    Rough Transcript: today tobacco companies make their annual payment to 46 states, the legacy of 7:42 PMa settlement that forced them to help cover smoking-related healthcare costs. opioid manufacturers and distributors are facing the possibility of a massive settlement for their industry, too. a federal judge in cleveland, ohio, is overseeing hundreds of lawsuits that aim to hold drug companies accountable for their alleged role in the opioid epidemic. "vice news" spoke james tierney, who was instrumental in coordinating the state cases against big tobacco about where the similarities to the big pharmalitigation begin and end. >> you get a lot to like with a marlboro. >> i don't think it's fair to say that tobacco and the pharmaceutical industry are similar. tobacco will kill you if you use it as directed. pharmaceutical opioids, if used as directed and properly prescribed, can relieve pain from people who are in terrible pain. why are opioids and why are opioids and tobacco put in the same category? it's simple. people are addicted. 7:43 PMin 2017, 70,000 americans died of drug overdoses. 70,000. that is more than all of the americans killed in the entire vietnam war, and we lost them in one year. and yet, we still are unable to understand the depth and the significance of this crisis. has the pharmaceutical industry done a lot of things wrong? absolutely! they have marketed these drugs. they took doctors out on trips. they suppressed research that didn't show what they wanted. >> less than 1% of patients taking opioids actually become addicted. they hired salespeople to go out into the doctors offices. they were selling it the way you'd sell used cars. they made billions of dollars, and they should be forced to put a lot of that money back into public health and just as with tobacco, they should stop their 7:44 PMmarketing practices cold. they used to give away tobacco. they would make it easy to steal tobacco from local stores. and it was all a very pernicious and sophisticated plan to hook children. and so lawsuits were the only option. so i jumped in and i helped the attorney general. >> will you raise your right hand? >> so we had to coordinate this and it was the litigation stress that discovered secret documents from the tobacco industry that showed they were marketing to children which was clearly illegal everywhere. eventually we had virtually every state sue and that provided sufficient leverage on the tobacco industry where we could generate a substantial settlement. >> we are going to hold them accountable, not only today, but into the future. >> we had a lot of success on getting the truth out. we had less success with the money, because once we got the money, other people wasted it. politicians want to get a quick fix. they wanted to not increase taxes or they wanted to pave 7:45 PMroads or build a bridge. and they used the tobacco money to do it. >> attorneys general from 41 states are seeking documents and information from the largest opioidmanagers, manufacturers, and distributors in america. >> a number of attorneys general began investigating the marketing practices of the opioidindustry, using a tobacco kind of model. now the judge could do several things. he's got to figure out a way to sort through these lawsuits and to settle them in the way that money goes to public health and doesn't just waste it the way they did much of the tobacco dollars. we should use it to address the huge issue at the moment which is the inability of addicts, 2.2 million addicts to get appropriate care.

    Rough Transcript: kentucky is filing a new lawsuit over prescribing painkillers. the rate at which it's been prescribed in their state because, apparently, at one point, more prescriptions being written out for opioid than people who live in the state. jen, what is more on one more state trying to fight back in their own way. >> and a very hard hit state. now they're going after johnson & johnson over the opioid crisis. a company we associate with baby powder, but the state top prosecutor said pay for ravaging our communities and destroying our families for profits. j&j said they acted appropriately and responsibly but the allegation is that the company flooded kentucky with very powerfully addictive pain killers while telling doctors and patients they were rarely addictive is the allegation.

    Rough Transcript: the problem with attorney generals, they are attorneys they are always suing people all the time yours is suing you related to education. he has also filed a suit today against johnson & johnson for decenting marketing practices when it comes to opioids his fifth suit to date when it comes to the pharmaceutical companies. are you on board with things like that. >> i am not on a board with anything that he does. i don't want to dock him personally, but the level of competence he has on any number of fronts -- he sues me repeatedly he aspires so much for political office these are political moves. does these for the headlines that he gets they are not thoughtfully done, not well laid out. i'm not on board with what he is doing at the broad level or the premise, but just about the way he does go about this.

    Rough Transcript: spokane county is joing the fight against the opioid crisis. county commissioners unanimously voted to join other counties across the state in a lawsuit against opioid manufacturers. the spokane regional health district says it spends about 5- million dollars a year treating nearly a thousand people for opioid addiction. in 2016 alone, 64 people died from overdoses in spokane county.

    Rough Transcript: the city of miami is taking 5:40 PMthe opioid -- our sister station has the details for us, an ana cuervo. >> reporter: that's right, 20 pharmaceuticalcompanies failed to disclose the danger associated with their drugs and that has contributed to the opioid crisis, the city of miami faced today. > reporter: overdoses in miami and the city have sen some o f the worst. >> even though we have increased calls for this type of situation, we adress demand for us to do our jobs accordingly. as a result, we had to increase the amount of narcan that we have had on hand to address these demands. > reporter: in 2015, city of 5:41 PMmiami fire rescue had to use narcan used to treat overdoses for some patient in the brink of death during 68 emergency calls and 2016, that number increased by 1,000. the medical medical examiner's office confirmed 540 deaths related to opioids in 2016. the city of miami is filing a lawsuit against pharmaceutical companies they aleged are ultimately responsible. >> enough is enough. these pharmaceutical companies have been responsible with the way they have been prescribing medications and it is not only hurting the residence of the city of miami because it is causing deaths, it is hurting miami's taxpayers and it is causing the city a lot of money and police and treat and things that are related to the prescriptions of these opioids. >> reporter: the city legal department chose the company in the lawsuits. city administration hoped to get more money from the pharmaceutical industry. >> we want responsibilities from these companies. it is not just about money but also the effects of these drugs and it needs to be transparent with people who are going to consume these drugs and prescribe them when they are necessary which has not been the case. >> reporter: attorneys have not revealed how much money they are seeking. they say they definitely want changes in the way these pharmaceutical companies do business and promote their products. reporting live from miami city hall,
