It was barely two months ago that consolidated lawsuits in the Xarelto Lawsuit multidistrict litigation numbered about 4,500. Today, there are in excess of 5,381 pending in US District Court for the Eastern District of Louisiana. Pundits from the outset held that Xarelto, akin to Pradaxa, would result in heavy litigation due to the way in which it was brought to market, the requirement for less monitoring, and the Achilles’ heel that is any lack of an antidote.

  1. Vermont Woman Files Xarelto Lawsuit Alleging Father Died From Brain Bleed Linked To Drug

    Jun 11, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

June 11, 2016 – /PressAdvantage/ – TheProductLawyers.com reports on Xarelto a new-generation blood-thinning drug that has been alleged to cause spontaneous instances of uncontrollable bleeding resulting in long-term injuries or death in many cases. Since its release on the market it fast became the focus of a large number of lawsuits totaling more than 3,000 and have all been levied against Bayer AG and Janssen Pharmaceuticals, the makers of the drug. The latter is a subsidiary of corporate giant Johnson and Johnson.

One such case involves a woman who filed a lawsuit in a Vermont federal court on behalf of her deceased father who died suddenly of a parenchymal hemorrhage, more commonly known as a brain bleed. He was taking Xarelto at the time of his death and doctors were unable to save him since the drug prevented them from clotting his blood.

It should be noted that of the 3,000 Xarelto cases, 2,800 are federal court suits from all across the country that were consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPML). The multidistrict litigation (MDL 2592) is being overseen by a court in Louisiana. The reason such a large number of cases have been able to be consolidated is because they all bear strikingly similar allegations and have been filed against the same defendants, Janssen and Bayer. Such a step to consolidate these cases together will serve to hasten the litigation process, thus saving time and money for all involved in bringing the cases to trial. Additionally, consolidation will help to prevent many different rulings by numerous judges.

The trials of those cases included in MDL 2592 are progressing forward with the selection of a number of bellwether trials having occurred. An additional 550 having been lumped together in a mass group tort in Philadelphia, Pennsylvania by the state’s Court of Common Pleas.

  2. Xarelto Lawsuit Update: Plaintiffs Claim Marketing Tactics Are Deceptive

In this particular commercial, all of the cited celebrity individuals are talking about the benefits of Xarelto but they fail to sufficiently the numerous concerns that many patients have with the drug and the risks associated with using it.

Many plaintiffs in the numerous lawsuits filed since the drug was released to the market have a very different view of the drug than those being expressed in the commercial. A good number of those pursuing legal action against the makers of Xarelto find it disconcerting that they and many others have been put at an increased risk of experiencing potentially life-threatening uncontrollable bleeding that can lead to death in the extreme case.

There have been in excess of over 2,800 lawsuits filed against the makers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, with more expected. These suits all similarly allege that the drug puts users at an increased risk for uncontrollable bleeding episodes. These cases come from all across the United States and have been consolidated into a multidistrict litigation (MDL) number 2592. The MDL is being overseen by the Honorable Judge Eldon Fallon in the Eastern District of Louisiana.

It should be noted, that since its initial approval of the drug, the U.S. Food and Drug Administration (FDA) has given the new-generation blood thinner two black box warnings. The black box warnings are the harshest warnings that the FDA can give a product before it is ordered off the market completely.

  3. Xarelto Lawsuit Plaintiff Alleges Husband Died From Internal Bleeding Resulting From Xarelto Use

    Jun 13, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

TheProductLawyers.com reports on the U.S. Food and Drug Administration (FDA) approval of Xarelto in 2011, which at the time was launched as a new-generation blood thinner drug. Xarelto was unlike its predecessor anticoagulant drugs because patients did not require constant monitoring and special diets. Xarelto is now the focus of concern in an excess of 2,800 federally-filed lawsuits from across the United States along with 550 or more additional cases in a mass tort program created by an action of the Court of Common Pleas in Philadelphia, Pennsylvania.

One lawsuit in particular filed by a Florida resident on behalf of her deceased husband alleges the manufacturers of the drug failed to sufficiently warn consumers of the serious bleeding risks associated with Xarelto. The plaintiff is claiming that her husband's use of Xarelto to lessen the threat of having a stroke due to his atrial fibrillation caused his untimely death. He suffered an instance of uncontrollable internal bleeding that doctors could not stop since Xarelto was still in his system. This case was eventually transferred to the Eastern District of Louisiana with the U.S. Judicial Panel's consolidation order which is now being overseen by the Honorable Judge Eldon Fallon.

