia, Pennsylvania.

The charges noted in this particular lawsuit are filed against nine total defendants including the product’s manufacturers and name wrongful death, strict product liability, negligent misrepresentation, and fraud. The 10 involved plaintiffs are requesting a minimum compensation of $50,000 for each of their deceased family members, in addition to money for their legal fees.

Because Xarelto lawsuits continue to be filed, Attorney Joseph Osborne is working to help ensure that everyone who may have taken the anticoagulant and who suffered from health problems that they believe were caused by the drug will be given the opportunity to fully evaluate their legal options. These patients may be entitled to substantial compensation gained through legal action. To help those deserving of justice in the matter, Attorney Osborne is offering free Xarelto consultations for affected parties at this time.

  14. Document Claims Drug Makers Deceived a Top Medical Journal

    Mar 14, 2016 | US Recall News

On March 1, 2016, The New York Times put out an article questioning whether or not two major pharmaceutical companies deceived a top medical journal in order to protect their drug.

The two companies, Johnson & Johnson and Bayer, are said to have misled editors at The New England Journal of Medicine in regards to their anticlotting drug, Xarelto. The claim that was filed in a New Orleans federal court stated that the published letter in the journal, written by researchers at Duke University, had left out critical lab data.

Xarelto, a best selling drug in a new category of drugs which seek to replace the blood thinner Warfarin, is considered to be a best selling drug with nearly $2 billion in sales last year in the United States.

Lawyers in the case have asked for documents associated with more than 5,000 lawsuits filed by patients and their loved ones after being harmed by Xarelto to be unsealed. Of those lawsuits, 500 cases involved death of the patient.

The two companies in question had hired the Duke Clinical Research Institute to run a three-year clinical trial, leading to the approval of Xarelto by regulators. However, since September, the results of the clinical trial have come under scrutiny after the companies’ notified regulators about the malfunction of a blood-testing device during the study.

The trial compared the number of bleeding events and strokes that were experienced by patients taking Xarelto to those using Warfarin. The concern lies in the possibility that the faulty results may have led doctors to give patients the wrong dose of Warfarin, which may have favored Xarelto.

According to The Times, Duke researchers “published an analysis” in The New England Journal of Medicine concluding that the results of the trial were not impacted by the malfunctioning device in question.

  15. Woman Blames Xarelto for Bleeding Issue

    Mar 14, 2016 | Meyerkord & Meyerkord LLC

A Texas woman has filed a lawsuit against the manufacturers of Xarelto claiming she suffered a bleeding injury due to the side effects related to the drug. The woman suffered from atrial fibrillation and was prescribed Xarelto by her doctor to treat it. Tragically, the woman’s life was at risk just five months after being prescribed the drug due to an uncontrollable bleeding episode. Her lawsuit is now one of the thousands of plaintiffs that are seeking compensation for their damages claiming Bayer and Johnson & Johnson, Xarelto’s manufacturers, of negligence.

Xarelto, an anticoagulant, was approved by the U.S. Food and Drug Administration in 2011 and is now the center of a mass torts lawsuit. While Bayer and J & J has spent millions of dollars to promote their drug as being the best choice for those requiring a blood thinner, they are being accused of failing to properly warn users of the drug’s risks. Xarelto appears to be more convenient than other blood thinners, such as Warfarin, due to the lack of lifestyle alterations. Warfarin users must follow a restricted diet and undergo regular blood testing. Xarelto users are not required to do either. However, Warfarin users that experience an injury that results in bleeding can be administered Vitamin K as an antidote to control and stop the bleeding. Xarelto does not offer an antidote resulting in uncontrollable bleeding injuries and death for many of its’ users. Plaintiffs are outraged that they were not informed of the lack of antidote by Xarelto’s manufacturers.

