Xarelto Lawsuit Alleges Xarelto is Defective

A Xarelto lawsuit has alleged that Xarelto is fraudulently represented.
In his Xarelto lawsuit, plaintiff Jermaine M. alleges that the makers of Xarelto negligently left out or downplayed serious potential health problems their drug could cause.
Xarelto is a blood thinner or anticoagulant, a class of drugs designed to be used to decrease the risk of stroke, some types of heart attack, and other medical problems wherein an errant blood clot lodges in the blood vessels that feed critical internal organs. Blood thinners are given to patients at risk for this type of medical problem in order to decrease their risk of suffering these life-threatening events.
But all blood thinners carry the risk of working too well. Without the ability to form blood clots, a person can bleed to death from a very minor injury. Sometimes, blood thinners like Xarelto make it too hard for patients to form blood clots. Older blood thinners like Warfarin have an available reversal agent. This means that if a patient on Warfarin suffers from uncontrollable bleeding, doctors can give them the reversal agent, allowing them to form blood clots and stop bleeding. However, newer-generation blood thinners like Xarelto do not have known reversal agents, although drug companies are racing to get a working reversal agent through human trials. In the meantime, patients with Xarelto bleeding are difficult for doctors to treat. At present, doctors must rely on massive transfusions to try and keep patients alive.
According to this Xarelto lawsuit, the makers of Xarelto did not adequately test the drug, and mostly relied on information about other blood thinners when advertising and promoting Xarelto. His Xarelto lawsuit says that Jermaine M. suffered a life-threatening Xarelto bleeding incident from the drug. His Xarelto lawsuit holds that the makers of Xarelto exposed him to the risk of uncontrollable bleeding when they marketed a drug that Jermaine holds was not adequately tested and did not have an available reversal agent. His Xarelto bleed lawsuit claims that it was fraudulent to promote Xarelto based on available data, when safer alternatives like older blood thinners existed, and holds that Xarelto’s makers hid their knowledge of these defects from the public, the FDA, and the medical community.
This Xarelto lawsuit seeks to recoup the cost of emergency medical care, allegedly required due to uncontrollable bleeding caused by Xarelto. The Xarelto lawsuit also seeks to recoup compensation for ongoing medical costs, pain and suffering, lost wages/lost income potential, and other costs allowable under law.

Xarelto Lawsuits Over Internal Bleeding Risks Continue

A dozen plaintiffs recently filed a Xarelto lawsuit against Janssen Pharmaceuticals and Bayer Healthcare, accusing the drug manufacturers of failing to properly warn about the bleeding risks associated with their new-generation blood thinner.
The Xarelto bleeding lawsuit states that if Janssen Pharmaceuticals (a subsidiary of Johnson & Johnson) and Bayer had properly warned of the Xarelto side effects, then the plaintiffs would have opted not to take the medication, and the physicians would have instead prescribed warfarin, a medication whose effects on internal bleeding can be treated with high doses of Vitamin K.
According to the Xarelto lawsuit, one plaintiff suffered a stroke and the remaining plaintiffs allege Xarelto caused serious gastrointestinal bleeding. The Xarelto injury lawsuit further alleges that the defendants placed their desire for profits before consumers’ safety by failing to properly research the risk of Xarelto bleeding or provide adequate warnings about the serious and potentially life-threatening health problems that may be caused by use of Xarelto.

