BloodThinnerHelp.com reports on another lawsuit which has been filed against the manufacturers of anticoagulant drug Xarelto, Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson corporation). The plaintiff filing the complaint claims that the defendants failed to properly warn consumers of a potentially heightened risk of sudden bleeding episodes linked to their drug, and also that the studies conducted on the blood thinner which both medical journals and advertisements depended upon were not reliable and were improperly managed. The lawsuit concerning these matters was filed in Eastern Louisiana under case number 2:15-cv-04273.
Just 5 years ago, in 2011, Xarelto gained approval by the U.S. Food and Drug Administration and was released to market for public use. It was initially very popular, as it was a new-generation “revolutionary” blood thinner that could provide users with freedoms that other blood thinners had been unable to. It also required just one dose a day in the form of a one-size-fits-all pill, which today has been questioned by some. Today, however, the drug is surrounded by more than 3,400 lawsuits alleging its dangers. More than 2,800 of these federally-filed lawsuits have been consolidated and transferred to Eastern Louisiana to form MDL number 2592. In addition, over 620 other Xarelto lawsuits have been consolidated in Philadelphia, Pennsylvania by the Court of Common Pleas to form a mass tort program.
Despite the fact that thousands of plaintiffs have filed suit against the drug, their claims are concerningly similar. They commonly allege that the drug puts users at increased risk for a variety of serious and damaging bleeding episodes, some of which, the plaintiffs claim, have proven fatal for loved ones.
Patients are often prescribed Xarelto to treat atrial fibrillation, pulmonary embolism, or deep vein thrombosis. In addition, the anticoagulant drug can be used by those who have undergone recent hip or knee replacement surgeries, and may be at increased risk for the development of blood clots or strokes.
Further details of this particular complaint show that the plaintiff accuses the defendants of using misleading marketing tactics to sell their drug, which do not adequately address serious risks. He says that this conceals, according to the lawsuit, the significant dangers the drug poses, including fatal bleeding out. In this complaint, the plaintiff also highlights the fact that throughout the United States and Germany, there have been thousands of reports of adverse events experienced by patients using Xarelto.
Attorney Joseph Osborne understands the concern these lawsuit allegations may cause for patients currently using Xarelto. He is working to help others who have taken the blood thinner and who believe that it has caused them health problems. He wishes to ensure that affected individuals will be given the opportunity to explore their legal rights in the matter. These patients could be entitled to substantial compensation attained through legal action. Nebraska Xarelto Lawsuit Plaintiffs Allege Drug Caused Serious And Lasting Complications

BloodThinnerHelp.com reports on a lawsuit filed against Janssen Pharmaceuticals, (a subdivision of Johnson & Johnson corporation, and the manufacturer of new-generation blood thinner Xarelto). Plaintiffs filing this complaint are a couple from Nebraska who claim that Janssen has produced a dangerous drug which caused the husband to suffer from serious and lasting health complications including a significant bleeding event and decreased life expectancy. Their lawsuit was filed under case number 2:15-cv-06514 in the Eastern District of Louisiana.
Lawsuit details indicate that the husband used Xarelto from May until December of 2013, after receiving a prescription for the anticoagulant from his physician. When he suddenly experienced a serious gastrointestinal bleed, however, he stopped taking the drug.
Unfortunately, these plaintiffs are far from alone in their claims. Since its 2011 debut after gaining approval from the U.S. FDA, Xarelto has become the subject of over 3,400 lawsuits filed by plaintiffs from across the country who share strikingly similar allegations. The plaintiffs allege that the blood thinner places those using it at elevated risk for spontaneous, dangerous bleeding events.
Of the thousands of Xarelto lawsuits filed, those filed federally have been consolidated and transferred to form MDL No. 2592 in Eastern Louisiana by the U.S. Judicial Panel on Multidistrict Litigation. This grouping is reported to contain over 2,800 cases today. In addition, another group of more than 620 Xarelto lawsuits has been consolidated to form a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania. Both of these groups are expected to see continued growth in lawsuit filings as time progresses.
Further details concerning this particular lawsuit indicate that the plaintiffs are requesting compensatory and punitive damages in addition to financing to assist with legal fees. While the many Xarelto lawsuit plaintiffs await bellwether trial dates set for early 2017, Attorney Joseph Osborne is working help assist others who believe that they were negatively affected by taking Xarelto. He wants to ensure that affected patients will be given the opportunity to explore their legal rights in the matter. BloodThinnerHelp.com reports on a recent article in Business Insider which talks about Xarelto bleeding lawsuits and current controversies surrounding Xarelto manufacturers Bayer AG and Johnson & Johnson division Janssen Pharmaceuticals. The publication indicates that recent public controversy arose concerning the drug after a document was released which claimed that the manufacturers may have misled a prestigious medical journal by intentionally neglecting to mention critical pieces of data collected during testing on Xarelto.
Xarelto was approved by the FDA five years ago in 2011, and released to market for public use. It is a new-generation blood-thinning drug which was approved to treat patients who are recovering from hip or knee replacement surgeries, those suffering from deep vein thrombosis (DVT) or pulmonary embolism, and those at increased risk of stroke due to atrial fibrillation. The drug is designed to thin the blood and prevent the development of blood clots and strokes among patients.
Xarelto has done well since its initial launch, and many consumers first regarded the drug as revolutionary, as it allowed users freedoms that traditional blood thinners had not. According to the Business Insider article, in 2015, Xarelto made an estimated $1.8 billion in sales across the United States. In more recent years, however, the drug has also become the subject of an increasing number of lawsuits, which, according to Business Insider, currently number over 5,000, with 500 of these 5,000 lawsuits alleging patient fatalities.