An action by the U.S. Food and Drug Administration (FDA) has given plaintiffs even more ammunition in their legal battle against the manufacturers of Xarelto. The agency has issued two black box warnings which are the harshest possible issuance prior to a product being fully removed from the market.

  4. Issuance of FDA Black Box Warnings Strengthen Plaintiffs Case in Xarelto Lawsuit

    Jun 13, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

TheProductLawyers.com reports on a South Florida resident whose husband died from internal bleeding while taking Xarelto, a new-generation blood thinner released on the market in 2011 after its approval by the U.S. Food and Drug Administration (FDA). The deceased’s wife filed a lawsuit on his behalf against the manufacturers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer Healthcare, stating they did not adequately warn consumers about the dangerous risks related to taking Xarelto, specifically the potential for significant and uncontrollable bleeding.

The plaintiff, in this case, alleges that Janssen and Bayer are responsible for her husband’s death because of bleeding that doctors were unable to stop. He died from a subdural hemorrhage. The deceased was taking Xarelto to decrease his risk of having a stroke that he was susceptible to because of his heart condition, atrial fibrillation.

When Xarelto was released it was touted as being different than the traditional blood thinners that came before it because patients taking it did not have to be constantly monitored nor did they require special diets. The drug was very popular upon its release yet quickly became associated with serious side effects as plaintiffs began filing lawsuits claiming the drug caused episodes of uncontrollable bleeding.

Xarelto now is the focus of 2,800 lawsuits filed in federal courts all across the United States. It is also the subject of 550 more in a mass tort program in Philadelphia, PA.

Recent actions were taken by the FDA which also seem to verify the alleged risks associated with taking Xarelto with its issuance of two black box warnings for the drug. A black box warning is considered to be the harshest that can be given to a product before being ordered to remove it from the consumer market.

The number of filed lawsuits against Bayer and Johnson & Johnson's subsidiary, Janssen Pharmaceutical Division, has now risen to more than 3,400 in number, with the bellwether trials set to start in 2017.

The number of lawsuits against Bayer and Johnson & Johnson's subsidiary, Janssen Pharmaceutical Division, continues to rise, as more plaintiffs file suit. Now, more than 2,800 cases have been consolidated in the Eastern District of Louisiana, with an additional 600 lawsuits consolidated by the Court of Common Pleas in Philadelphia, Pennsylvania (MDL 2592). The first two bellwether trials have been scheduled for trial on February 6th and March 13th of 2017, with the second two scheduled for April 24th and May 30th of 2017.

The lawsuits include claims of serious health problems, long hospital stays, and even death as a result of uncontrollable bleeding events. According to experts, there is no known antidote at this time.

Chris Janish, CEO of Legal-Bay, commented on the recent announcement, "We expected the Xarelto litigation to pick up steam, and as more lawsuits continue to be filed by plaintiffs all over the U.S., it seems that it's happening. 6. Xarelto Lawsuit Plaintiff Suffers Stroke On Anticoagulant, Questions Dosage

    Jun 15, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

TheProductLawyers.com reports on Xarelto, an anticoagulant approved in 2011 by the U.S. Food and Drug Administration (FDA). The drug's purpose is to impede strokes and blood clots for people suffering from a number of medical conditions or recovering from specific surgical procedures such as deep vein thrombosis and hip and knee replacement surgeries, respectively. An additional use of the blood thinner was added later to treat a common heart condition called atrial fibrillation.

Since the drug's approval, it has become the subject of controversy. The FDA has given the drug two black box warnings, which are the harshest warnings that a product can receive before it is potentially removed completely from the consumer market.

Xarelto is manufactured by a subsidiary company of the Johnson and Johnson Corporation, Janssen Pharmaceuticals, as well as by Bayer AG. Since its release on the market, Xarelto, and its manufacturers have been the focus of thousands of lawsuits including 550 in Philadelphia, PA consolidated by the Court of Common Pleas, and over 2,800 others consolidated in a multidistrict litigation (MDL 2592) in Eastern Louisiana. In all of these cases, the plaintiffs have alleged that the drug causes sudden instances of uncontrollable bleeding. One case, however, is notably different from the others in that it focuses on a new concern related to the marketed once-daily dosage regardless of the weight or size of the patient.