A growing number of plaintiffs already have filed Xarelto lawsuits and more are expected. Some of these Xarelto lawsuits have been consolidated as follows:
Xarelto Multidistrict Litigation
A federal panel of judges has granted a request to centralize pending and subsequent Xarelto lawsuits in the U.S. District Court, Eastern District of Louisiana. The U.S. Judicial Panel On Multidistrict Litigation (JPML) issued an order in 2014 to transfer over 50 Xarelto cases pending in 22 districts to the Louisiana court for consolidation under U.S. District Judge Eldon E. Fallon.
According to the order, the JPML found that the pending Xarelto claims have common issues, such as the adequacy of the blood thinner’s warning label about the risk of severe bleeding and other injuries, the results of certain clinical studies, and the alleged need for blood monitoring.
Additionally, the judicial panel maintained the Xarelto complaints have common allegations including plaintiffs suffering significant bleeding or other injuries, the defendants did not warn about the blood thinner’s potential to cause severe or fatal bleeding, and Xarelto does not have an antidote should severe bleeding occur in patients.
Xarelto Mass Tort
Administrative Judge Kevin Dougherty of the Philadelphia Court of Common Pleas recently issued an order that has created a mass tort docket for Xarelto bleeding lawsuits filed against Janssen Pharmaceuticals and Bayer Healthcare Pharmaceuticals. The Jan. 21 order affects at least 75 cases that share common allegations regarding the medication, including uncontrollable bleeding that may lead to wrongful death. The cases will be transferred to the Pennsylvania state court’s Complex Litigation Center.
A mass tort action is different from a class action lawsuit. In the latter type of litigation, one lawsuit is filed on behalf of many plaintiffs and will be resolved by a sole trial or settlement deal. In contrast, plaintiffs participating in a mass tort reserve their right to an individual trial by jury.
The plaintiffs involved in this action had argued in favor of the creation of a mass tort, noting that their allegations “are virtually identical and arise from the identical conduct of defendants.” The plaintiffs’ motion went on to note that these common allegations involve the unreasonably dangerous nature of the defendants’ product, Xarelto, which has been linked to severe and uncontrollable internal bleeding that can be fatal.
The Xarelto Lawsuit is Case No: 2:15-vc-01971, in the U.S. District Court for the Central District of California. The Xarelto MDL is In re: Xarelto Products Liability Litigation, Case No: 2592, in the U.S. District Court for the Eastern District of Louisiana.

Bayer teamed up with Johnson & Johnson subsidiary Janssen Pharmaceuticalsto produce Xarelto, which became the second drug in a new class of blood thinners called Xa inhibitors. The anticoagulant is used to prevent or treat blood clots in patients undergoing hip or knee replacement surgery, and to prevent strokes in some heart patients, such as those with the common heart rhythm ailment atrial fibrillation.
Xarelto hit the market in 2011, just a year after Boehringer Ingelheim’s Xa inhibitor Pradaxa hit the market. It proved to be perfect timing. Reports of life threatening bleeding events including gastrointestinal bleeds, brain hemorrhages and rectal bleeding in patients treated with Pradaxa were beginning to surface.
As physicians became more wary of Pradaxa, Bayer and Janssen makers began to push Xarelto as a safer alternative, spending upwards of $11 million to market the drug. Boehringer, meanwhile, agreed to pay $6.5 million to settle about 4,000Pradaxa lawsuits as Xarelto sales skyrocketed toward blockbuster status.
But the glory was short lived. Soon, reports of adverse bleeding events with Xarelto began to surface. In 2012, the anticoagulant was linked to 2,081 serious adverse events, of which 151 resulted in death.
Now Bayer and Janssen are facing a mass of Xarelto lawsuits. Attorneys with Beasley Allen Law Firm are investigating cases of uncontrolled bleeding in patients who used the drug Xarelto.

West Virginia Man files Xarelto Lawsuit

According to the West Virginia Record, Jermaine Tavon McMillan filed a Xarelto lawsuit in the U.S. District Court for the Northern District of West Virginia on February 20. He claims that the defendants, including Janssen, Bayer Healthcare, and others, acted in negligence by failing to accurately represent the risks of Xarelto to doctors, the FDA, and the public. McMillan also claims that the defendants fraudulently misrepresented the safety and benefits of Xarelto.
Like other plaintiffs in Xarelto lawsuits, McMillan alleges that the defendants did not perform sufficient testing into Xarelto side effects including the risk of internal bleeding. He says that as a result of this negligence, he suffered serious injuries as well as permanent personal injuries, suffering, diminished enjoyment of life, medical expenses, loss of wages, and other damages.
In response to this lawsuit, a representative of Janssen Pharmaceuticals, William Foster, stated, “After more than three years on the U.S. market, and more than 2 million patients prescribed in the U.S. to date, the benefit-risk profile of Xarelto remains favorable and consistent with its clinical trials. All anticoagulants, or blood thinners, carry the risk of bleeding, and the prescribing information for Xarelto has always warned of these risks.”

