The decedent was prescribed Xarelto by his doctor to prevent blood clots and stroke for atrial fibrillation, a heart condition for which Xarelto is FDA approved to treat. After taking Xarelto, the decedent was admitted to hospital for a brain bleed, which was diagnosed as a parenchymal hemorrhage. The blood thinner prevented the decedent’s blood from clotting and stopping the bleed, which unfortunately lead to the death of the plaintiff’s father. According to the complaint, the plaintiff’s father was hospitalized for 6 days while extreme measures were taken to stem the bleeding. Xarelto is a new form of blood thinner that is marketed by it’s manufacturers for its convenience compared to traditional blood thinners like Warfarin. New Xarelto Bleeding Injury Lawsuit Filed by NC Plaintiff

A plaintiff from North Carolina has filed a Xarelto bleeding injury lawsuit over complications she claims stem from thedrug’s lack of reversal agent and its manufacturer’s failure to provide adequate warning about this flaw.
Tahkiya Daniels, of Halifax County, NC filed her complaint (Case 2:15-cv-01783) on May 28 in the U.S. District Court, Eastern District of Louisiana. The complaint outlines that Daniels was using Xarelto (the brand name of the blood thinner rivaroxaban) for conditions that may have included stroke risk, atrial fibrillation, deep vein thrombosis, or pulmonary embolism and was prescribed the drug by her physician on May 28, 2013.
Although the drug was purportedly safe, Daniels experienced “dangerous side effects including life-threatening bleeding” as a result of the drug’s undisclosed bleeding risks. The complaint also lists “other severe and personal injuries which are permanent and lasting in nature, physical pain and emotional and mental anguish, diminished enjoyment of life, shortened life expectancy, medical expenses, loss of earnings or earning capacity, and other economic and non-economic damages” for which Daniels is now seeking compensation.Xarelto bleeding injury lawsuit joins growing number of cases
The Daniels complaint joins a growing number of cases that have been filed concerning Xarelto bleeding risks. Xarelto, like Pradaxa and Eliquis, are “new generation” blood thinners that purportedly offered an advantage compared to older standby medications, chiefly warfarin. However, whereas warfarin patients experiencing serious hemorrhaging problems could be treated with a reversal agent, Vitamin K, no such agent is currently available for the new drugs.
The Daniels complaint, and others, charge that the defendants hid the problems with bleeding risksand a lack of reversal agent from the FDA, from physicians, and from the public at large.
The complaint states that the defendants made claims about Xeralto that were fraudulent and that they did not perform sufficient trials (“if any”) that included human subjects in order to ascertain the safety of the drug, and that they relied on “safety information that applies to other non-valvular atrial fibrillation treatment and DVT/PE treatment and prophylaxis, which does not entirely and/or necessarily apply to Xarelto whatsoever.”Xarelto injury lawsuit filed as part of Louisiana MDL
Although the plaintiff is from North Carolina, her complaint will be filed directly as part of a Xarelto multidistrict litigation (MDL 2592 – Xarelto Products Liability Litigation) currently taking place in the Lousiana federal court system with presiding Judge Eldon Fallon. Currently, well over 400 lawsuits have been consolidated as part of this MDL, which is designed to streamline and process efficiently and fairly the growing number of complaints over Xarelto side effects.
The MDL was established in December of 2014 and new complaints are added frequently. The next step for the MDL will be to determine cases that will be good candidates for preliminary (or “bellwether”) cases to set precedent as part of the litigation process.
In addition to the federal litigation process, there is also a state level mass tort taking place in Pennsylvania. Judge Kevin Dougherty currently presides over the approximately 200 claims that have been filed in the Philadelphia Court of Common Pleas. The mass tort was established in January of 2015.

