Endo International plc unit American Medical Systems Inc. on Friday said it has reached compromises in more than 100 injury suits in multidistrict litigation in West Virginia over health complications allegedly caused by a number of vaginal mesh devices.
In a joint motion to dismiss, AMS said it had compromised and settled claims in roughly 135 suits filed by women who said they had been injured by the the vaginal mesh devices. The devices included the Apogee and Perigee systems as well as the MiniArc Sling and the IntePro Y Sling, among other products.
The suits have claimed that the vaginal mesh devices at issue are defective and have caused chronic pain, incontinence and other injuries.
The women are represented by a number of firms, including Barton Law Firm and Nations Law Firm, which didn’t immediately respond to requests for comment. Attorneys for the other settling plaintiffs couldn’t immediately be reached for comment on Friday.
Last July, plaintiffs in another 100 suits reached settlements with AMS.
In May 2015, U.S. District Judge Joseph R. Goodwin, who is overseeing the litigation, said he’d been informed by counsel for AMS that approximately 108 plaintiffs had reached a settlement with Endo.
In April 2015, Endo told the judge it had “compromised and settled all claims” in about 360 cases.
Endo said in April 2014 that it had agreed to pay $830 million to settle a large chunk of suits over the alleged mesh injuries. Its agreement was with several plaintiffs' firms — includingMotley Rice LLC, Blasingame Burch Garrard & Ashley PC, Levin Simes LLP and Clark Love & Hutson GP — and sought to resolve some 20,000 claims in the ongoing litigation.
Seven separate MDLs comprising some 70,000 cases are pending in West Virginia over alleged pelvic mesh implant injuries. Ethicon is facing about 23,000 suits as part of its MDL, according to court records.
The U.S. Food and Drug Administration recently reclassified pelvic mesh devices like those at issue in the suits as high-risk devices that must undergo the agency's most stringent safety evaluation before hitting the market.
In late April, the Fourth Circuit affirmed a lower court's ruling that a case thrown out of another pelvic mesh multidistrict litigation was barred by a two-year statute of limitations, finding that the woman should've begun questioning the mesh's effectiveness by at least the end of 2007.
The three-judge panel said in an unpublished opinion that Brenda L. Robinson's claims, as well as her husband's derivative claims, came too long after the expiration of Utah's two-year statute of limitations for product liability actions. Robinson's case was cut from the MDL afterBoston Scientific Corp., which made the mesh, won summary judgment last year.
Representatives for Endo didn’t immediately respond to request for comment on Friday.
The settling plaintiffs are represented by Barton Law Firm and Nations Law Firm, among others.

Parliament gives recommendations for mesh

A Parliamentary committee is calling for a registry of the use of surgical mesh but has stopped short of backing an inquiry.
The health select committee has released a report in response to a petition from Carmel Berry and Charlotte Korte, who have both experienced complications from surgical mesh, and others.
The report makes recommendations to improve things for patients needing repairs of pelvic organ prolapses and stress urinary incontinence and repairs of hernias.
"Establishing a mesh implant registry would allow more detailed information to be collected about complications from mesh surgery," the report says.
Mesh complication symptoms include chronic pain, erosion of mesh, extrusion of mesh through tissue and organs, pain with intercourse, nerve damage, infection, neuro-muscular problems, and auto-immune diseases.
The committee says the petitioners called for an inquiry.
"However, we believe that, at this time, the recommendations in this report would address the petitioners' concerns".
Recommendations:The Government to work with medical colleges to investigate options for a centralised surgical mesh registry.Medical colleges review best practice around informed consent for mesh procedures.Coding for mesh surgery is consistent and include a system to allow patients with mesh complications to be identified and monitored.The adverse events reporting system be applicable to medical devices.Ongoing education for surgeons on the use of surgical mesh and mesh removal surgery.Consideration of expanding Medsafe's role over time to assess the quality and safety of medical devices.