A dozen plaintiffs suing the manufacturers of Xarelto are accusing Janssen Pharmaceuticals Inc., a unit of Johnson & Johnson (J&J) and Bayer Corp., of putting the health of Americans at risk from Xarelto side effects while continuing to market their blockbuster drug for significant profit.
What’s more, the Xarelto lawsuit notes that unlike Coumadin (warfarin) - until recently the gold standard of blood thinners - Xarelto requires none of the rigorous and ongoing testing required of warfarin. The plaintiffs hold that Xarelto manufacturers were misguided when making such a claim.
The plaintiffs filed their Xarelto lawsuit in California federal court March 20, alleging that Xarelto caused Xarelto bleeding events and, in one case, a stroke.
For years, doctors and their patients have been searching for an anticoagulant, or blood thinner, that didn’t require the stringent monitoring required of warfarin use. The latter has proven effective and reliable provided careful dietary restrictions and ongoing monitoring is followed. When Xarelto and one other new-age competitor appeared on the scene - both claiming stringent monitoring was no longer required - doctors and their patients snapped them up.
It should be noted that Coumadin is not infallible. Even with the careful monitoring in place, bleeding events can occur. However, doctors could rely on the application of vitamin K, which serves as a reversing agent to swiftly counteract the thinning properties of warfarin. An antidote, if you will.
There is no such tool in the Xarelto tool kit. Plaintiffs assert that using Xarelto puts patient lives at risk, and assert in their Xarelto lawsuit that product labeling may not have sufficiently warned about the possibility of Xarelto uncontrollable hemorrhaging. Plaintiffs also assert that those involved in the manufacturing and marketing of Xarelto wrongly communicated to health care providers that follow-up testing was not necessary.
All the plaintiffs in the present suit were prescribed Xarelto for “atrial fibrillation and/or the prevention of potentially dangerous blood clots,” according to court documents, and allegedly suffered either gastrointestinal or rectal bleeding as a result. Some of them were hospitalized, including one man who had a stroke.There is an increasing level of activity on the Xarelto lawsuit front. In December, the US Judicial Panel on Multidistrict Litigation consolidated nearly two dozen lawsuits at federal court in Louisiana involving similar claims. That was followed in January by the creation of a new mass tort in the Philadelphia County Court of Common Pleas. As of mid-January there were 73 cases alleging Xarelto bleeding events.
Plaintiffs allege Janssen and Bayer could have been more forthcoming with warnings about the possibility of Xarelto side effects, including the possibility of Xarelto irreversible brain bleeding and other occasions of Xarelto uncontrollable hemorrhaging that cannot be reversed due to the lack of an effective antidote.
The plaintiffs hold they never would have used Xarelto had they known the risks, and reference the “fervent marketing of Xarelto,” that misinformed patients and doctors as to the necessary monitoring precautions required for patients taking blood thinners.