Xarelto is a once a day treatment, whereas other anticoagulants need to be taken twice daily. This new suit alleges that the once daily requirement is an ineffective amount. In this particular case, filed in October of 2015, the plaintiff suffered a stroke only 4 days after starting his treatment, as he was told he would be at risk of strokes due to his atrial fibrillation. He claims that not only did the drug not prevent his stroke, but he feels that Xarelto may have actually caused it.

  7. Ohio Plaintiffs In Xarelto Lawsuit Allege That Manufacturers Did Not Disclose Risks

    Jun 15, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

TheProductLawyers.com reports on the number of lawsuits that have been filed against the manufacturers of the anticoagulant drug Xarelto, Janssen Pharmaceuticals, a subdivision of the Johnson and Johnson Corporation, and Bayer AG. There have been more than 3,400 suits filed from across the United States since the U.S. Food and Drug Administration (FDA) approved the drug in 2011. Plaintiffs claim that the anticoagulant puts patients at a higher risk of experiencing dangerous and life-threatening bleeding episodes. Many of them have proven fatal. The plaintiffs in these cases also claim that the makers of the drug did not fully disclose to the public and to medical professionals prescribing the drug the dangerous side effects that could ensue when taking it.

The purpose of Xarelto is to treat patients suffering from deep vein thrombosis (DVT), pulmonary embolism, and atrial fibrillation, as well as those who are recovering from hip and knee replacement surgeries.

One of the 3,400 cases was filed by an Ohio couple who allege Xarelto caused the wife to experience a life-threatening gastrointestinal bleeding episode. She was taking Xarelto to minimize the chance of having a stroke because of her atrial fibrillation. The couple's court documents state that after only two months taking Xarelto, she developed internal bleeding, as well as anemia and some other unidentified medical conditions. The couple also claims the bleeding has caused the need for long-term medical care and supervision.

It should be noted as well that the U.S. Food and Drug Administration (FDA) has issued two black box warnings which are the most severe and harshest warnings that the agency issues.

  8. Ohio Xarelto Lawsuit Plaintiffs Claim Gastrointestinal Bleed Occurred As A Result Of Taking The Anticoagulant

    Jun 15, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

TheProductLawyers.com reports on a lawsuit filed by an Ohio couple requesting over $150,000 to compensate them for pain and suffering related to the adverse side effects of taking Xarelto, a blood-thinning drug approved by the U.S. Food and Drug Administration in 2011. The wife in the plaintiff couple was given Xarelto to treat her atrial fibrillation. After taking Xarelto for two months, she very suddenly experienced a gastrointestinal bleed, and anemia, as well as other injuries not specifically identified. The woman claims to still be impacted by the side effects of the drug and requires long-term maintenance and monitoring. The monetary payment being sought is to cover both current and future medical bills related to her condition.

This lawsuit, along with over 3,400 others all across the country has been brought against the makers of the drug, Janssen Pharmaceuticals, a division of corporate giant Johnson and Johnson, and Bayer AG. The plaintiffs in this case, as well as the others, commonly allege that the use of the anticoagulant has made the risk of experiencing instances of excessive bleeding more likely. Some of the bleeding episodes have proven to be fatal. The plaintiffs also generally claim that the manufacturers of Xarelto failed to adequately and sufficiently inform the public and those medical professionals prescribing the drug of the dangers and risks involved in using it.

When Xarelto was initially approved by the FDA, its intended use was for treating patients with medical conditions such as atrial fibrillation, deep vein thrombosis, and pulmonary embolism. The drug was also designed to treat patients that had undergone hip and knee replacement surgeries.

The FDA has issued two black box warnings to the blood-thinning drug. Black box warnings are considered a telling indication that a product could be on the verge of being wholly removed from the consumer market.

  9. Warnings And Investigations Arise As Xarelto Lawsuit Filings Increase

    Jun 16, 2016 | TheProductLawyers.com

    By TheProductLawyers.com

TheProductLawyers.com reports on Xarelto, a new-generation blood-thinning drug approved by the U.S. Food and Drug Administration's (FDA) in 2011. Since its initial approval of the drug, the FDA has issued two black box warnings which are the worst, most severe warnings the agency can give to a product. Such warnings can also denote a product's potential removal from the consumer market.