The Business Insider article also goes on to delve further into current controversies, noting that, “The New York Times’ Katie Thomas found in a footnote in a federal legal briefing that there might be some evidence that the drug’s developers, Johnson & Johnson and Bayer, may have left out some critical data when a peer reviewer (a researcher who is independent of the study who goes through and vets the findings) at the New England Journal of Medicine asked for it.”
These controversies follow additional public concerns surrounding a clinical trial conducted on Xarelto, and the accuracy of the trial’s results after it had been indicated that a recalled medical device may have been used during the trial, and that results could have been altered in favor of the anticoagulant drug.
As controversies continue to mount and plaintiffs and the general public await answers, it has been reported that both the U.S. Food and Drug Administration (FDA) and the European Medicine Agency have begun to investigate these issues, and are now looking into whether the recalled blood-testing device potentially used during clinical trials could have led to Xarelto’s premature FDA approval.
As others await the results of these investigations, Attorney Joseph Osborne is working to help others who have taken Xarelto and who have suffered from adverse health events that they believe were caused by the anticoagulant drug. Those affected may be entitled to substantial compensation attained through legal action. To help those deserving investigate pursuing justice, Attorney Osborne is now offering complimentary legal consultations for affected individuals.

BloodThinnerHelp.com reports on bellwether trial preparations which have been steadily taking place for the more than 2,800 plaintiffs who have federally-filed Xarelto lawsuits. The lawsuits were transferred and consolidated in a move by the U.S. Judicial Panel on Multidistrict Litigation, forming MDL No. 2592. This consolidation decision was made due to the fact that the lawsuit plaintiffs share strikingly similar claims and name the same defendants: Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson corporation). Plaintiffs allege that Xarelto use places patients at increased risk for spontaneous and dangerous bleeding events, which can prove fatal. Lawsuit numbers continue to increase as the preparations are underway for the hearing of early 2017 bellwether trials. MDL lawsuits are centralized in Eastern Louisiana and are being overseen by the Honorable Judge Eldon Fallon.
According to a court order provided by Judge Fallon on December 17, 2015, the detailed and lengthy process of selecting 40 lawsuits from those in the MDL has now taken place. The 40 cases which were selected will form a bellwether pool, from which just 4 cases will be selected . These cases will go on to be heard in bellwether trials. Bellwether trials are designed to provide involved parties with a more clear concept of how juries may respond to certain pieces of evidence and testimony in the future.
Judge Fallon also required that selected lawsuit complaints, (which were to be chosen equally from both plaintiffs and defendants) were to involve reported victims from several different categories: Xarelto users who allege that they have suffered from gastrointestinal bleeding, brain hemorrhaging, or rectal bleeding while taking the drug to prevent the occurrence of strokes, as well as patients who used Xarelto and allege that they have suffered from gastrointestinal bleeding, brain hemorrhaging, or rectal bleeding while they were attempting to treat deep vein thrombosis (DVT) or pulmonary embolism.
It has been reported that Xarelto lawsuits have grown to number in the thousands, and are anticipated to continue to grow as time progresses. As bellwether trials approach, Attorney Osborne is working to assist others who have taken Xarelto and who have experienced adverse health events that they believe were caused by Xarelto. Xarelto Lawsuit Plaintiff Claims Blood-Thinning Drug Caused Her Dangerous Internal Bleeding Episode
Apr 13, 2016 | Bloodthinnerhelp.com
By Joseph Osborne
BloodThinnerHelp.com reports on details of a Xarelto lawsuit filed by a plaintiff from Texas which claims that the blood-thinning drug’s manufacturers, Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson corporation) neglected to adequately warn her of the dangers of their product. The plaintiff initially filed her complaint in a federal court in the Eastern District of New York under case number 1:14-cv-04524, but the case was later transferred with others from across the nation to be centralized in a single court in Eastern Louisiana and to form MDL number 2592.
Further lawsuit details indicate that the plaintiff claims she was prescribed Xarelto by her physician to treat her atrial fibrillation, which is a fairly common heart condition that can put patients at heightened risk for the occurrence of strokes. The plaintiff states that she had taken the anticoagulant for just 5 month’s time when she suddenly suffered from a life-threatening internal bleeding event. She says that this internal bleed left her with long-term health complications which will require specialized medical care and will cost a significant amount of money.
After just 5 years on the market following its 2011 FDA approval, Xarelto has become the topic of increasing controversy. The FDA itself has given the product two “black box” warnings, which are the most strict warnings a product can be given before being fully pulled from the market. In addition, the anticoagulant drug has become the subject of over 3,400 lawsuit filings. More than 2,800 of these lawsuits have been transferred and consolidated by the U.S. Judicial Panel on Multidistrict Litigation to form MDL No. 2592 in Eastern Louisiana. In addition, however, more than 620 other Xarelto-related lawsuits have been formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania.
Attorney Joseph Osborne knows well how concerning these side effect allegations could be to patients currently taking Xarelto. Affected parties could be entitled to substantial compensation. Attorney Osborne believes that everyone affected deserves to be given the important opportunity of exploring their legal rights in the matter. BloodThinnerHelp.com reports on another notable lawsuit which was filed against Xarelto manufacturers Bayer AG and Janssen Pharmaceuticals (a subdivision of pharmaceutical giant Johnson & Johnson). This lawsuit is especially notable as a group of 10 plaintiffs from several different states have come together to jointly file a lawsuit due to striking similarities in their allegations involving anticoagulant drug Xarelto, which they claim has caused the death of their family members.