The plaintiffs claim that Johnson & Johnson’s (J&J) Janssen Pharmaceuticals unit and Bayer Corporation failed to warn about potential Xarelto problems that caused gastrointestinal bleeding.
One of the claimants suffered a stroke as a result of a Xarelto bleeding event.
Xarelto was marketed as a more convenient alternative to the anticoagulant warfarin, which required patients to undergo routine blood level monitoring. The manufacturers failed to warn patients to monitor blood levels to determine if they were at risk of internal bleeding.
Xarelto users should alert their doctor if they experience:
Frequent nose bleeds, Unusual gum bleeding, Unusually heavy menstrual bleeding or vaginal bleeding, Red, pink or brown urine, Red or black stool, Coughing up blood or blood clots, Vomiting blood or what looks like coffee grounds, Headaches, dizziness or weakness, Pain, swelling or new drainage at wound sites
In the complaint, Xarelto attorneys question whether J&J and Bayer wrongly told health care providers that follow-up blood testing was not necessary for patients taking Xarelto, Law360 reported.
About 130,000 Xarelto prescriptions were written in the U.S. during the first quarter of 2012, according to an article in the Huffington Post.

Heart Surgery Patient Sues Over Xarelto Bleeding Complications

California plaintiff Mary B. is suing the drug companies Bayer and Janssen Pharmaceuticals for the injuries she allegedly incurred from Xarelto (rivaroxaban), a drug she was prescribed after heart surgery to avoid blood clots. Mary claims that as a direct result of using the defendants’ product, she suffered life-threatening internal bleeding injuries that could only be stopped through emergency intervention.
The Xarelto lawsuit states that after undergoing cardiac ablation surgery, the plaintiff was prescribed Xarelto on Nov. 14, 2012, to prevent possible blood clotting during recovery. Xarelto is typically prescribed to patients with atrial fibrillation who are at high risk for stroke, but is also approved to prevent clotting in certain surgical recovery situations.
Despite the defendants’ Xarelto advertisements promising quick and efficient progress, the plaintiff allegedly experienced dangerous complications soon after starting the drug. After only five days of using Xarelto, Mary’s right kidney started bleeding and she developed a life-threatening internal bleed. Mary had to be hospitalized for a period of time, and must frequently see her doctor to monitor her recovery progress, according to the Xarelto lawsuit.
Mary is filing legal action against Bayer and Janssen for allegedly failing to warn her about the side effects of Xarelto. Xarelto’s label contained no warnings or indications that bleeding incidents were possible, nor did it warn that there was no reversal agent to stop such a bleeding incident, the Xarelto lawsuit claims. Mary alleges that at no point in time did the defendants warn her of this complication, or provide her or her physician with any relevant studies.
The Xarelto bleeding lawsuit states that Bayer and Janssen had the civil responsibility to warn the plaintiff and other Xarelto patients of possible bleeding complications because the public and medical community rely on labels to provide adequate and accurate information. Mary insists that she never would have used Xarelto if she had known about the possibility of irreversible bleeding injuries.
Mary is suing Bayer and Janssen Pharmaceuticals for being allegedly responsible for manufacturing, selling, distributing and marketing a dangerous drug. The charges include negligence, false advertising, concealing information and misrepresenting a product.

Overview of Xarelto Bleeding Complications
Xarelto is a part of the new generation of blood thinners that manufacturers produced as alternatives to warfarin. When the FDA approved Xarelto on Nov. 4, 2011, Bayer and Janssen Pharmaceuticals released the drug in a joint effort to compete against warfarin and the first new-generation blood thinner, Pradaxa.
Like its predecessors, Xarelto was approved to treat patients with atrial fibrillation and to prevent stroke in high-risk patients. Upon Xarelto’s release, the manufacturing companies met with almost instantaneous success. Xarelto beat out Pradaxa’s place at the top of the anticoagulant market within one year of its release.
Xarelto’s place at the top of the market, however, came with large advertising costs. In 2013, Janssen and Bayer reportedly spent at least $11 million purely for Xarelto marketing purposes, making it the most advertised pharmaceutical drug during the third quarter of 2013. The campaign included ads designed to encourage patients to ask their physician about Xarelto. This effort paid off, as Xarelto garnered $582 million in global sales during its first year of release. By the end of 2013, U.S. physicians had written approximately one million Xarelto prescriptions.
Despite its popularity, Xarelto allegedly causes serious side effects, including a particularly deadly one. Numerous patients have reported suffering severe and life-threatening bleeding injuries after using Xarelto, and needing emergency intervention to prevent death.
Thousands of product liability lawsuits state that the manufacturers of Xarelto and the other new-generation blood thinners neglected to mention that the blood thinners lack a stopping agent to control such bleeding events. While the new anticoagulants boast to be faster and more convenient than warfarin, the first-generation anticoagulant warfarin came with a reversal agent and required patients to undergo frequent dose adjustments from their doctors.
Many medical experts believe that Xarelto patients would have been at much less risk if they had been required to have regular doctor visits, and if they had been warned about the lack of reversal agent. This has led to the mass Xarelto litigation movement that Janssen and Bayer are facing today.