The drug liability attorneys at Meyerkord & Meyerkord, LLC will investigate your case to properly plan and execute a strategy for success. We will fight aggressively to hold any drug company responsible for their negligence and will fight to recover the compensation you deserve. 16. 40 Xarelto Bellwether Cases to be Selected, Says Judge

    Mar 15, 2016 | The Legal Examiner

    By M. Brandon Smith

According to a case management order issued by U.S. District Judge Eldon Fallon, 40 cases will be chosen for the Xarelto bellwether pool, with each side selecting 10 cases and an additional 20 chosen randomly.

    According to Judge Fallon’s plan:

Half of the cases will have originated in the Eastern District of Louisiana

Seven from any states chosen by the plaintiffs

Seven from any states chosen by the defendants

    Four from Mississippi federal court

    Two from Texas federal court

    Xarelto Bellwether Trials

The only criteria for the selection of the seven cases by the plaintiff and the defendant is that each must have at least 20 eligible cases pending in the litigation. The parties have also been ordered to create a selection plan for the four cases that will be the first to go to trial. The first trial dates are expected to be between February and May 2017.

The Xarelto cases were consolidated into a multidistrict litigation (MDL) in December 2014, in an effort to combine resources to gather the facts and present them to a handful of juries in what are known as bellwether trials. Bellwether trials help to determine how juries may react to the evidence presented and can set the stage for future negotiations, potential settlements, and a quicker resolution of the litigation.

    What is Xarelto?

Xarelto is an anticoagulant that is used to prevent blood clots from forming due to an irregular heartbeat, after hip or knee replacement surgery, and to treat deep vein thrombosis and to prevent clots from forming again. Doctors have been searching for many years for an anticoagulant that didn’t require the stringent scrutinizing that warfarin does, and thought Xarelto might be the answer, until it was discovered that the blood thinner had become associated with numerous severe bleeding events, and as of yet, there is no effective antidote for Xarelto.

  17. Xarelto Lawsuits Expand As More Plaintiffs Join

    Mar 15, 2016 | Personal Injury Bureau

More plaintiffs across the country are joining class action lawsuits associated with the anticoagulant drug Xarelto. Federally-filed Xarelto lawsuits have been consolidated on Multidistrict Litigation to form MDL No. 2592, which now includes more than 2,800 cases. More than 600 other Xarelto lawsuits have been consolidated into a mass tort group in Philadelphia, Pennsylvania by the Court of Common Pleas.

The lawsuits are filed against pharmaceutical manufacturer Janssen Pharmaceuticals (a subdivision of the Johnson & Johnson corporation) and Bayer Healthcare. The plaintiffs allege that the defendants failed to properly warn consumers about the dangerous side effects that have been linked to their blood thinning drug. The plaintiffs involved in the lawsuits are seeking monetary damages and the payment of their legal fees.

People from across the United States allege that that the drug puts patients at increased risk for dangerous bleeding episodes or that Xarelto use has caused them severe and persistent health problems. Some have joined the lawsuits on behalf of loved ones who have passed away from severe hemorrhages or bleeding events after taking Xarelto.

Recent reports in the media may help their case. It has now been alleged that all of the data from Xarelto testing conducted by Duke researchers was not provided to the New England Journal of Medicine. Duke researchers were paid by Xarelto manufacturers to run the trial. Some are suspicious that the manufacturers were trying to intentionally deceive the medical journal with the omissions.

The data was part of a 3-year long clinical trial comparing the effects of Xarelto with those of traditional blood thinner warfarin. The study involved 14,000 patients. According to the report, Duke omitted data surrounding a recalled blood-testing device which was used. Researchers have indicated that it was likely that study patients were given the wrong dosage size of warfarin due to the malfunctioning testing device. Under the conditions of the study, that factor could make Xarelto appear more effective than it really was.

Lawyers allege that the companies involved purposefully remained silent after noticing the issue, intentionally misleading the New England Journal of Medicine and its many readers. This would be a serious matter because the assessment in the medical journal likely led to determining the drug’s safety for FDA approval and public consumption. This incomplete drug information was then sent to regulators across the nation and in Europe. The revelation has led to questions about whether providing the omitted information would have resulted in different usage guidelines or reduced the number of adverse incidents related to the drug.