The plaintiffs filing are made up of a group of family members who are now representatives for loved ones that have passed away because of severe medical problems they suffered while taking Xarelto. The lawsuits were jointly filed on November 20, 2015, under case number 15-L-670 in a St. Clair County Circuit Court. Further lawsuit details show that plaintiffs reported in June of 2013, the defendants were in receipt of a letter from the U.S. Food and Drug Administration (FDA) which asked them to change their advertising tactics and indicated that their current claims were potentially misleading.
Since its 2011 approval by the U.S. Food and Drug Administration, Xarelto has also become the recipient of two “black box” warnings from the agency. These “black box” warnings are the most severe product warnings the FDA is able to give a product before fully pulling it off the market. In addition, Xarelto lawsuits have surged from across the country, surpassing 3,400 in number. These cases have been formed into two major groupings. More than 2,800 of the lawsuits have been consolidated to form multidistrict litigation number 2592 in Eastern Louisiana, while over 620 cases have been formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania.
The charges discussed within this lawsuit are also notable as they have been filed not just against the drug’s manufacturers, but against nine defendants in total, claiming wrongful death, strict product liability, negligent misrepresentation, and fraud, among other charges. Each of the 10 plaintiffs involved has requested a minimum of $50,000 compensation to cover medical, funeral, and legal fees for each of their deceased family members.
While Xarelto lawsuits continue to be filed and plaintiffs involved in MDL 2592 anxiously await 2017 bellwether trials, Attorney Joseph Osborne is working to assist others who have used Xarelto and who have suffered from health complications that they believe were caused by the drug. He wants to ensure that these deserving individuals will be given the important opportunity to evaluate their legal options in the matter. BloodThinnerHelp.com reports on yet another lawsuit which has been filed against Xarelto manufacturers Janssen Pharmaceuticals (a division of Johnson & Johnson corporation) and Bayer Healthcare in regards to the new-generation blood thinner. The complaint is just one of over 2,800 federally-filed cases from across the nation which have been transferred and consolidated by the U.S. Judicial Panel on Multidistrict Litigation, forming MDL No. 2592. The plaintiffs involved in the MDL share strikingly similar allegations that Xarelto use by patients can place them at increased risk for the development of dangerous bleeding episodes which could result in long-term injury or death.
This case is particularly notable as it involves the unfortunate death of a patient. The plaintiff involved is a daughter who filed suit on behalf of her deceased father. Her case was first filed in a Vermont federal court under number 2:14-cv-00159-cr. Details found within the court documentation indicate that the woman’s father died after suffering from an unexpected parenchymal hemorrhage (or brain bleed) which the family alleges was caused by his use of Xarelto.
Since its launch in 2011 after FDA-approval, Xarelto has quickly become the topic of over 3,400 lawsuits: more than 2,800 which have been consolidated in the Eastern Louisiana MDL and another 620 or more Xarelto lawsuits which have been formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania. Cases which are in the Louisiana MDL have steadily progressed toward trial dates, and reportedly recently underwent bellwether trial preparations. They await bellwether trials, currently scheduled to be heard in early 2017.

Xarelto Lawsuit Filings Reported To Number Nearly 3,500 In Just Five Years Time
Apr 13, 2016 | Bloodthinnerhelp.com
By Joseph Osborne
BloodThinnerHelp.com reports on the continually increasing number of Xarelto lawsuit filings which has reportedly surpassed 3,400 since the drug was approved and sent to market in 2011. Since this approval by the U.S. Food and Drug Administration, the agency has given the drug two “black box” warnings, which are the most strict product warnings possible before a drug is completely pulled from the market for public use. New controversies surrounding the drug have brought to light allegations in recent plaintiff lawsuits, as well as controversies highlighted in the New York Times, and investigations taking place by the FDA and European Medicines Agency.
Xarelto was regarded as a revolutionary new-generation blood thinner when it launched onto the market. The drug could provide users with more freedoms than traditional blood thinners had in the past, as it required no special diets, regular physician monitoring, or dosage adjustments. The anticoagulant was FDA approved for treating patients who are recovering from hip or knee replacement surgeries as well as those with deep vein thrombosis, pulmonary embolism, or atrial fibrillation.
Xarelto-related lawsuits have been filed against manufacturers Bayer AG and Janssen Pharmaceuticals. The lawsuits have been consolidated to form two large groupings. In Eastern Louisiana, the U.S. Judicial Panel on Multidistrict Litigation transferred all federally-filed Xarelto cases to form MDL No. 2592. They are being overseen by Judge Eldon Fallon and reportedly number over 2,800. In addition to these lawsuit filings, however, a group of over 620 Xarelto lawsuits has also been formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania.
As plaintiffs involved in Xarelto lawsuits await bellwether trials scheduled for early 2017, Attorney Joseph Osborne is working to help others who have taken the drug and have suffered from health problems that they believe Xarelto caused. Affected patients should be provided with the opportunity to fully explore their legal rights and may be entitled to significant compensation. In order to better assist those wanting to learn more about their rights, Attorney Osborne is offering complimentary legal consultations at this time for qualified parties.

Georgia Plaintiff Files Xarelto Lawsuit Alleging Anticoagulant Caused His Father’s Death

BloodThinnerHelp.com reports on a lawsuit filing which discusses new-generation blood thinner Xarelto. The lawsuit was filed by a son on behalf of his deceased father, and now joins more that 2,800 other federally-filed cases from plaintiffs across the United States. Due to their commonalities, federally-filed Xarelto cases were transferred and consolidated by the U.S. Judicial Panel on Multidistrict Litigation, forming MDL No. 2592 in Eastern Louisiana.
The son’s lawsuit has been filed in Eastern Louisiana under complaint number 2:15-cv-00885, and was officially filed on March 20, 2015. Details from court documents show that the son claims his father died due to an uncontrollable internal bleeding event which he says was caused by Xarelto. His lawsuit has been filed against defendants Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson), manufacturers of the blood thinner.