In addition to the black box warnings, there are have been over 3,400 lawsuits filed against the manufacturers of Xarelto, Bayer AG, and a subsidiary company of corporate giant Johnson and Johnson, Janssen Pharmaceuticals. Given the breadth of cases and the similarities between them in terms of allegations made against the makers, the cases, which come from all across the country, have been consolidated into two primary groups for litigation purposes. The first is comprised of over 2,800 federal cases consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPML). The multidistrict litigation (MDL) has been assigned number 2592 and is being overseen by a judge in the Eastern District of Louisiana, the Honorable Judge Eldon Fallon. The second is a mass tort program created by the Court of Common Pleas in Philadelphia, Pennsylvania with cases now in excess of 600. It is expected that the load of cases to be included in each of these groupings will continue to increase.

When it was released on the market in 2011, Xarelto was immensely popular since it allowed patients many freedoms that did not exist with blood thinners coming before it. The drug was approved to treat patients recovering from knee and hip replacement surgeries, as well as medical conditions such as atrial fibrillation, pulmonary embolism, and deep vein thrombosis. The drug has now become the subject of the lawsuits, black box warnings, and investigations into clinical trials and a potentially defective medical device used during those trials.

  11. Johnson & Johnson faces transvaginal surgical mesh lawsuits from California, Washington attorney generals

    Jun 10, 2016 | Heygood, Orr & Pearson Law

    By Michael Heygood

The attorney generals of Washington and California have filed transvaginal surgical mesh lawsuits against Johnson & Johnson over complications from these medical devices. The lawsuits allege that Johnson & Johnson has misrepresented the safety of its surgical mesh products for years, despite the fact that they have been linked to widespread complications in women who are implanted with the products during pelvic surgery.

Washington Attorney General Bob Ferguson and his California counterpart Kamala Harris say that although Johnson & Johnson’s transvaginal surgical mesh products have been linked to thousands of cases of injury, the company failed to warn doctors and patients about the serious and potentially permanent complications that can arise from using its pelvic mesh products. Some of the most widely reported complications from Johnson & Johnson surgical mesh include urinary dysfunction, loss of sexual function, constipation, and severe pain.

Johnson & Johnson and its subsidiary Ethicon are already facing thousands of personal injury lawsuits filed by patients who suffered complications from transvaginal mesh products. Lawsuits have also been filed against Boston Scientific, Endo International, and other manufacturers of transvaginal surgical mesh. In 2014, Endo agreed to a $830 million settlement to resolve the approximately 20,000 lawsuits filed against the company over its surgical mesh products. Johnson & Johnson is currently facing more than 35,000 lawsuits, Harris says.

Transvaginal mesh is commonly used to treat pelvic organ prolapse, a condition in which the bladder, bowel, or uterus may shift, often as a result of childbirth, hysterectomy, or menopause. Surgical mesh products can also be used in pelvic surgery to treat stress urinary incontinence, a condition involving loss of bladder control because of weakness or dysfunction in the bladder muscles.

Because of the high number of side effects cases associated with surgical mesh products used for transvaginal surgery, the Food and Drug Administration announced in 2016 that it would re-label these products in order to warn patients and doctors about the risk of serious complications. The FDA said that it reached the decision to add new warning labels to transvaginal surgical mesh due to the high rate of complications suffered by women who underwent surgery to treat pelvic organ prolapse or stress urinary incontinence compared with women who were treated using traditional surgical repair.Transvaginal Surgical Mesh Lawsuits Filed By Heygood, Orr & Pearson

If you or a loved one were injured by a surgical mesh product, you may be eligible to file a lawsuit and receive a settlement from the company that manufactured the device. Experts have found that surgery with mesh carries additional risks of complications while offering no additional benefits to the patient. Thousands of transvaginal surgical mesh lawsuits have been filed involving more than 50 different brands of implants against manufacturers, including Johnson & Johnson, Boston Scientific, C.R. Bard, Gynecare, and American Medical Systems.

  12. Woman Files Wrongful Death Lawsuit Against Xarelto Makers

    Jun 10, 2016 | RIghting Injustice

    By Jennifer Walker-Journey

San Francisco resident Leatrice Oliver is seeking justice for her deceased husband Melvin, after he suffered a brain hemorrhage allegedly caused by the prescription blood thinner Xarelto.

