Today, however, after 5 years on the market, the drug is immersed in controversy, with over 3,400 lawsuits filed by users who claimed the drug caused excessive and uncontrollable internal bleeding. The thousands of lawsuits that have been filed are all against the same defendants, Bayer Healthcare and Janssen Pharmaceuticals (a subsidiary of Johnson and Johnson Corporation), the manufacturers of the drug. The cases allege very similar experiences that focus on uncontrollable bleeding precipitated from Xarelto’s use. In many cases, these bleeding episodes were fatal.
One lawsuit in particular focuses on the failure of Xarelto’s manufacturers to sufficiently warn patients of the potential risks associated with taking the drug.The lawsuit was filed by a couple in Texas in the Eastern District of New York, whose case is now part of the consolidated multidistrict litigation (MDL 2592) in Louisiana, which was approved by the U.S. Judicial Panel for Multidistrict Litigation (JPML).
The female complainant in this case was prescribed Xarelto by her doctor because she was at an increased risk of having a stroke due to atrial fibrillation. She claims that after only 5 months of taking the drug for her heart condition, she experienced a very quick onset of internal bleeding. She also states that because of the bleeding it has left her with some serious long-term health issues as well.
It should also be noted the number of new complaints and court filings has increased while those plaintiffs involved in the 3,400 already filed cases await their day in court to tell their stories and the stories of those who have died from excessive bleeding allegedly from using Xarelto.

There have been over 2,800 federally-filed complaints against Xarelto. Due to the magnitude of the complaints and similarities of the allegations against the drug’s manufacturers, Bayer AG and Janssen Pharmaceuticals, the latter of which is a subsidiary company of Johnson and Johnson Corporation, the United States Judicial Panel on Multidistrict Litigation (JPML) consolidated all cases and will be heard together in a multidistrict litigation (MDL). Since the consolidation and in the month of August 2015 alone, the MDL expanded by 400 more cases and that number is expected to increase even further as Xarelto lawsuits continue to grow in both Louisiana and Pennsylvania.
The MDL is being overseen by the Honorable Judge Eldon Fallon in the Eastern District of Louisiana. The cases encompassed in the MDL are inching toward litigation. He had set a January 11, 2016, deadline for having 40 bellwether cases in a pool from which 4 would be selected for bellwether trials beginning in the spring of 2017.

The court has released information regarding the first 4 cases that will be heard in early spring of 2017. The dates of the first two trials will be February 6th and March 13th of 2017. The second set of case dates released subsequent to these are April 24th and May 30th of 2017. These 4 cases were selected from an initial pool of 40 lawsuits that Judge Fallon directed to be compiled by January 11, 2016.

Xarelto was approved by the U.S. Food and Drug Administration (FDA) in 2011 to treat patients who were at an increased risk of stroke or blood clots due to various medical conditions or surgical procedures. Patients suffering from deep vein thrombosis, pulmonary embolism or atrial fibrillation, or those who required hip or knee replacement surgery were likely to receive the blood-thinning drug Xarelto. As a new-generation blood thinner, it was met with a lot of excitement upon its release to the market, however, it was not long after its release that patients began to experience potentially life-threatening side effects related to dangerous and sudden instances of uncontrollable bleeding.
Patients have used a number of studies that have been conducted on these various side effects to support their cases in court. One such study was done by two doctors of their own prompting. Judy Hun and John Hwang began to notice that many of their patients taking Xarelto began to suffer from episodes of eye bleeding, otherwise known as “spontaneous vitreous hemorrhage.”
After their own investigation, they concluded that the risk of eye bleeds could be increased in patients who had switched from using traditional blood thinners to Xarelto.
Another study conducted over the course of almost two years beginning on October 1, 2010, and concluding on March 31, 2012, evaluated the potential linkage of excessive bleeding to Xarelto. The study evaluated almost 46,000 users of blood-thinning drugs such as Warfarin, Pradaxa, and Xarelto. The primary conclusion was that the use of Xarelto produced much higher numbers of uncontrollable bleeding episodes than the other blood-thinning drugs included in the study.

Richard Polakowski, of Michigan, has filed a lawsuit against the makers of Xarelto, alleging the blood thinner caused him to bleed internally.
Polakowski’s lawsuit was filed in the U.S. District court for the Eastern District ofLouisiana against Johnson & Johnson, its unit Janssen Pharmaceuticals, BayerHealthcare, and their related companies. Polakowski’s lawsuit alleges breach of warranty, negligent misrepresentation and violation of the Consumer Protection Law.
Polakowski claims he began using Xarelto in 2013 until Aug. 14, 2013, when he says he suffered a serious Xarelto side effect – serious uncontrolled bleeding. He claims his injuries are severe, personal and permanent, and he is requesting compensation for his hospital expenses as well as his pain and suffering.

An Illinois man recently filed a Xarelto lawsuit, claiming that the blood thinner medication put him in the hospital for gastrointestinal bleeding.
Plaintiff Austin F.’s Xarelto lawsuit was filed against Janssen Pharmaceuticals, Bayer Healthcare, and a number of subsidiaries, and alleges that Xarelto caused him substantial injuries.
According to the Xarelto lawsuit, Austin began taking Xarelto in April 2014. On September 19, 2014, he began experiencing severe gastrointestinal bleeding and was admitted to the hospital for treatment.
The Xarelto lawsuit alleges that these Xarelto side effects were serious and painful, and have even caused permanent injury.
According to Austin, using Xarelto has directly caused physical and mental pain, hospitalization, diminished enjoyment of life, and medical expenses.
Austin further alleges in his Xarelto lawsuit that Janssen and Bayer were directly responsible for these injuries, as they were responsible for the design, testing, and marketing of the drug.

A women from Arkansas recently filed a complaint alleging the manufacturer of the prescription drug,Xarelto, knew about severe bleeding side effects, but failed to adequately warn consumers of the dangers, according to a report by the Louisiana Record.
The lawsuit was filed in the U.S. District Court for the Eastern District of Louisiana on April 7.