The son states that his father was given a prescription for Xarelto by his physician to help him prevent strokes, which he was considered to be at heightened risk for due to his atrial fibrillation condition. Atrial fibrillation is generally considered a common heart condition which can cause the heart to beat more rapidly than what is considered normal. Patients suffering from this condition often turn to blood thinners to help them avoid the risk of strokes. The plaintiff indicates that when selecting to use new-generation Xarelto as an anticoagulant, he and his father were never made aware of potentially dangerous and even fatal side effects that he has now linked to his father’s use of the drug.
Xarelto has been on the market for five year’s time now, since its 2011 FDA-approval. Since this time, the FDA has given the drug two “black box” warnings, which are the most strict warnings a product is able to receive before being completely removed from the market. Today, Xarelto is also the topic of over 3,400 lawsuits in total in the United States. 2,800 of these lawsuits were consolidated to form MDL 2592, while more than 620 others have been formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania. Those involved believe that these filing numbers will only continue to grow as plaintiffs await early 2017 bellwether trials.
In the meantime, Attorney Joseph Osborne is working to assist other patients who have used Xarelto and have suffered from health complications that they believe were caused by their use of the drug. He hopes to help ensure that affected patients will be given the opportunity to fully investigate their legal rights. Patients could be entitled to substantial compensation gained through legal action. To better assist those wanting to learn more, Attorney Osborne is also currently offering free legal consultations to qualified parties.

BloodThinnerHelp.com reports on mounting numbers of Xarelto lawsuits which continue to be filed across the nation. Xarelto is a new-generation anticoagulant drug which is manufactured by Bayer AG and Johnson & Johnson’s Janssen Pharmaceuticals. In 2011, the blood thinner was approved by the U.S. Food and Drug Administration and released to the market. Since its initial launch as a revolutionary new blood thinner that provides users with new freedoms other blood thinners had been unable to in the past, Xarelto has become broadly considered dangerous, and is now the topic of more than 3,400 lawsuit filings from across the United States.
In addition to these growing lawsuit numbers, Xarelto has recently become the subject of increasing controversies as investigations have begun surrounding the drug’s clinical trial results and FDA approval process, as well as potentially critical data which was allegedly left out of reports sent to a prestigious medical journal.
Plaintiffs have been anxiously awaiting updates on these pending investigations, and, according to a recent article published in SBWire, so has Greg Grambor. Mr. Grambor is the president of Vascular PRN, a company which offers patients deemed to be at increased risk for the development of blood clots with an alternative prevention method to blood-thinning drugs like Xarelto. The company sells pneumatic compression devices for use by these patients. It is Grambor’s hope that his company’s offerings might become more widely used given the current controversies surrounding several blood-thinning drugs. He believes that his blood clot therapies can offer patients protection without the complicated health risks.
Grambor noted, “In cases where embolism prevention is the primary concern, pneumatic compression is a terrific alternative or supplemental therapy to warfarin and Xarelto.” He further explained, “It uses alternating compression to enhance blood flow and prevent clotting in the limbs of immobilized patients, such as those recovering from surgery, or sedentary patients such as those in nursing homes.”
Today, Xarelto’s 3,400 or more lawsuits are consolidated into two main groupings. Over 2,800 federally-filed Xarelto lawsuits have been transferred to a single court and consolidated by the U.S. Judicial Panel on Multidistrict Litigation, forming MDL No. 2592. In addition, more than 620 other Xarelto related lawsuits have been formed into a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania. Many believe that the lawsuit numbers in each of these groups will continue to grow as time goes on.
As the allegations surrounding Xarelto cause public concern, and new controversies surrounding a reportedly recalled medical device used during clinical trials on the drug now surface as well, it is certainly possible that people requiring treatment for potential blood clots could begin to consider alternative therapies like Vascular PRN and Greg Grambor distribute.
As those following the Xarelto lawsuits anxiously await the findings of current pending investigations, Attorney Joseph Osborne is working to help others who have taken the drug and who believe that it has negatively impacted their health in some way. He notes that these patients deserve to be provided with an opportunity to fully evaluate their legal rights in the matter, and indicates that they may be entitled to significant compensation gained through legal action. Affected patients who wish to investigate their rights further are offered free legal consultations from Attorney Osborne at this time.

BloodThinnerHelp.com reports on a lawsuit which was filed against Xarelto manufacturers Bayer AG and Janssen Pharmaceuticals (a subdivision of Johnson & Johnson corporation). The lawsuit referenced new-generation blood thinner Xarelto and was filed by a granddaughter on behalf of her grandmother who has passed away. The filing plaintiff claims that her grandmother died after suffering from a severe bleeding episode while taking Xarelto. Details of the lawsuit indicate that in September of 2014, the grandmother was given a prescription for the anticoagulant by her physician in order to treat her deep vein thrombosis (DVT). Only two months later, however, the grandmother suddenly suffered from an intracranial bleed (brain bleed) while having active blood thinner in her system. Physicians reportedly stated that the bleed was “irreversible and fatal,” and the woman died quickly afterward.
Further details surrounding this complaint indicate that the granddaughter claims that Xarelto was the cause of her grandmother’s fatal bleed. She explains that physicians were unable to clot the woman’s blood and stop her bleed, and unable to counter the effects of the drug. The plaintiff also reports that when deciding what blood thinner her grandmother should use, both she and her grandmother took note of several advertisements promoting the positive aspects of Xarelto without properly addressing dangerous potential side effects. She indicated that the defendants’ marketing tactics, “overstated the efficacy of Xarelto with respect to preventing stroke and systemic embolism.”