Mrs. Oliver filed her lawsuit on June 2 in the U.S. District Court for the Northern District of California against Johnson & Johnson, its unit Janssen Pharmaceuticals, Bayer Healthcare, and their related companies. Her lawsuit cites strict liability, manufacturing defect, failure to warn, negligence, and other counts.

Mrs. Oliver claims her husband took Xarelto from May 2013 until June 2014. Sometime between June 1, 2014, and June 3, 2014, Melvin suffered an interacranial hemorrhage that led to his death. 14. Xarelto Lawsuits Continue Unabated, Now Over 5,000 and Growing in Number

    Jun 16, 2016 | LawyersandSettlements.com

    By Gordon Gibb

    New Orleans, LA

It was barely two months ago that consolidated lawsuits in the Xarelto Lawsuit multidistrict litigation numbered about 4,500. Today, there are in excess of 5,381 pending in US District Court for the Eastern District of Louisiana. Pundits from the outset held that Xarelto, akin to Pradaxa, would result in heavy litigation due to the way in which it was brought to market, the requirement for less monitoring, and the Achilles’ heel that is any lack of an antidote.

Those gazes into the litigation crystal ball appear to have come to pass…

Coumadin (warfarin), the once de facto heritage blood thinner that also doubles as rat poison, has nonetheless remained effective as a viable anticoagulant for patients with atrial fibrillation or those at risk for stroke. Constant monitoring of diet and blood is required to maintain what is normally a delicate dance between effective blood thinning and sudden bleeds - but an infusion of vitamin K quickly reverses the thinning properties of warfarin, providing for the patient a reasonable chance to survive.

Still, doctors and their patients have been clamoring for a magic bullet that would provide all the benefits of warfarin without the need for constant monitoring.

Enter Xarelto, heralded as the savior from constant monitoring people were looking for - especially important to a health care system under constant strain from increased demand and dwindling resources.

There has always been a risk for uncontrolled bleeding with Coumadin. However, an emphasis on blood and diet monitoring (for example, how much asparagus a patient consumes) has been effective in associating a reasonably safe profile with warfarin.

The manufacturers of Xarelto brought Rivaroxaban (Xarelto) to market with much fanfare over a reduced need for monitoring. However, like warfarin, there is also a Xarelto Bleedout risk for Rivaroxaban. Attorneys conversant with the Xarelto file note that Rivaroxaban possesses a low therapeutic index, which lands Xarelto in both a safe and dangerous zone within a relatively close margin.

And then there is the lack of an antidote - a driver for most of the Xarelto Bleeding Issue lawsuits. Unlike warfarin, which can be reversed with an infusion of vitamin K, no such reversing agent was available when Xarelto entered the market. An antidote is reportedly being researched and is under development, but its eventual arrival will come too late for the thousands of plaintiffs who allege grievous Xarelto Bleeding complications and even Xarelto Death due to a hemorrhage that can’t be as easily brought under control.

One plaintiff, Ruth McGowan (Ruth E. McGowan v. Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals, Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Bayer Corporation, Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG, Case No. 2:2014cv02867, December 30, 2014, Louisiana Eastern District Court), filed a Xarelto lawsuit in 2014 on behalf of her deceased father. Thomas Dunkley had been prescribed Xarelto for only a month due to stroke risk, when he suffered a serious Xarelto Bleeding Issue in his brain and died.

Nancy Packard (Packard v. Janssen Research & Development LLC et al,Case No. 0:2014cv61448, June 23, 2014, Florida Southern District Court, Fort Lauderdale Office, Broward County) is another plaintiff suing the manufacturers of Xarelto after her husband suffered a Xarelto Bleedout in his brain. Doctors breached the man’s skull in an effort to relieve the building pressure, but the attempt was not successful in saving his life. He had been taking Xarelto for six months for atrial fibrillation when he died.

Plaintiffs are alleging that defendants were not only negligent in bringing Xarelto to market without an available antidote, but also in not adequately advising patients and their health care providers with regard to the lack of a reversing agent that had so long been a part of the warfarin equation. Plaintiffs also assert that defendants were negligent in suggesting that less monitoring was required when, given the lack of an antidote and the risk for a Xarelto Bleedout, monitoring is in effect even more integral.
