    Johnson & Johnson's (NYSE:JNJ) Ethicon subsidiary agreed to settle a bellwether lawsuit filed over its Prolift pelvic mesh product, the company confirmed today.

    "The parties have agreed to resolve the matter," Johnson wrote.

    The trial had entered its 5th day March 6 when jurors were informed of the settlement at about 11: 30 a.m., according to documents filed with the U.S. District Court for Southern West Virginia.

    A judge in that court, Judge Joseph Goodwin, has been assigned to oversee more than 70,000 product liability lawsuits filed against a slate of pelvic mesh manufacturers including Ethicon, Bard, BSX and Coloplast.

  4. Cook Medical Transvaginal Mesh Bellwether Trials Set to Begin

    So far in pelvic mesh litigation, the name of mesh manufacturer Cook Medical has not been heard. That is about to change.

    The federal court in Charleston, West Virginia, home of more than 70,000 product liability cases, is about to start a series of trials claiming defendant, Cook Medical, produced a defective product that has injured women. Charleston was chosen by a panel of federal judges to attempt to move similar pelvic mesh cases through the courts under one judge. Cook is one of seven defendants facing bellwether trials in this jurisdiction to test legal theories.

    Pamela Ailey v. Cook Group, Inc.; Cook Incorporated; Cook Biotech, Inc; Cook Urological Incorporated; Cook Medical Inc., of Bloomington, Indiana, (case number is 2:13-cv-18888) is set to begin April 20, 2015. Lingo v Cook Inc, et al. 2:13-cv-20359 is the backup case that will be tried only if Ailey is dismissed or otherwise not ready for trial.

    Ms. Ailey is a resident of Pleasant, Iowa. Her mesh was implanted in Huntsville, Alabama.

    Cook is one of the smaller mesh manufacturers. At this writing, there are 377 product liability cases filed against Cook Medical, Inc. that have been consolidated from around the country to this federal court in West Virginia before The Honorable Judge Joseph Goodwin.

    The action claims negligence, negligent misrepresentation, negligent infliction of emotional distress, breach of express warranty (promising safety, withholding information), a failure to warn her physician about the risks associated with the product, gross negligence for the rights of others, violation of consumer protection laws (for Iowa and Alabama, her implanting state), unjust enrichment, and knowingly marketing a dangerous medical device (strict liability). Ailey also asks for punitive damages to send a message to the company.

    Background

    Pamela Ailey was implanted with a Surgisis Posterior Graft July 29, 2009 to treat SUI (stress urinary incontinence) and POP (pelvic organ prolapse). As a result, she claims she’s experienced mental and physical pain, permanent injury, physical deformity, corrective surgery, financial loss and lost wages.

    This is not only the first bellwether trial for Cook Medical but is the first trial for a mesh that claims it is made from a material other than polypropylene, the polymer-based synthetic so common in hernia and pelvic meshes. Cook claims to be advancing the next generation of technology that include biologic/ device design. See more here.

    Cook claims its product are biomaterials from natural tissue sources using a porcine small intestinal submucosa (SIS) and therefore are resistant to infection and result in complete remodeling. The inflammatory response is limited to the area where synthetic sutures are/were utilized during surgery, according to Cook promotional materials.

    Defendants Claim

    The Defendants called it “A breakthrough technology, it incorporates the best attributes of a biologic graft –resistant to infection and complete remodeling – with the added benefits of moderate price, ease of use and widespread availability.” Here

    Cook claims here of its Biodesign products “And unlike synthetic mesh, nothing is left permanently in the body to cause problems down the road.”

    The Ailey complaint notes studies that support the product. Studies also show Surgisis Gold was inferior in aiding in the growth of fibrinolytic activity of human mesothelial cells; integration was insufficient; foreign body reaction was pronounced and shrinkage was excessive.

    Last year, U.S. Magistrate Judge Cheryl Eifert ordered Cook, and two related defendants, may not “discuss any aspect of the care and treatment of a plaintiff with the plaintiff’s former or current treating physician, regardless of whether the physician is an expert or a consultant,” she said. A treating physician may not be retained as an expert in these cases to opine on their own patient unless, “those opinions were documented by the treating physician in the patient’s medical record before the physician was retained by Cook to act as an expert,” Eifert said.

