J&J loses another talcum powder case, ordered to pay victim $55 million

By Glen Mclaughlin
In February, another St Louis jury awarded $US72 million to the family of Jacqueline Fox who died from ovarian cancer, which she said was caused by using Johnson & Johnson's baby powder and other talcum products.
Following a three-week trial with 12 jurors, nine ended up siding with Ms. Ristesund, landing her a narrow win in the case. In March, another jury ordered the company to pay $72 million to an Alabama woman who said she had used talcum powder for years to "stay fresh and clean".
In a statement, spokesman for Johnson & Johnson Carol Goodrich said the latest verdict contradicted 30 years of research into the safety of the company's talc products. The jury's decision should "end the litigation", he said, and force J&J to settle the remaining cases.
"There's now been three trials involving talcum powder, and all three juries have said 'you should have a warning, ' " Onder said.
The debate is heating up: some studies suggest that women regularly using talc face up to a 40 percent greater risk of getting ovarian cancer, while J&J presents medical proof that its Johnson's Baby Powder and Shower-to-Shower are faultless. Some researchers have said that links of talcum powder with ovarian cancer are unproven.
Ristesund's lawyer Allen Smith told jurors on Friday that his client was unaware about the health risk of talc powder that she was using for four decades.
The company knew about the possible health risks linked to the product and failed to warn consumers, her lawyers argued. She said concerns over talc led many doctors to advise mothers to stop using talcum powder on their babies, and to discontinue use for feminine hygiene. Johnson & Johnson positioned itself well as their target: Even though scientists have been publishing concerning studies for years, the company didn't forthrightly warn its customers there could be a major safety issue.
Now, another victim-who is still alive-is being awarded $55 million, including $5 million in compensatory damages and $50 million in punitive damages.
The jury finally voted 9-3 to make the award after most decided that talc was a contributing factor in ovarian cancer, Bloomberg reports.
The report noted that J&J shares were down 18 cents in after-hours trading to 112.57, dollars.
As stated in the lawsuit, Johnson & Johnson had the option of replacing the potentially unsafe substance with cornstarch, which has similar properties and is not a suspected carcinogen.
Meadows says, "what we're hoping is that Johnson and Johnson will finally do what they should have done decades ago and put a warning on the product".