Xarelto Science Day “Ground Rules” Established in MDL

With parties planning to present non-adversarial medical and research information about the potential side effects of Xarelto next week, the U.S. District Judge presiding over hundreds of lawsuits has laid out ground rules for the “science day”.
Since December 2014, all Xarelto lawsuits filed throughout the federal court system have been consolidated before U.S. District Judge Eldon Fallon in the XXX, as part of an MDL, or multidistrict litigation.
All of the complaints involve similar allegations that Bayer Healthcare and Johnson & Johnson’s Janssen subsidiary failed to adequately warn consumers and the medical community about the bleeding risks associated with their medication, which has been linked to hundreds of reports involving uncontrollable hemorrhages and deaths.
As part of the coordinated pretrial proceedings, Judge Fallon has scheduled a Xarelto “science day” for June 11, at which time each side will be able to present information to the court regarding the bleeding risks associated with Xarelto and similar Factor Xa novel oral anticoagulants. The presentations are designed to be in an objective format, without advocacy.
In a pretrial order (PDF) issued on May 21, Judge Fallon outlined the procedures agreed to by the parties to educate the Court on the basic issues in the litigation and avoid duplication in presentation.
Such science days are increasingly common in complex pharmaceutical lawsuits, allowing each side to present information about the science and medical issues that are likely to come up during the Xarelto litigation.
Judge Fallon’s order notes that the presentations will not be admissible for any purpose other than educating the court. There will be lecture-style presentations by physicians and scientists, without any cross examinations.Xarelto Bleeding Risk
Xarelto (rivaroxoaban) was introduced in 2011 as a superior replacement for Coumadin (warfarin) for reducing the risk of blood clots among individuals at risk for deep vein thrombosis or pulmonary embolism. Since it hit the market, the drug has been aggressively marketed and has quickly grown to become one of the top selling medications in the United States.
While all blood thinners carry a risk of bleeding injury, Xarelto has been linked to a surprising number of problems as more and more patients are switched to the novel anticoagulant.
Xarelto has been promoted as easier to use than warfarin, since it does not require regular blood monitoring. However, several recent studies have raised questions about those claims, with researchers suggesting that Xarelto blood monitoring may actually help doctors identify patients at the greatest risk of bleeding.
In addition to failing to warn about the risk of bleeding and importance of blood monitoring, plaintiffs pursuing bleeding claims against Bayer and Janssen allege that the drug makers withheld information about the lack of a Xarelto reversal agent, which doctors could use to stop hemorrhaging that may develop among users.
While warfarin’s blooding thinning effects can be quickly reversed in an emergency, there is no antidote for Xarelto.
Similar allegations were raised in the litigation over Pradaxa, which is another new-generation anticoagulant introduced by Boehringer Ingelheim in October 2010, one year before Xarelto hit the market. More than 4,000 Pradaxa lawsuits were filed by users of that drug who suffered bleeding injuries. Following several years of litigation, Boehringer Ingelheim ultimately agreed to pay $650 million in Pradaxa settlements, with an average of about $150,000 per claim.
As part of the coordinated pretrial proceedings in the Xarelto litigation, Judge Fallon is expected to select a small group of claims to go through case-specific discovery and be prepared for a series of early trial dates. While the outcomes of any early trial dates will not be binding on other claims, they will heavily influence eventual Xarelto settlement negotiations to resolve the litigation.

Parties in Xarelto MDL to Select Bellwether Cases

Parties in the Xarelto blood-thinner multi-district litigation have been ordered to select which cases will participate in bellwether trials, a sample of cases with similar facts.
Bellwether trials help provide parties from both sides insight about how future juries may rule and also help minimize the inconvenience to the court, the witnesses, the lawyers and the parties. Bellwether cases are used when there are a large number of plaintiffs with similar claims.
The federal judge overseeing the Xarelto litigation in the U.S. District Court in the Eastern District of Louisiana has ordered the parties by June 15 to establish procedures to select the bellwether cases and to begin specific discovery. A proposed case management order detailing the procedures is to be submitted to the court by June 30.
Initially approved by the U.S. Food & Drug Administration in 2011, Xarelto has been widely prescribed as a treatment for stroke prevention in people with atrial fibrillation (arrhythmia of the heart), deep vein thrombosis (blood clots deep within the body) and pulmonary embolism (blood clots in the lungs), stroke, and prevention of deep vein thrombosis in patients undergoing hip or knee replacement surgery.
Xarelto plaintiffs allege that pharmaceutical companies Johnson & Johnson, Bayer, and Janssen Pharmaceutical used misleading marketing to position Xarelto as a superior blood thinner alternative to Coumadin (warfarin) for anticoagulant therapy. Coumadin has been on the market since the 1950s.
Patients taking Coumadin must adhere to dietary restrictions and regularly have their blood checked. Xarelto users does not require regular blood tests or a special diet, two of the drug’s key selling points.
Xarelto lawsuit plaintiffs claim, however, that they were not adequately warned of the risk of severe bleeding, known as a bleedout, as well as the lack of an approved reversal agent for the new-generation blood-thinner. Coumadin bleeding episodes can be reversed by administering vitamin K to the patient.
A black box warning on the Xarelto label includes information about the increased risk of blood clot formation after premature discontinuation of the medication in the absence of adequate alternative anti-coagulation.
Severe internal bleeding and death are Xarelto’s most commonly reported side effects, but others include thrombosis (blood clots), decreased hemoglobin (a substance that carries oxygen in red blood cells), cerebrovascular accidents (an event that leads to a cerebral hemorrhage), hematoma (a semisolid mass in the blood), peripheral edema (swelling of the lower limbs), and dyspnea (difficulty breathing).
Xarelto is in the same class of drugs as Pradaxa (dabigatran), another of the newer anticoagulants also facing a slew of lawsuits in which plaintiffs have alleged bleeding complications. Pradaxa manufacturers Boehringer Ingelheim GmbH agreed to pay $650 million in a comprehensive settlement of lawsuits brought against Pradaxa.
The settlement was expected to resolve some 4,000 lawsuits brought by plaintiffs in the United States. Researchers linked Pradaxa to more than 500 deaths.