This particular lawsuit was filed in the U.S. District Court for the Eastern District of Louisiana under case number 2:15-cv-05874. At this point, it has been consolidated to form multidistrict litigation number 2592 by the U.S. Judicial Panel on Multidistrict Litigation and is housed with over 2,800 other Xarelto lawsuits which mention strikingly similar complaints. These cases are awaiting early 2017 bellwether trials and are being overseen by the Honorable Judge Eldon Fallon. Additionally, another 620 Xarelto lawsuits have been consolidated to form a mass tort program by the Court of Common Pleas in Philadelphia, Pennsylvania. Lawsuit numbers in both groups are expected to continue to rise.
Today, Attorney Joseph Osborne is working to assist others who have used the blood thinner and who believe that it has damaged their health in some way. He wants to ensure that affected patients are given the important opportunity to fully evaluate their legal rights, and notes that they may be entitled to significant compensation gained through legal action. To better assist those wishing to explore their rights in full, Attorney Osborne is currently offering complimentary legal consultations to qualified parties.

Apr 11, 2016 | Heygood, Orr & Pearson
By Michael Heygood
The Food and Drug Administration has launched an investigation into whether a faulty blood monitor may have compromised testing results that led to the agency’s approval of the bloodthinner Xarelto. Xarelto has been prescribed to millions of Americans since it was approved by the FDA and placed on the market in 2011.
Prior to receiving FDA approval, Johnson & Johnson and Bayer conducted a clinical trial for Xarelto known as Rocket AF, which lasted from 2006 to 2010 and involved about 14,000 patients. In Fall 2015, Johnson & Johnson informed the FDA that a device used in the clinical trial used to monitor patients taking warfarin known as INRatio had been recalled because it understated a patient’s risk of bleeding. The FDA is investigating whether the problems with INRatio may have caused doctors to give patients too much warfarin, which could have increased the number of bleeding events linked to the drug during the clinical trial and caused Xarelto to appear to carry a lower bleeding risk by comparison.
Researchers at Duke University who conducted the Xarelto clinical trial have also come under fire for failing to mention the existence of laboratory tests taken at two points during the trial that could have been used to determine whether readings generated by INRatio were accurate. Officials from the Yale University Open Data Access Project have asked Johnson & Johnson to make data from the Rocket AF clinical trial available as part of a standing agreement with the group so that experts can determine whether problems with the tests may have compromised the company’s results. Although Johnson & Johnson has agreed to make the data available, Bayer, the other drugmaker that marketed Xarelto, has refused.
Information about the FDA’s investigation into Johnson & Johnson and Bayer’s clinical trial for Xarelto were revealed in a legal brief filed recently by attorneys who are representing patients who have filed lawsuits against the two companies over severe bleeding episodes linked to the bloodthinning drug. Bayer and J&J are currently facing about 3,400 lawsuits in Pennsylvania and Louisiana filed on behalf of patients who suffered gastrointestinal bleeding, bleeding requiring a transfusion, or other severe bleeding episodes after being treated with Xarelto. The lawsuits allege that Bayer and J&J failed to properly warn patients about the risk of severe bleeding they could face from taking Xarelto.
Xarelto was marketed by Bayer and Johnson & Johnson to treat patients who were at risk of developing pulmonary embolism, deep vein thrombosis, or other blood clots, including patients who underwent hip or knee replacement surgery. Xarelto patients supposedly did not require the same level of monitoring as those who were prescribed warfarin. However, because there is no readily available antidote to counter Xarelto’s anticoagulant effects, it may be more difficult to stop severe bleeding episodes in patients who are taking the drug. This could increase their risk of severe and potentially deadly bleeding episodes.Xarelto Lawsuits Filed Against Bayer, Johnson & Johnson
Lawsuits filed against Bayer, Johnson & Johnson, and their subsidiaries have accused the drugmakers of deliberately hiding information about the dangers of Xarelto from doctors and patients. These lawsuits have also alleged that the companies knew about the health risks of Xarelto years before this information was made public, yet failed to warn patients about the health risks they might face from the drug.
Patients who have suffered gastrointestinal bleeding or other major bleeding events caused by the use of Xarelto may be eligible to file a lawsuit and receive compensation for medical expenses and other losses caused by their injuries. The first step in taking legal action is to speak with an experienced pharmaceutical litigation attorney who can help guide you through the process of filing a claim.

Canadian Xarelto Lawsuits Continue to Emerge
Apr 12, 2016 | LawyersandSettlements.com
By Gordon Gibb
While lawsuits pertaining to Xarelto Bleedout have been steadily increasing in the United States, similar lawsuits have been coming to the fore in other jurisdictions as well. To that end, a Xarelto lawsuit filed in Calgary last February and another that was expected to be filed in Ontario are representative of the risk inherent with the new-age anticoagulant that successfully reached the market without provision of a ready antidote.
According to the Calgary Sun (2/13/15), the lead plaintiff in the Canadian class action based in Calgary is Betty Samson, who is reported to have come very close to suffering a heart attack in September 2012 after experiencing internal bleeding while on Xarelto.
“They advised her that Xarelto was the cause of her hemorrhaging and that, unlike other anticoagulants such as Warfarin, there was no way to reverse the anticoagulant effects of Xarelto.”
As of February of last year, Health Canada - the Canadian counterpart to the US Food and Drug Administration (FDA) - had logged some 1,100 adverse effects related to Xarelto, according to the Xarelto Side Effects class action, stating further: “A dozen of those adverse events registered with Health Canada indicated that death had resulted from Xarelto,” the lawsuit says.
Attorneys close to the Canadian Xarelto file said at the time they were expecting a lawsuit on behalf of an 83-year-old woman from Ontario who is alleged to have bled to death in the shower, in November 2013.