    Of the seven mesh manufacturers, Johnson & Johnson (Ethicon) has suffered a series of losses in recent cases and settling cases for an undisclosed amount in some instances. Boston Scientific was successful in a couple of cases in a Massachusetts courtroom before it lost a monumental $73 million case last year in Dallas. That amount was later cut in half due to tort reform but still sets a record for transvaginal mesh litigation. AMS (American Medical Systems) is in the process of settling its cases.

  7. J&J Mesh Bellwether Case Settled Following Earlier $5.7 Million Verdict

    A transvaginal mesh settlement has been reached in a lawsuit that had been selected for a bellwether trial as part of a federal mass tort against medical device maker Ethicon, a subsidiary of Johnson & Johnson. Details of the settlement were not disclosed. Only one day earlier, a jury in a different Ethicon mesh case had found in favor of the plaintiff, holding J&J liable for over $5 million in damages.

    Currently, there are over 70,000 cases in the courts concerning transvaginal mesh devices, which doctors have implanted to help women overcome problems such as urinary incontinence. Plaintiffs have argued that the devices can cause a considerable amount of long-term damage for some women. To deal with the heavy volume of cases, the courts have ordered the construction of several multidistrict litigations (MDLs) to consolidate and streamline the processing of many of these lawsuits. MDLs were created to encompass cases brought against seven different mesh manufacturers, including Ethicon.

    Bellwether cases are designed to set precedent for other lawsuits that are part of each MDL and to encourage parties to negotiate settlements.$5.7 million verdict came a day earlier

    The $5.7 million mesh verdict that preceded the settlement was handed down in the Superior Court of the State of California, Kern County. It is the fourth favorable jury verdict for a plaintiff challenging Ethicon and includes $700,000 in compensatory damages and $5 million in punitive damages. The case concerns the Abbrevo, a newer model of mesh product approved to treat urinary incontinence in 2010.

    The plaintiff testified that she experiences frequent pain that she expects to last for the rest of her life as a result of implantation with the mesh product. Jurors in the case found the defendant liable for the flawed design of their product and for failure to warn of possible injuries. The lawyers for the defendant believe, however, that they have good grounds for an appeal.Ethicon mesh settlement reached

    The Ethicon mesh settlement was reached only four days after the start of the bellwether trial. As with all other lawsuits involved in the vaginal mesh MDLs, the case was tried in the U.S. District Court for the Southern District of West Virginia under Judge Joseph Goodwin.

    Details of the case have not been released, though common complaints concerning the mesh devices involve recurring pain and infection, in many cases resulting from the mesh eroding through the vaginal wall and causing damage. Patients often must have follow-up surgery to remove the mesh and in some cases multiple surgeries are involved. In the worst cases, even surgery does not completely alleviate long-term damage, according to the complaints.

    Thus far, the parties in the majority of the MDLs have not reached the large scale settlements that would resolve the thousands of cases now pending in the court system. The one exception is the American Medical Systems (AMS) MDL, which included approximately 20,000 transvaginal mesh lawsuits. The company has set $1.6 billion in settlement money to resolve these complaints.

    Mesh mess continues… Ethicon, the division of Johnson & Johnson that makes TVT Abbrevo, one of many transvaginal mesh products that are the subject of several thousand lawsuits, has been found liable and ordered to pay $5.7 million to plaintiff Coleen Perry.

    The jury hearing Perry’s case deliberated for three days and found that Ethicon’s conduct regarding the TVT Abbrevo vaginal sling amounted to “malice,” her lawyer said. They awarded Perry $700,000 in compensatory damages and an additional $5 million in punitive damages.

    This Ethicon verdict makes the fourth against the company. Currently, over 36,000 lawsuits have been filed against the TVT manufacturer in both state and federal courts, all alleging the devices, which are used to treat stress urinary incontinence and pelvic organ prolapse, are defectively designed and result in significant personal injury.

    Perry claimed the Abbrevo mesh began to erode in her body, causing pain that she said she expects to last the rest of her life, Reuters reported.

    The FDA approved Abbrevo, one of Ethicon’s newer models of mesh products, in 2010, specifically to treat stress urinary incontinence. Perry, received her implant in 2011. She said she began experiencing a “pulling-type” pain almost immediately after surgery, Reuters reports.

    The case is Perry et al v. Luu et al, Superior Court of the State of California, Kern County, No. 5-1500-CV-279123.