Study Suggests Xarelto Carries Higher Risk for Gastrointestinal Bleeding

For several years now, anticoagulant drugs Pradaxa and Xarelto have been linked with serious bleeding events, some of which have caused hospitalizations and even death. The courts have been busy processing lawsuits filed by injured plaintiffs who claim manufacturers overstated the benefits of these medications while downplaying the serious side effects.
Both Pradaxa and Xarelto were marketed as being more convenient options to warfarin, the leading anticoagulant for decades, because they allegedly worked just as effectively in reducing stroke and other risks of blood clots, but required no blood monitoring or dietary adjustments. A new study, however, suggests that these newer drugs may be more dangerous than older ones—directly contradicting the manufacturers’ messages about the products.
Study Suggests Bleeding More Likely with Xarelto
On April 24, 2015, the British Medical Journal published a new study by researchers from Johns Hopkins Bloomberg School of Public Health, George Washington University, and Johns Hopkins Medicine in Baltimore.
Researchers examined a large administrative database of commercially insured people in the U.S. from October 1, 2010 through March 31, 2012. They were looking for those who had a prescription for warfarin, dabigatran (Pradaxa), or rivaroxaban (Xarelto) and who were 18 years or older. In the end, they came up with 46,163 on Pradaxa, 1,649 on Xarelto, and 39,607 on warfarin. (The lower number for Xarelto was likely because the drug wasn’t FDA-approved until July 2011.)
Results showed the following:
• Patients taking Xarelto had a risk for gastrointestinal bleeding that was twice as high as patients taking warfarin.
• Patients taking Pradaxa had as much as a 50 percent increase in the risk of gastrointestinal bleeding.Researchers concluded: “Although rates of gastrointestinal bleeding seem to be similar in this commercially insured sample of adults in the United States, we cannot rule out as much as a 50% increase in the risk of gastrointestinal bleeding with dabigatran compared with warfarin or a more than twofold higher risk of bleeding with rivaroxaban compared with warfarin.”
Other Studies Show Similar Risks of GI Bleeding
This isn’t the first time researchers have suggested that Xarelto may lead to more gastrointestinal bleeds. In 2012, a new analysis of data from one of the early clinical trials on the drug (ROCKET-AF) also found that risk of gastrointestinal (GI) bleeding events occurred more frequently in patients receiving rivaroxaban than warfarin.
“Both major and non-major, clinically relevant GI bleeding were more common in patients with AF [atrial fibrillation] taking rivaroxaban than warfarin.”
A 2013 study found similar results, reporting that in a pooled analysis of randomized controlled trials, patients receiving “newer” oral anticoagulants like Pradaxa and Xarelto were more at risk for GI bleeding than patients on standard care.
Plaintiffs who have filed Xarelto lawsuits claim the manufacturers should have done more to warn patients and doctors of the risks, and should have conducted more studies on the drug to be sure that the once-a-day convenient dosing was truly advisable for everyone.