Akin to US-based Xarelto Bleeding Issue lawsuits, the Canadian cases allege that defendants involved in the manufacture and marketing of Xarelto succeeded in bringing Rivaroxaban (Xarelto) to market without a ready means to reverse its blood thinning properties in the event of a hemorrhage or other Xarelto Bleeding complications. One of two heirs to the Coumadin kingdom, Xarelto appeared to meet the long-held wish lists of doctors and patients alike who had been hoping for an effective blood thinner that did not require the stringent monitoring of blood and diet that has always been a part of the warfarin (Coumadin) regimen in order to achieve optimum blood thinning without tipping the scales toward uncontrollable bleeding. Were a hemorrhage to occur, doctors knew they had the chance to reverse - or at the very least minimize - a bleeding issue with an infusion of vitamin K, the latter acting to reverse the thinning properties of warfarin.
In contrast, Xarelto was brought to market amidst claims that stringent monitoring was not required - at least to the same degree as that associated with warfarin. Needless to say, patients and their health care practitioners snapped up Xarelto in spades.
Plaintiffs now say had they known Xarelto was brought to market ahead of an available reversing agent or antidote, they would have stayed with warfarin. Plaintiffs also now allege that Bayer was negligent in promoting Xarelto as requiring less monitoring, when a reversing agent was not yet available to help with Xarelto Bleeding Complications.https://www.lawyersandsettlements.com/articles/xarelto/xarelto-lawsuit-death-bleeding-issue-39-21404.html

Makers of Xarelto Accused of Deceiving Top Medical Journal
Apr 13, 2016 | US Recall News
By Desiree Housek
The popular U.S. drug Xarelto has been the cause of controversy for quite some time now, with over 5,000 lawsuits nationwide, and 500 patient deaths allegedly tied to the drug. More recently, a document emerged, alleging that two major pharmaceutical companies misled medical journals by leaving out critical data on the drug.
USRecallNews.com previously reported on this. Seehttp://www.usrecallnews.com/document-claims-drug-makers-deceived-top-medical-journal/. Now this deception has reached the courts.
A brief recently filed in federal court claims that a letter published in The New England Journal of Medicine, primarily written by researchers at Duke University, left out critical data regarding laboratory results. The brief goes on to claim that the manufacturers of the drug, Bayer and Johnson & Johnson, aided in deceiving the editors by remaining silent while providing the same data to regulators in the U.S. and Europe.
The newly found data revealed that during trials testing the safety and effectiveness of Xarelto, in comparison to Warfarin, an older blood thinner, the blood-testing devices that were used had been recalled. USRecallNews.com also reported on this. See http://www.usrecallnews.com/defective-device-used-in-xarelto-trial/.
Researchers responsible for leading the original study have determined that use of the recalled device had no impact on the results; however, choosing to leave out such information is still considered to be an ethical problem.
The European Medicine Agency has concluded that the device was highly inaccurate, but most likely didn’t affect the outcome of the trials. The Food and Drug Administration is currently looking into whether or not the drug would have received approval knowing that a faulty blood-testing device was used.

Xarelto (rivaroxaban) has been the focus of an increasing number of lawsuits filed against Janssen Pharmaceuticals, a subsidiary of pharmaceutical giant Johnson & Johnson.
Though thousands have taken Xarelto, and many have begun filing adverse event reports, some potential plaintiffs may end up needing Xarelto lawsuit help.
You may want to seek Xarelto lawsuit help if you have experienced one of a number of complications after taking the popular blood thinner. The most dangerous of these complications, which often leads to a Xarelto lawsuit, is uncontrollable bleeding.
Xarelto bleeding complications occur because this drug, unlike warfarin, the traditional blood thinner, does not have an antidote that can reverse its thinning effects in case of a bleeding emergency.
People who file Xarelto lawsuits claim that they were not adequately warned about the bleeding risks of Xarelto, and would have chosen warfarin over the newer drug had they known of the risks. Warfarin has been widely used since 1954 and has a reliable antidote to counteract any major bleeding events.
What is Xarelto?
Xarelto is a new and popular anticoagulant, or blood thinner, that is used to prevent blood clots. Blood clots can be especially dangerous for patients with atrial fibrillation (irregular heartbeat), pulmonary embolism (blood clots in the lungs), or deep vein thrombosis (blood clots deep within the body).
Not all side effects of Xarelto are severe or dangerous, and not all users of Xarelto experience side effects. Xarelto is also linked with a number of other side effects, including decreased hemoglobin, hematoma, and difficulty breathing.
Those who do suffer from severe side effects can be in extreme danger, given that there is no antidote to counteract Xarelto’s effects.
Xarelto lawsuits allege that a series of clinical trials well known in the medical community has revealed a link between Xarelto and major bleeding events, such as gastrointestinal bleeding. The studies indicated that Xarelto had an even higher rate of major bleeding complications than other, similar drugs, including generic warfarin.
“Major bleeding” indicates that the bleeding involved a critical organ, led to reoperation, or led to fatalities.
Xarelto bleeding lawsuits claim that Janssen was not only aware of these studies and the bleeding risks of Xarelto, but the drug maker failed to report these major bleeding complications as significant adverse effects. On top of this, the Xarelto lawsuits allege that Janssen failed to adequately warn consumers and the medical community about dangerous Xarelto problems.
Despite the manufacturer’s alleged knowledge of these risks, the company continued to market Xarelto in a manner the Xarelto lawsuits describes as negligent and misleading, diminishing the concern for the serious risks of the drug.
Can Filing a Xarelto Lawsuit Help?