12 File Xarelto Lawsuit in California Superior Court

A dozen plaintiffs have filed a Xarelto lawsuit in California alleging the blood thinning medication was responsible for serious complications they experienced. According to the complaint, which is currently pending in U.S. District Court, Central District of California, all of the plaintiffs named in the lawsuit experienced either gastrointestinal or rectal bleeding, and one suffered a stroke.
Law360.com reports that all of the individuals named in the California complaint were prescribed Xarelto to treat atrial fibrillation or to prevent blood clots. In some cases, the complications they experienced were serious enough to warrant hospitalization. The lawsuit notes that the complaint could potentially be transferred to the U.S. District Court, Eastern District of Pennsylvania, where dozens of similar Xarelto cases have been consolidated before a single judge for coordinated pretrial proceedings.
Like other Xarelto claims pending in U.S. courts, the California case alleges that the drug’s manufacturers failed to warn doctors and patients about its potential to cause life-threatening internal bleeding and other serious complications. Plaintiffs also assert that the companies misinformed doctors and patients by promising that the drug does not require frequent blood monitoring, which is standard for some other anticoagulants. Rather, they assert that Xarelto patients would benefit from such monitoring. Finally, they point out that there is currently no approved antidote for internal bleeding that sometimes occurs with Xarelto. If this case is transferred to the federal multidistrict litigation in Louisiana, it would become one of more than 200 claims pending in that jurisdiction. In addition, at least 169 Xarelto lawsuits have been filed in a mass tort proceeding underway in Pennsylvania state court in Philadelphia, all of which allege similar injuries and make the same assertions about the way the medication was marketed.

Louisiana Woman Sues Xarelto Makers Over Bleeding Risks

A Louisiana woman is suing the makers of the blood thinner Xarelto claiming she was never warned that using the drug could cause her to suffer serious, uncontrolled bleeding.
According to the lawsuit, Deborah Lyons was prescribed Xarelto in March 2014 by her doctor to prevent strokes. While using the drug, Lyons suffered three severe bleeding events and had to be hospitalized to receive blood transfusions on three separate occasions.
Xarelto is used to prevent or treat blood clots and strokes in some heart patients, and blood clots in patients who recently underwent knee or hip replacement surgery. It was approved in July 2011, and was the second in a new class ofanticoagulants to hit the market.
In 2012, Xarelto was associated with 2,081 serious adverse events, of which 151 resulted in death. Xarelto side effects include gastrointestinal bleeds, rectal bleeding, and brain hemorrhages.
Lyons’ lawsuit is one of hundreds waged against the makers of Xarelto overbleeding side effects and failure to warn.
Lyons’ lawsuit was filed in the U.S. District Court of the Eastern District of Louisiana and targets Janssen Research and Development (formerly known as Johnson and Johnson Pharmaceutical Research and Development), Janssen Ortho,Janssen Pharmaceuticals Inc. (formerly known as Ortho-McNeill Janssen Pharmaceuticals), Bayer Pharma, Bayer Healthcare and Bayer Healthcare Pharmaceuticals.
The lawsuit claims the drug makers “negligently and/or fraudulently represented …that Xarelto had been tested and was found to be safe and/or effective for its indicated use.”
