The claim made by the state is that 15,000 women had transvaginal meshes implanted without the hazards associated with the meshes being notified to either the patients or their surgeons.The meshes are intended to help women suffering from stress urinary incontinence and pelvic organ prolapse.

    The case has been brought under Kentucky’s Consumer Protection Act and it will be heard by the Franklin Circuit Court. With this, Kentucky Attorney General Andy Beshear told QMed that Ethicon ‘misrepresented’ a range of adverse events associated with the meshes.

    The adverse events included patients having problems going to the bathroom, chronic pelvic pain, pain during sex, or inability to engage in sexual intercourse. The Kentucky Attorney General claims these issues were not made prominent in marketing literature.

    In relation to this Beshear said: “The way this company clearly chose profits over people is outrageous.”

    The lawyer added further: “My office has talked to victims whose lives have been devastated by this company’s deceitful practices. We may not be able to give them back the lives they once had, but my office will do everything we can to hold this company accountable.”

    Johnson and Johnson disputes the charges and is preparing for a vigorous defense. In a statement, reproduced by Fierce Biotech, the company said: “The evidence will show that Ethicon acted appropriately and responsibly in the marketing of our pelvic mesh products. The use of implantable mesh is often the preferred option to treat certain female pelvic conditions, including pelvic organ prolapse and stress urinary incontinence, and is backed by years of clinical research.”

    The statement further explains: “Ethicon is concerned that this lawsuit will keep women from obtaining treatment for the often-debilitating symptoms of stress urinary incontinence.”