Contacting Xarelto lawsuit lawyers can help determine whether or not filing a Xarelto lawsuit is applicable to your situation. While a lawsuit cannot take away pain or suffering, Xarelto lawsuit help can start to alleviate the financial burden of medical bills and lost wages that Xarelto complications can incur.
Filing a Xarelto lawsuit can be one of the only ways to hold drug manufacturers accountable for their actions, including putting dangerous or defective drugs on the market.
If you or someone you know has experienced serious side effects such as internal bleeding after using Xarelto, you may be able to seek Xarelto lawsuit help and file a lawsuit against Janssen.

Serious safety issues continue to plague blood thinner Xarelto
Apr 12, 2016 | Penn & Seaborn
By Shane Seaborn
Lawsuits filed against Johnson & Johnson subsidiary Janssen Pharmaceuticals and Bayer Corp. over the blood thinner Xarelto have been consolidated in Louisiana federal court. Xarelto has been linked to serious side effects including internal bleeding, gastrointestinal bleeding, brain bleed and death. The Xarelto lawsuits come on the heels of the recent $650 million Pradaxa settlement. Researchers linked Pradaxa, also a blood thinning medication, to more than 500 deaths. Xarelto blood thinner litigation has been consolidated before U.S. District Judge Eldon Fallon in the Eastern District of Louisiana, who presided over suits against Merck & Co. over its medication Vioxx. The Vioxx litigation resulted in a $4.85 billion settlement in 2007.

KNOW THE WHOLE XARELTO STORY? THE RISKS & COMPLICATIONS OF TAKING XARELTO
Apr 11, 2016 | Brindisi, Murad, Brindisi & Pearlman
By Eva Brindisi Pearlman
Blood thinners have existed for some time now, however, new types of the drug are emerging; and those that are flying off the shelves may be a danger to consumers due to their lack of antidote. Xarelto is one of those medications.
Blood thinners are typically used in order to treat blood clots and prevent them from forming. But what causes blood clots? And how do drugs like Xarelto work?
How Blood Clots Form
Medical research tells us blood is a messenger for the body, carrying oxygen, food, hormones, medicine, and more throughout your body. Blood is also a vital line of defense when you suffer from injuries. When you get a cut, your blood clots to prevent germs and other contaminants from entering the wound. And a bruise? That’s essentially a blood clot under your skin. The blood clotted up to prevent internal bleeding from the hit. Therefore, a blood clot is a clump of blood cells that solidifies to block liquid blood from running past.
Your blood clots naturally to seal up wounds. However, if your blood clots elsewhere, it can cause serious health problems. For instance, a blood clot in your veins or arteries can block the blood flow through that vessel which can cause pain and swelling if the clot is located in an extremity. A blood clot that forms at or travels to your heart, lungs, or brain can be fatal.
The Dangers of Blood Clots
Further, medical research tells us clots may form in your heart as a result of an irregular heart rhythm, also known as “atrial fibrillation” or “Afib.” According to the FDA, over 3 million Americans suffer from atrial fibrillation. Patients with Afib, have a much higher risk of stroke as well as blood clots traveling to the brain causing these strokes. You are also at a higher risk for blood clots after major surgery. Surgeries such as hip and knee replacements have an extensive healing period. This means that the veins in your legs may become sluggish, giving it an opportunity to clot. Deep vein thrombosis or DVT is the development of a blood clot in a vein deep beneath the skin. DVT most commonly occurs in the lower leg. If a blood clot blocks blood flow to the lungs, it causes serious damage. This is called a “pulmonary embolism.” Furthermore, people who have often struggled with blood clots in the past are placed on blood thinning medication to prevent clots in the future.
Blood Thinners
Individuals with these conditions are usually prescribed blood thinning medication to prevent the blood from clotting. There are two different types of blood thinning medication: anticoagulants and antiplatelet drugs. Anticoagulants such as warfarin, a drug that has been around since the 1950’s, slows down the clotting process. Antiplatelet medications break up platelets that form the base of a clot, which then prevents the blood clot from forming. Aspirin is an example of an antiplatelet drug.
Side Effects Of Blood Thinners Like Warfarin
Nearly every medication has side effects, and blood thinners are no exception. Typically, the problem with blood thinning medication is it is too successful. As previously stated, blood clots do have some positive functions, therefore we do not want to completely prevent clotting, just those inside veins and arteries. But because blood thinners do not differentiate the area of the clot, individuals on blood thinning medication often are not able to stop bleeding if they are injured or undergoing surgery. Other common side effects include bleeding from the gums, uncontrollable nosebleeds, excessive bleeding from scratches or cuts, and frequent bruising. These side effects are a result of the blood that is not able to clot together, therefore it is difficult to stop bleeding.
Medication reacts differently from person to person, but sometimes blood thinners can turn deadly. Some are so effective that patients are at risk of bleeding to death, which often occurs during a surgery or other medical procedure. Furthermore, injuries causing a bruise or bump could potentially set off internal bleeding that is difficult to stop. If you are on blood thinners and begin to vomit blood or find blood in your urine, you may have an internal bleed and should seek medical attention immediately. Because of these dangerous side effects like serious bleeding, individuals on this medication must have regular check ups.
Antidotes
Blood thinners that have been in the market for a while like aspirin or warfarin have antidotes that reverse the process if they are too effective. They may also be removed by dialysis. Reversing the process or cleaning your body of the drug stabilizes your condition and the doctor may reevaluate your medication or dosage to create a better balance.
Warfarin vs. Xarelto
Warfarin has been the most popular blood thinner on the market for some time now; and with good reason. Because the dosage varies from person to person, it is difficult to take and also requires users to restrict their diet of foods that are high in vitamin K, like spinach or kale. Patients also have to have monthly exams to confirm the dose is accurate and warfarin is doing its job. Nonetheless, these minimal inconveniences may be worth it as it is both highly effective and has an emergency antidote. If users of warfarin have a dose that is too high, they can be given vitamin K to level it out.
Xarelto and other drugs like Pradaxa and Eliquis have recently been introduced to the market as blood thinning medication. They are more expensive, but appeal to the consumer. If you are on Xarelto instead of warfarin, you don’t have diet restrictions and constant monitoring isn’t needed.
Xarelto’s main ingredient acts on one specific enzyme in the clotting process. The FDA approved the medication for use in patients at risk for DVT and strokes caused by Afib in 2011. In the United States, Janssen Pharmaceuticals, a division of Johnson & Johnson, produces Xarelto. Bayer also produces the drug.
Side Effects of Xarelto
In a case where it’s too good to be true may be accurate, Xarelto has plenty of side effects. The drug can cause serious bleeding that may be uncontrollable. Other blood thinning medications have an antidote to reverse this process. Xarelto does not. Thus, patients taking Xarelto are at a greater risk of bleeding to death. Various antidotes are in the works but have yet to be approved by the FDA. Some blood thinners may also be removed via dialysis. Xarelto cannot be removed by this process. The FDA states that Xarelto is not affected by dialysis. Serious bleeding may be caused by a major surgery, but could also happen at home with a simple bruise. While on Xarelto, your body cannot form blood clots to prevent the process, so the blood keeps flowing. Once patients begin to experience severe bleeding while taking Xarelto, the consequences may be fatal.
FDA Involvement
The FDA has released numerous warning about Xarelto and has forced the makers of the medication to change their labeling several times. The FDA has specifically warned users of the risk of uncontrollable bleeding. In fact, the FDA has given Xarelto the black box warning, which is the most serious type of warning on drugs, due to the greater risk of stroke in patients that stop taking Xarelto prematurely as well as the increased risk for swelling and injury related with the use of epidural anesthesia while on Xarelto.
Makers of Xarelto are unbothered by this. Actually, they have applied to the FDA about expanding the approved uses of Xarelto to treat Acute Coronary Syndrome, a condition that over 1 million patients are hospitalized for each year. With the expansion, Xarelto has serious growth opportunity to add to their already estimated $3 billion sales yearly. The FDA denied this request.
What May Have Went Wrong
One of the clinical trials that lead to Xarelto’s approval for stroke prevention in patients who suffer from Afib is currently under investigation. In this trial, Xarelto was directly compared to warfarin while using a device called INRatio to test warfarin patients. This device was later recalled for inaccurate readings. Consequently, the results of this trial may have been skewed, putting Xarelto on a pedestal when compared to warfarin. The investigation is supposedly reaching a conclusion very soon, but individuals can’t help but wonder if Xarelto was a defective drug before reaching the consumer.
The FDA has repeatedly defended its approval of Xarelto Blood Thinner claiming that its benefits outweigh the side effects and “provides an important health benefit when used as directed. Xarelto also has a short half-life, so it is only in your system for 5-9 hours before your blood returns to normal.
Xarelto Lawsuit
Copious amounts of patients have suffered from the severe side effects of Xarelto. Many have come forward and have issued a lawsuit against its manufacturers Johnson & Johnson and Bayer. The lawsuits claim that the companies knew of the risks of the drug and failed to disclose these risks to medical professionals and patients. By withholding the fact that Xarelto may cause uncontrolled serious bleeding, they put thousands of patients at risk.
Multi-District Litigation
When a large group of people are harmed by the same cause, the individuals may sue together in a class action lawsuit. When the class sues together, every member shares in the outcome. Class action lawsuits are rare since it is very difficult to form a legally recognized class. Currently, there is no recognized class of Xarelto users. Nonetheless, it does not make sense for thousands of individuals to go at it alone. The victims may not have the resources for a lawsuit. In addition, different courts could reach a different decision on very similar cases, which would be unfair. A possible solution? A Multi-District Litigation, or MDL.
An MDL allows a large number of individual cases to benefit from parts of the class action process without actually needing to become a class. In an MDL, a large number of cases are combined into one proceeding for the pre-trial portions of the case. The pre-trial portions include pre-trial motions, discovery, and settlement sessions. An MDL is used to determine common questions of fact for a great number of cases. Essentially, an MDL concludes what happened. During this process, some cases may settle. Those that do not return to an individual trial, but the facts of the case are pre-determined by the MDL.
With lawsuits ranging from patients suffering severe gastrointestinal bleeding to filing a lawsuit on the behalf of a deceased loved one, thousands of lawsuits against the makers of Xarelto have been filed. Because of this, the U.S. Judicial Panel on Multi-District Litigation has consolidated the class-action lawsuit into an MDL in Louisiana. Moving forward, Honorable Eldon E. Fallon will hear bellwether cases, or test cases to see how the litigation is going to play out. These trials aren’t expected to reach the courtroom until 2017. The outcome of these bellwether trials will have a big effect on all of the outstanding lawsuits pending against these pharmaceutical giants. A verdict for the plaintiffs in this case would increase the chances that the defendant companies would opt to settle the remaining cases across the country.
Potential Xarelto Settlement
In settlement meetings, the parties will look at what a jury would award to each individual case. They would also discuss potential strengths and weaknesses if the lawsuit were to go to trial. When negotiating a settlement, the plaintiff should consider the following:
The severity and duration of the injuries from taking Xarelto;
Effects the Xarelto damage has had on the patient’s physical and mental health;
Past and future pain and suffering;Cost of medical expenses as a result of taking Xarelto;
Amount of lost wages or loss of earning potential;
Loss sustained by family members as a consequence of the patient’s health complications from taking Xarelto.
